<br />Now on this 19th day of September, 1945, this cause came on for hearing upon the Petition
<br />of Henry Mader, praying for a settlement of the estate of John R.Meves, deceased, for a determin-
<br />ation of his heirs and the right of-descent of his real estate, and the degree of kinship of his
<br />heirs -at -law, and for a decree settling his estate.
<br />And it apn earing to the Court from the proofs on file that due and legal notice has been
<br />given by publication for three successive weeks as by law provided, to all heirs -at -law and to
<br />the other persons interested in said estate, of the filing of said petition, and of the time and
<br />place fixed for a hearing on the same, and there being no objections thereto, this cause was duly
<br />submitted to the Court upon the petition and evidence in support thereof.
<br />The Court bQing duly advised, finds that the allegations in the said petition are true; that
<br />Henry Mader, the petitioner herein, is the owner of a the real estate described herein, and is
<br />a competent and proper person to prosecute this proceeding.
<br />The Court further finds that the said John R.Meves departed this life on the 13th day of
<br />April, 1943, in Grand Island, Hall County, Nebraska, and that he was the owner in fee simple
<br />title of an undivided one half interest in and to Lot Three (3) in Block Ten (10) in Joehnek's
<br />Addition to the City of Grand Island, Hall County, Nebraska, and that more than two years have
<br />elapsed since the death of the said John R.Meves; that no application has been filed for the,
<br />appointment of an administrator for said estate, and no application has been had upon the estate
<br />of the said John R.Meves, deceased.
<br />The Court further finds that the said John R.Meves, was, at the time of his death, married;
<br />that he left surviving him as his heirs -at -law and only heirs -at -law, his widow, Metha A.Meves,
<br />a son, Detlef Meves, and his daughters, Viola Bachman and Hulda Schultz, all of whom are of
<br />legal age.
<br />The Court further finds that under the laws of the State of Nebraska in force at the time of
<br />the death of the said John R.Meves, the real estate described herein passed and descen ed in
<br />absolute title as follows: 1/3 thereof to Metha Meves; 2/9 thereof to Detlef Meves; 09 thereof
<br />to Viola Bachman; and 2/9 thereof to Hulda Schultz.
<br />The Court further finds that the funeral expenses of the said deceased have been paid; that
<br />all debts of said deceased were paid; that if any claims are outstanding they are barred and
<br />precluded, and the Court further finds that the costs of this proceeding have been paid.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the said John R.Meves died
<br />intestate on the 13th day of April, 1943; that no application for appointment of an administrator
<br />for his estate has been made, nor has there been any administration upon his estate in the State
<br />of Nebraska; that said deceased was the owner in fee simple title of an undivided one half in-
<br />terest in Lot Three (3) in Block Ten (10) Joehnek's Addition to the City of Grand Island in Hall
<br />County, Nebraska;.that the petitioner herein, Henry Mader, has acquired 112 interest of the
<br />above named heirs in said property by Deed, and that he is a competent person to prosecute this
<br />proceeding; that the deceased left surviving him the heirs -at -law above named, and upon the death
<br />of the said John R.MeVes, the real estate herein above described passed and descended as follows:
<br />1/3 thereof to Metha Meves; 2/9 thereof to Detlef Meves; 2/9 to Viola,Bachman, and 2/9 thereof
<br />to Hulda Schultz.
<br />IT IS FURTH'R ORDERED, ADJURED, AND DECREED BY THE COURT that all debts of said deceased
<br />have been paid; that the funeral expenses have been paid; that if there are any outstanding
<br />claims, the same are forever barred and precluded; and it is also ordered by the Court that
<br />further administration of said estate is hereby dispensed with, and said estate is hereby settled
<br />and closed.
