<br />WILL AND DECREE
<br />IN THE NAME OF GOD, AMEN.
<br />I, August Schultz, of Cairo in the County of Hall, State of Nebraska, being of sound mind
<br />and memory and considering the uncertainty of this frail and transitory life, do therefore make,
<br />ordain, publish and declare this to be-my last WILL AND TESTAMENT.
<br />FIRST, I order and direct that my Executrix hereinafter named, pay all my just debts and
<br />funeral expenses as soon after my decease as conveniently may be.
<br />SECOND, After the payment of such funeral expenses and debts, I give, devise, and bequeath
<br />unto my beloved wife, Minnie Schultz, all of my personl- property of whatsoever nature it may be or
<br />wherever it may be found, to be held by her in an absolute estate of inheritance. To my Children,
<br />Otto E. Schultz, Ella Seery, Etta Meyer and Carl Schultz, I give, devise and bequeath all of my
<br />real estate, subject however to a life estate in the said real estate to be held by my said wife,
<br />Minnie Schultz, to be accepted by her in lieu of her right of dower in the said land. She to
<br />receive the rental from the said land during her lifetime, keeping the taxes paid up and the
<br />buildings in repair and at the time of her death, the said land to descend to my four children,
<br />named above share and share alike.
<br />LASTLY, i make, constitute and appoint my wife, Minnie Schultz to be Executrix of this my
<br />last Will and Testament, hereby revoking all former wills by me made. She to serve as such
<br />executrix without bond.
<br />IN WITNESS WHEREOF, I have hereunto subscribed my name and affixed my seal the 19th day of
<br />March, in the year of our Lord, one thousand nine hundrdd Thirty.

<br />At a session of the County Court held in the County Court Room in Grand Island, in said
<br />County, on the 14th day of November, A.D. 1945-
<br />In the Matter of the Estate of Present Charles Bossert, County Judge
<br />August Schultz, Deceased.
<br />I, Charles Bossert, Judge of the County Court, in and for said County, do hereby certify that
<br />on the 19th day of October, 1945, the instrument purporting to be the last will and testament of
<br />August Schultz, deceased, was filed for probate in this Court. That on the 14th day of November,
<br />19+5, said instrument to which this certificate is attached was duly proved, probated and allowed
<br />as the last will and testament of the real and personal estate of said August Schultz, deceased,
<br />and the same was ordered to be recorded in the records of the Court aforesaid.

<br />on this 17th day of April, 1946, thin cause came on for hearing upon the final report of
<br />Minnie
<br />Schultz, executrix of the estate of August Schultz, deceased, and upon the petition of said
<br />executrix for the allowance and approval of said report, settlement of said estate and discharge
<br />herein,
<br />and the Court having examined the records and-files herein and being fully advised in the
<br />premises,
<br />finds that due'and legal notice has been given to all persons of the time and place
<br />fixed by
<br />the Court for the hearing upon said report, and further finds that said report is true
<br />and correct in all things and that the same ought to be approved and allowed as and for the final
<br />report
<br />of said executrix, said - estate settled and closed and said executrix discharged.
<br />The
<br />Court further finds that the said August Schultz departed this life on the 10th day of
<br />August,
<br />1945, and that at the time of his death he was a resident and inhabitant of-Hall County,
<br />Nebraska;
<br />that he left surviving him as his heirs -at -law and only heirs -at -law, his wife, Minnie
<br />Scbultz
<br />and four children, Otto E.Schultz, Etta Seery, Etta Meyer and Carl Schultz, all of whom
<br />are of
<br />legal age; that he left a last Will and Testament, which was, by the consideration of this
<br />Court,
