<br />Now on this 16th day of August,1945,this cause came on for hearing upon the petition of Raymond
<br />H.West,praying for a settlement of the Estate .of Mary J.West,deceased,for a determination Of the
<br />heirs and the right of descent of her real estate,and the degree of kinship of her heirs-at-law,
<br />and for a decree settling her estate;and it appearing to the Court from the .proofs on file' that
<br />due and legal notice has been given by publication for three successive weeks as by law, anal the
<br />order ,of this Court provided, to all heirs -at -law, and other persons interested in said estate of
<br />the filing of said petition, and of the time and place fixed for hearing on the same; and there
<br />bean no objections thereof,this cause was duly submitted to the dourt upon petition and evidence
<br />In support thereof;and the Court being duly advised,finds that the allegations in said petition
<br />are true,and that Raymond H.West,the petitioner herein,is the present owner of the real estate
<br />described herein,is a competent and proper person to prosecute this proceeding;that the said
<br />Mary J.West,departed this life in Hamilton City,California on the 27th day of July,l939,and that
<br />she had previously been a resident and inhabitant of Hall County,Nebrasta, and the owner *fee
<br />simple title to the East Half of the Northeast quarter (EI'NEi) of Section Four (4) in Township
<br />Ten (10),North,Range Twelve (12) West of the 6th P.M. in Hall County,Nebraska;that more than six
<br />years have elapsed since her death;that no application has ever been made in the State of ]Nebraska
<br />for the appointment of an administrator for her estate,and no petition has been filed for that
<br />purpose,and no administaation has ever been made on the Estate of Mary J.West,deceased.
<br />The Court further finds that the said Mary J,West was,at the time of her death,a widow;that she
<br />left surviving her as her heir -at -law, and only heir -at -law, her s6n,Raymond H. West, res iding ! in
<br />Hamilton City,California,and that the said Raymond H.West is of legal age.
<br />The Court further finds that under the laws of the State of Nebraska in force at the time of the
<br />death of the said Mary J.West,the real estate described herein passed and descended in absolute
<br />title to Raymond H.West,her son.
<br />The Court further finds that the funeral expenses of the said deceased have been fully pai(14.
<br />that all debts of said estate were paid and settled,and that if any other claims exist they are
<br />forever barred and precluded,and that the costs of this proceeding have been paid.
<br />IT IS THEREFORE ORDERED,ADJUDGED,AND DECREED BY THE COURT that the said Mary J.West. died intest-
<br />ate on the 27th day of July,1939;that more than six years have elapsed since her death,andthat
<br />no application for appointment of an administrator for her estate has ever been made,nor has
<br />there ever been any administration upon the estate of the said deceased in the State of Nebraska;
<br />that the said deceased was the owner in fee simple title of the East Half of the Southeast]
<br />Quarter (ENSE4) of Section Four (4) in Township Ten (10) North,Range Twelve (12),West of the
<br />6th P.M. in Hall County,Nebraska;that the petitioner herein is a competent person to prosecute
<br />this proceeding; that said deceased left surviving her as ' heir -at -law and only heir- at- law,Raymond
<br />H.West,her son,and that upon the death of the said Mary J.West,the real estate hereinbefore
<br />described passed and descended by absolute title under the intestate laws of the State of Nebraska
<br />in force at the time of the death of the said Mary J.West,to Raymond H.West,her son,in absolute
<br />title.
<br />IT IS THEREFORE ORDERED,ADJUDGED,AND DECREED BY THE COURT that all debts of said deceased and of
<br />her estate, if any such there hre, are forever barred and precluded, and that further administartion
<br />of said estate is hereby dispensed with and said estate is hereby settled and forever closed.
