<br />West of 6th P.M., in Merrick County, Nebraska, more fully described as follows: beginning at a
<br />point on the west line of and 1392.0 feet north from the southwest corner of said Section 20;
<br />thence north along the west line of said section 20, a distance of 450 feet; thence east, at an
<br />angle of 900 with the west line of said section 20, a distance of 500 feet; thence south, parallel
<br />to the west line of said section 20, a distance of 450 feet; thence west to point of beginning, a
<br />distance of 500 feet; this tract containing 5.17 acres, which was condemned and acquired by Platte
<br />Valley Power and Irrigation District,
<br />and that said real estate, under the laws of descent of the state of Nebraska, passed and descended
<br />as follows: To Dora Lilienthal, the widow, an undivided one -third interest; to Ella Herman, daughter;'
<br />Hilda Frauen, daughter; Emil Lilienthal, Harry Lilienthal, Ray Lilienthal, and Roy Lilienthal, sons,
<br />an undivided two- thirds interest, share and share alike, subject, however, to a lien, equity, and
<br />trust in Dora Lilienthal, in the amount of $14,000.00, in Lot 1 of the County Subdivision of Lots
<br />5 and 6 in Section 9, Township 10 North,Range 9 West, and of Lot 1 and the northeast quarter of the
<br />northwest quarter and the northwest quarter of the northeast quarter, of Section 16, in Township
<br />10 North,Range 9 West, containing 82.65 acres, the surveyor's certificate of which said County
<br />Subdivision is recorded in Book 37 at page 42 in the office of the Register of Deeds of Hall
<br />County, Nebraska; also the southeast quarter of the southeast quarter of Section 5, and the east
<br />half of the southeast quarter of section 9, all in Township 10 North, Range 9 West of 6th Prin-
<br />cipal Meridian, in Hall County, state of Nebraska.

<br />In the matter of the estate

<br />Katherina Beier, Deceased. FINAL DECREE
<br />This matter came on for hearing this 13th day of March, 1946, upon the final report and
<br />?etition of Herman Seier, administrator, for settlement and distribution of the estate of_
<br />Katherina Beier, deceased, the files and the evidence.
<br />The court finds that: due and legal notice of the time and place of hearing on such final
<br />report and petition for settlement and distribution has been given to all persons interested in
<br />such estate as provided by law; the final report and accounting of such administrator is, in all
<br />respects, just, true and correct; due notice has been given to creditors; no claims have been
<br />filed or allowed against such estate; the costs of this court and the fee of the attorneys for such
<br />estate have been paid by such administrator; the administrator has collected no monies or personal
<br />property and is not claiming compensation for his services; there remains only real property for
<br />distribution, the County Attorney of Hall County, Nebraska, has been notified of the petition
<br />herein for a determination that such estate is not subject to inheritance tax; the deceased died
<br />intestate on August 29, 1944, and left her surviving, as her sole and only heirs at law; Herman
<br />Seier, husband, and Lena Scott, a daughter, of deceased and such Herman Beier, and whose full
<br />name is Caroline A.Scott, which heirs -at -law are more than 21 years of age,
<br />IT IS, THEREFORE, CONSIDERED, ORDERED AND ADJUDGED THAT; such estate and the shares of the
<br />heirs at law therein is and are not subject to inheritance tax under the laws of Nebraska or the
<br />United States; Katherina Beier died intestate, leaving surviving, as her sole and only heirs -at-
<br />law; kerman Seier, husband, and Caroline A.Scott, daughter; the real estate of which such deceased
<br />died seized, namely: An undivided one -fifth interest in Lots One (1) and Two (2), the southeast
<br />quarter of the northwest c�uarter, and the northwest quarter of the northwest quarter, of Section
<br />Two (2), in Township Ten (10) North,Range Nine (9) West, and a strip of ground in the same section,
<br />described as follows: commencing at the northeast corner of the southwest quarter of the northwest
<br />quarter of said Section 2, in Township 10 North of Range 9 West of 6th P.M., and running thence
<br />west on the north line of said southwest quarter of the northwest quarter, 16 feet; thence in a
<br />southeasterly direction to the southeast corner of said southwest quarter of the northwest quarter;
<br />thence north -- the place of beginning, excepting the south 8 feet of the northeast quarter of the
<br />northeast quarter of said Section 2 deeded to Fred Falldorf by deed recorded in Book 22 of deeds at
<br />page 474, and excepting the south eight (8) feet of the west 79 rods of the northwest quarter of
<br />the northwest quarter of said Section 2, deeded to John Fall.dorf by deed recorded in Book 55 of
<br />deeds at page 1, all of the deed records of Hall County, Nebraska; all in Hall County, state of
<br />Nebraska, is assigned to such heirs at law in equal shares; the costs of this proceeding having
<br />been paid and such administrator having filed herein the receipt of the attorneys for such estate
<br />evidencing payment for their services and there being no personal property to distribute, the final
<br />account of such administrator is approved, confirmed and allowed and such administrator is discharged
<br />from his trust as administrator of such estate, and the sureties on his official bond released.
