<br />14th day of February, 1939, the instrument purporting to be the last will and testament of Anna
<br />Neuhalfen, deceased, was filed for probate in this Court. That on the 15th day of March, 1939,
<br />said instrument to which this certificate is attached was duly proved, probated and allowed as
<br />last will and testament of the real and personal estate of said Anna M.- Neuhalfen, deceased, and

<br />This matter came on for hearing this 13th day of March, 1946, upon the final report and petition
<br />of Grand Island Trust Company, executor, for settlement and distribution of the estate of Anna M.
<br />Neuhalfen, deceased, the files and the evidence.
<br />The Court finds that: due and. legal notice of the time and place of hearing on such final report
<br />and petition for settlement and distribution has been given to all persons interested in such estate
<br />as provided by law; and the County Attorney of Hall County, Nebraska, has been notified of the pe-
<br />tition herein for a determination that such estate is not subject to inheritance tax.
<br />The Court further finds that Elizabeth Lacher, Michael M.Neuhalfen, Phillip Neuhalfen, William
<br />F. Neuhalf en, Mathias Neuhalfen and Jacob C.Neuhalfen, did, on July 10, 1939, and Francis P. Neu-
<br />halfen did on September 19, 1945, each individually sell, transfer, assign and set over to Regina
<br />W.Neuhalfen, all of the right, title, and interest which each of such persons has in the personal
<br />estate of Anna M.Neuhalfen, deceased, and did each direct the executor to turn over and deliver
<br />to Regina W.Neuhalfen the share of each of them in the personal property of such estate.
<br />The Court further finds that: the costs of this proceeding are $F+0.50; the report of the execu-
<br />tor is in all respects just, true, and correct; due notice has been given to creditors; all claims
<br />allowed against such estate, including funeral expenses and expenses of last illness, have been
<br />paid by Regina W.Neuhalfen; the executor is entitled to receive and is hereby allowed for .its
<br />services herein, which the Court finds were extraordinary, the sum of $75.00; the sum of 4300.00
<br />should be and is hereby allowed to duhr,Pierce & Cronin for their services as attorneys for the
<br />executor and conducting proceedings for settlement of such estate; the executor and such Regina W.
<br />Neuhalfen have agreed that upon ayment of the costs, executor.'�.s compensation and the attorneys'
<br />fees herein, the balance of the 1000.00 in dispute between them, shall be paid to such Regina W.
<br />Neuhalfen; Regina W.Neuhalfen,Regina M.Neuhalfen, and "Minnie" Neuhalfen are one and the same
<br />person, d daughter of such deceased; Frank Neuhalfen and Francis P.Neuhalf en are one and the same
<br />person, a son of such deceased; William Neuhalfen and William F.Neuhalfen are one and the same
<br />person, a son of such deceased; Matthew Neuhalfen and Mathias Neuhalfen are one and the same person,
<br />a son of such deceased; there remains both personal and real property for distribution, and assign-
<br />ment; such estate is not subject to inheritance tax; the deceased left as her sole and only heirs
<br />at law the persons her einbefore specifically named, all of whom are more than twenty -one years of
<br />age.
<br />IT IS, THEREFORE, CONSIDERED, ORDERED AND ADJUDGED BY THE COURT that; such estate and the shares
<br />of the devisees therein is and are not subject to inheritance tax under the laws of Nebraska or the
<br />Unites States; the heirs at law of such Anna M. Neuhalfen, deceased, are: Philip Neuhalfen, Jacob
<br />C.Neuhalfen, Frank Neuhalfen, William Neuhalfen, Matthew Neuhalfen, Michael M.Neuhalfen, sons,
<br />Elizabeth Lacher, and Regina M.Neuhalfen, daughters; the real estate of which such Anna M.Neuhalfen
<br />died seized, to -wit: An undivided one -third interest in Lot Four (4) Block One Hundred Twenty -one
<br />(121) in Koenig & Wiebe's Addition to the city of Grand Island, in Hall County and state of Nebraska,
<br />according to the terms and provisions of the last will and testament of such deceased, descends and
<br />is assigned as follows: To Elizabeth Lacher, Frank Neuhalfen, William Neuhalfen, Matthew Neuhalfen,
<br />Michael M.Neuhalfen, and Regina M.Neuhalfen, an undivided one - eighth share and interest each; to
<br />Philip Neuhalfen an undivided one - eighth share and interest subject.to a charge in the amount of
<br />$275.00, with interest at six per cent;per annum; and to Jacob C.Neuhalfen an undivided one - eighth
<br />share and interest subject to a charge in the amount of $1500.00, with interest at four per cent.
<br />per annum;
<br />The personal property of such deceased remaining after the payment of the court costs herein;
<br />the executor's compensation of $75.00 and the fee of Suhr,Pierce & Cronin in the amount of $300.00;
<br />and in particular the notes of Minnie Neuhalfen, J.C.Neuhalfen- and Phillip Neuhalfen, and the house-
<br />hold furniture and furnishings, shall be transferred and delivered by the executor to such Regina
<br />(Minnie) Neuhalfen, as legatee and assignee thereof.
<br />Upon the executor paying such court costs and filing in this Court receipts for payment of
<br />executor's com ensation and the fee of the attorneys for such estate and the receipt of such
<br />Regina (Minnie Neuhalfen for the personal property remaining in such estate, such executor shall
<br />be discharged from its trust as executor of such estate and the sureties on its official bond
<br />released.
