MARY GEHRT, deceased. ) STATE OF NEBRASKA ) At a session of the County Court held in and for said County of Hall COUNTY OF HALL )ss• and State of Nebraska, this 27th day of March, 1946, Present: Charles Bossert, County Judge. BE IT REMEMBERED: That on the lst day of ga,rch, 1946, Otto Guenther, Executor of the estate of Mary Gehrt, deceased, filed in this Court his final account as such Executor and a petition praying that said account be allowed, for a decree of heirship, an order of distribution, a final settle- ment thereon and discharge. For these purposes, the 27th day of March, 1946, at 10 o'clock A.R. at the County Court Room in said County was assigned as the time and place for hearing said petition, examining and allow- ing said account; and it was ordered that notice of the pendency of said petition be given to all persons interested in said estate by publishing such notice in the Grand Island Independent, a legal newspaper printed in said County, for three weeks prior to said day of hearing, and it appears by proof on file that said notice was given as ordered by Court and that no objections to said final-account have been made or filed. Upon examination of the record and the evidence in this matter and being duly advised in the premises, the Court finds as follows: FIRST. That Mary Gehrt departed this life on the 15th day of September, 1945, at her home in Grand Island in Hall County, Nebraska, testate, and at the time of her death she was a resident of Hall County, Nebraska. SECOND. That on the 20th day of September, 1945, Otto Guenther filed in this Court an instrument pur- porting ':o be the Last Will and Testament of said Mary Gehrt, deceased, wherein said petitioner was named Executor and a petition offering said Will for probate, and on the 20th day of September 1945, an order of this Court was made therein assigning the 17th day of October, 1945, at 10 o'clock A.M. in the County Court Room in said County as the time and place for hearing said petition, prov- ing said Will and admitting the same to probate and ordering that notice of the pendency of said petition and hearing thereon be given to all persons interested in said matter by publishing said notice in the Grand Island Independent, a legal newspaper printed in said County, for three suc- cessive weeks prior to said day of hearing, and it appears by proof on file that notice of said order was so given. THIRD. The Court further finds that on the 17th day of October, 1945, said instrument was proven allowed and admitted to probate as the Last Will and Testament of Mary Gehrt, deceased, which Last Will and Testament is in words as follows: - LAST WILL AND TESTAMENT I, Mary Gehrt, a widow, of Grand Island, Nebraska, do hereby make, publish and declare this my Last Will and Testament hereby revoking all former Wills by me made, in words as follows: 1. I hereby appoint my son Otto Guenther Executor of this Will and direct him to pay all claims against my estate, expenses of my last illness and probating this Will and administering my estate out of my personal property: I have some life insurance which is payable to my daughter Mrs. Carolina Louise Smith, and it is my Will that she use the proceeds of the same in payment of my burial and if that be not sufficient, then my Executor is to pay the balance thereof from my personal property. 2. All of my household goods, clothes, linens and all other personal effects, I give to my daughter Carolina Smith; but I provide that out of the same, she permit my daughter -in -law Carolyn Guenther to select a remembrance for herself, and that my said daughter give to each of my granddaughters therefrom, a rememberance of me. 3. I hereby bequeath unto the adopted son of my deceased son George Guenther, whose name is Jack Screeve Guenther, the sum of Five Dollars, ($5-00) and no more, which sum is to be paid him out of my personal property. 4. All tools, including carpenter and garden tools, I hereby bequeath unto my son Otto- Guenther. 5• All the rest, residue and remainder of my personal estate, after payment of all of the foregoing, I bequeath as follows: A one- fourth part to Geraldine'Gehrt of Denver, Colorado, who is the only daughter of my deceased son Joan Gehrt; an undivided one - fourth part to my son Otto Guenther; an undivided one- fourth part to my daughter Earolina._Srith and an undivided one - eighth part to my granddaughter Evelyn Fregeu and an undivided one - eighth part to my grandson Robert Rex Cummings, both of Denver, Colorado, they being the two children of my deceased daughter Doris Cummings.
