<br />WILL AND DECREE
<br />LAST WILL AND TESTAMENT OF HENRY SCHAAF
<br />OF MERRICK COUNTY,NEBRASKA.
<br />IN THE NAME OF GOD,AMEN.
<br />I. Henry Schaaf, being of sound mind and memory and considering the uncertainties of this
<br />mortal life, do hereby make, publish and declare this, my last will and testament, in words and
<br />figures following, to -wit:
<br />1. To my beloved wife, Katherine Schaaf, I give, devise and bequeath all of my property,
<br />both real and personal, and wheresoever situated, to have and to hold for and during her natural
<br />life, provided, however, that should my wife desire, she may dispose of any or all of said property
<br />during her life time and use the proceeds thereof in any manner that she sees fit, and I give to
<br />her full power and authority to so dispose of any or all of my property, both real and personal,
<br />without obtaining license from any Court or Judge.
<br />2. So much of my property as shall remain undisposed of at the death of my wife, either real
<br />or personal, I give, devise and bequeath unto my son, Hanry A.Schaaf, to have and to hold to him
<br />and his heirs forever, subject, however, to a charge of Four Thousand Dollars, which charge shall
<br />be and constitute a first lien on all of my real estate, from and after the death of the survivor
<br />of myself and wife, and which sum my son, Henry A.Schaaf, shall pay to my grandchildren as follows:
<br />To Clarence Henry Strattman, One Thousand Dollars,
<br />To Irvin William Strattman, One Thousand Dollars,
<br />To Viola Katherine Strattman, One Thousand Dollars,
<br />To Evelyn W. Strat tman, One Thousand Dollars,
<br />it being my intention that the sums to be paid to my said grandchildren is to be paid to them by
<br />my said son, Henry A.Schaaf, when they reach the age of Twenty -one years, and if one or more of
<br />said grandchildren are Twenty -one years of age at the time of the death of the survivor of myself
<br />and wife, then said sum is to be paid those over 21 years of age within Six months from the death
<br />of such survivor, and is to draw interest at the rate of Six per cent per annum from the date Six
<br />months subsequent to the death of such survivor until paid.
<br />3. All the rest, residue and remainder of my estate, both.real and personal, I give, devise
<br />and bequeath unto my son, Henry A.Schaaf, subject to the charge of Four Thousand Dollars ( 4000.00)
<br />mentioned in paragraph Two hereof, to have and to hold to him and his heirs forever.
<br />4. I hereby Nominate and appoint my son, Henry A.Schaaf, to be executor of this, my last will
<br />and testament and request that he be permitted to qualify without giving bond.
<br />I hereby revoke any and all former wills by me made.

<br />We, whose names are hereunto subscribed, do hereby certify that this instrument, consisting
<br />of Two pages, was signed by Henry Schaaf, the testator in our presence and in the presence of each
<br />us and at the same time in our presence and hearing he declared the same to be his last will and
<br />testament, and we, at his special request and in his presence and in the presence -of each other,

<br />CODICIL TO THE LAST WILL OF HENRY SCHAAF
<br />I. Henry Schaaf, now a resident of the City of Grand Island, Hall County, Nebraska, hereby
<br />notify and confirm the foregoing will which was executed by me on the 20th day of May, 1925,
<br />with this exception however, that I hereby revoke the charge of $4,000.00 as contained _in
<br />Section 2 of said will and substitute therefore a charge of $1200.00 and provide that said
<br />1200.00 shall be paid in like shares to my grand children Clarence Henry Strattman $300.00,
<br />rvin William Strattman $300.00 Viola Catherine Strattman $300.00 and Evelyn W.Strattman $300.00.
<br />The provisions in said will of bl,000.00 for each of said grandchildren are hereby revoked and
<br />the legacies of $300.00 each to said grand children are substituted therefor.
<br />I further provide that my son Henry A.Schaaf shall be under no obligations to pay any interest
<br />on said charge until one year after my death or the death of my wife, whichever should live the
<br />longest.
<br />Done at Grand Island this 9th day of January, 1935.

<br />The foregoing codicil to the Last Will of Henry Schaaf at the date thereof was signed, sealed,
<br />published and declared by said testator as and for his last will and codicil to said will in
<br />our presence and we in his presence, and at his special request and in the presence of one
<br />another, have signed our names as witnesses hereto.

<br />At a Session of the County Court held in the County Court Room in Grand Island, in said
<br />County, on the 25th day of October, A.D. , 1944.

<br />I, Charles Bossert, Judge of the County Court, in and for said County, do hereby certify that
<br />on the 17th day of August 1944, the instruments purporting to be the last will and testament
<br />and Codicil thereto of Henry Schaaf deceased, was filed for probate in this Court. That on the
<br />25th day of October, 1944, said instruments to which this certificate is attached were duly
<br />proved, probated and allowed as the last will and testament and Codicil of the real and personal
<br />estate of said Henry Schaaf deceased, and the same were ordered to be recorded in the records of
<br />the Court aforesaid.
