<br />on the 19th day of October, 1945, the instruments purporting to be the last will and testament
<br />and Codicil thereto of Fred Beberniss deceased, were filed for probate in this Court. That on
<br />the 14th day of November, 1945, said instruments to which this certificate is attached were duly
<br />proved, probated and allowed as the last will and testament and Codicil thereto of the real and
<br />personal estate of said Fred Beberniss, deceased, and the same was ordered to be recorded in the
<br />records of the Court aforesaid.

<br />Fred Beberniss, Deceased. )
<br />BE IT REMD4BERED that on this 31st day of May, A.D. , 1946, it being the day fixed for approving
<br />the final account of the administrator, with will annexed, and hearing on his petition for final
<br />settlement and determination of heirship, and it appearing from proof on file that due notice was
<br />given by publication of the time heretofore fixed for said hearing, and there being no objections
<br />on file, and the court being fully advised in the premises finds:
<br />1. That Fred Beberniss died testate on the 11th day of October, A.D. 1945, a resident of Hall
<br />County, Nebraska, and left surviving him as his next of.kin and. heirs -at -law the following named
<br />persons, to -wit:

<br />Walter Beberniss, a
<br />Fred Beberniss, a
<br />Hazel Pedersen, a
<br />Mabel Baas ch, a
<br />Raymond Herman, a
<br />Elmer Herman, a

<br />deceased daughter)
<br />that he left no widow, other living children or other living issue of deceased children, and that
<br />the above named children and grandchildren are the sole and only heirs of his estate.
<br />2. That on the 14th day of November, A.D., 1945, the last will and testament of the said
<br />Fred Beberniss, deceased, and the codicil thereto, wq.s duly approved, allowed and admitted to
<br />probate; that on said day H.G.Wellensiek was appointed administrator, with will annexed, qualified
<br />as such and has been acting in said capacity ever since.
<br />3. That due notice irTas given to creditors of the time limited in which to file claims against
<br />said estate; that such time has duly expired and all claims against said estate, including the
<br />expenses of his last illness and funeral and the costs and expenses of administration, have been
<br />paid in full; that the further presentation of claims against said estate has been forever barred
<br />by a former orderl.entered herein; that there is no inheritance tax due the Estate of Nebraska,
<br />and no federal estate tax due the United States of America.
<br />4. That the report of the administrator, with will annexed, filed herein is in all things
<br />true and correct and should be approved and allowed as his final .report; that all the acts-and
<br />doings of said administrator, with will annexed, should be approved; that there is no personal
<br />property or money in the hands of said administrator, with will annexed, for distribution; that
<br />all of the cash received by the said administrator, with will annexed, was expended in the payment
<br />and discharge of the claims filed against and the expenses of said estate.
<br />5. That the said Fred Beberniss died seized and possessed of the following described real
<br />estate, which by the terms and provisions of his last will and testament, And the codicil thereto,
<br />was devised as follows, to-wit:
<br />The Westerly one -half 6f Lot 7, in Block 26, of the Original Town, now City of Grand
<br />Island, Nebraska, devised to Walter Beberniss.
<br />Lot 2, of the County Subdivision of the West half of the Southwest quarter, of Section 10,
<br />in Township 11, North of Range 9, West of the 6th P.M. in Hall County, Nebraska, devised to
<br />Ellen Weaver.
<br />The Easterly 33 feet of the Northerly 82 feet of Fractional Lot 4, in Fractional Block 104,
<br />in Railroad Addition to the City of Grand Island, Hall County, Nebraska, devised to Fred
<br />Beberniss.
<br />The Westerly 33 feet of the Northerly 82 feet of-Fractional Lot 4, in Fractional Block 104,
<br />in Railroad Addition to the City of Grand Island, Hall County, Nebraska, devised to Ellen
<br />Weaver and Ida Poore, to each an undivided one -half thereof.
<br />6. That the said Fred Beberniss is also known as Alfred Beberniss, and the said Northerly
<br />82 feet of Fractional Lot 4, in Fractional Block 104, in Railroad Addition, to the City of Grand
<br />Island, Hall County, Nebraska by mistake was erroneously described in said will as Fractional
<br />Lot 4, in Fractional Block 104, in Railroad Addition of the City of Grand Island, Hall County,
<br />Nebraska.
<br />IT IS THEREFORE CONSIDERED, ORDERED, ADJUDGED AND DECREED by the court:
<br />1.
<br />That the report of H.G.Wellensiek, Administrator, with will annexed, filed herein be and the
<br />same is hereby in all things ap- proved and allowed, and for his final account and in full settle-
<br />ment of his trust; that each and every act and doings of said administrator with will annexed be and
<br />the same is herby approved; that he be discharged and he and his surety released from all further
<br />liability on his official bond.
<br />11.
<br />That the said Fred Beberniss died testate on the 11th day of October, A.D., 1945, a resident
<br />?f Hall County, Nebraska, that he left surviving him as his next hf kin, and heirs -at -law, Ida
<br />oore and Ellen Weaver, daughters, Walter Beberniss and Fred Beberniss, sons, Hazel Pedersen and
<br />Mabel Baasch, granddaughters, Raymond Herman and Elmer Herman, grandsons, all of legal age; that
<br />he left no wido7,T, other living children, or otherliving issue of any deceased children, and that
<br />said children and grandchildren are the sole and only heirs of his-estate.
