<br />WILL AND DECREE
<br />LAST WILL AND TESTAMENT OF ALBERT HEYDE
<br />I, Albert Heyde, of Grand Island, Nebraska, being of sound mind and disposing mEMory, do
<br />hereby make, publish, and declare this my last will and testament.
<br />1.
<br />It is my desire and I direct my executor hereinafter named to pay all of my just debts,
<br />funeral expenses, and expenses of my last illness, if any, out of my personal property: if the
<br />same be not sufficient, I direct my executor to sell so much of my real estate as is necessary
<br />to pay the same.
<br />11.
<br />All the rest, residue, and remainder of my property I give, devise, and bequeath: to my eight
<br />children, share and share alike, and I request that my said children agree on an amicable and
<br />fair dividion of the same between themselves.
<br />111.
<br />I name, nominate, and appoint my son, Albert F.Heyde, of Scottsbluff, Nebraska, as executor
<br />of this my last will and testament, and I direct that he shall not be required to give any bond
<br />as such executor, and further, that he shall not receive any payment for his services in acting
<br />as executor of this my last will and testament.
<br />'IV.
<br />I hereby revoke any and all former wills by me made.
<br />IN WITNESS WHEREOF, I hereunto sign my foregoing last will and testament at Grand Island,
<br />Nebraska, this 15th day of June, 1944.

<br />At a Session of the County Court held in the County Court Room in Grand Island, in said County,
<br />on the 31st day of May, A.D. , 1945-

<br />Albert Heyde, Deceased.
<br />I, Charles Bossert: Judge of the County Court, in and for said County, do hereby certify
<br />that on the 4th day of May, 1945, the instrument purporting to be the last will and testament of
<br />Albert Heyde, deceased, was filed for probate in this Court. That on the 31st day of May, 1945,
<br />said instrument to which this certificate is attached was duly proved, probated and allowed as the
<br />last will and testament of the real and personal estate of said Albert Heyde deceased, and the
<br />same was ordered to be-recorded in the records of the Court aforesaid.

<br />Deceased:
<br />Now on this 12th day of January, 1946, this cause came on to be heard, and Albert F.Heyde,
<br />Executor, having filed in this court, receipts from each of the heirs,receipt for the attorney
<br />fees and receipt for the executor's expenses, in accordance with the Decree of Distribution;
<br />NOW, THEREFORE, IT IS ORDERED, ADJUDGED AND DECREED BY THE COURT that Albert F.Heyde be and
<br />he is hereby discharged as executor and his recognizance released.
<br />The Court finds that Albert Heyde died on the 30th day of April, 1945, an unmarried man;
<br />that he was a resident of Hall County and of the State of Nebraska -at the time of his death, and
<br />that this court had jurisdiction; that his will has heretofore been admitted to probate in.this
<br />court, and that the probate thereof has never been set aside or appealed from.
<br />The Court further finds that all claims allowed, all expenses of administration, funeral
<br />expenses and expenses of last illness, the Federal estate tax and State Inheritance tax, executor s
<br />expenses and attorney fees have been paid in full.
<br />The Court further finds that the said Albert Heyde was the owner at the time of his death of
<br />the following described real estate, to -wit:
<br />The Easterly Fourteen (14) feet of Lot Seven (7), and all of Lot Eight (S) in Block
<br />Ninety -eight (99) of Railroad Addition-to the City of Grand Island Hall County, Nebraska;
<br />Lots Three (3) and.Four (4) in Block Two (2) in Arnold & Abbottls iddition to the City of
<br />Grand Island, Hall County, Nebraska.
<br />Lot Nb.Nine (9) in County Subdivision of West Half of the Southwest Quarter (W2 SWJ) of
<br />Section Fifteen (15), in Township Eleven (11),North, of Range Nine (9),West of the 6th
<br />P.M., in Hall County, Nebraska, more particularly described as follows:- Commencing at
<br />a point Twenty -eight (28) rods and Sixteen (16) feet South of the Quarter section stake
<br />at the Northwest corner of the Southwest Quarter of said Section Fifteen (15), thence
<br />East Forty (40) rods,-thence South eleven (11) rods and six (6) inches, thence West
<br />forty (40) rods, thence North eleven (11) rods and six (6) inches to the place of be-
<br />ginning; except part conveyed to Margaretha Lindemann recorded in Book 43, page 550 ,
<br />except part conveyed to John Henry Langenheder recorded in Book 52,page 285, and except
<br />part conveyed to City of Grand Island, for alley purposes, recorded in Book 61, page
<br />543, of the records of Hall County, Nebraska
<br />Northerly 68 feet of Lots One (1) and Two (N and the Easterly 33 feet of Lot Three (3)
<br />and Southerly 64 feet of Lot Two (2), all in Block Fifty -six (56) of the Original Town,
