<br />on the 23rd day of December, 1944, the instrument purporting to be the last will and testament of
<br />Nickolaus Weinrich deceased, was filed for probate in this Court. That on the 2nd day of July,
<br />1945, said instrument to which this certificate id:-attached was duly proved, probated and allowed
<br />as the last will and testament of the real and personal estate of said Nickolaus Weinrich deceased,
<br />and the same was ordered to be recorded in the records of the Court aforesaid.

<br />IN THE MATTER OF THE ESTATE OF
<br />NICKOLAUS WEINRICH, Deceased. D E C R E E
<br />Now on this 3rd day of January, 1946, this cause came on for hearing upon the final report
<br />filed by Albert Weinrich, executor of the estate of Nickolaus Weinrich, deceased, and upon his
<br />application for the approval and allowance of said report, settlement of said estate and his
<br />discharge as executor of said estate, and the Court having examined the records and files herein,
<br />including said report and vouchers thereto attached, and being fully advised in the premises finds
<br />as follows:
<br />That on the 23rd day of December, 1944, Albert Weinrich, son of Nickolaus Weinrich, deceased,
<br />filed his petition in this Court in which he alleged, among, other things, that Nickolaus Weinrich
<br />departed this life in Hall County, Nebraska, on the =_ - day of December, 1944, leaving a Last Will
<br />and Testament in which Albert Weinrich and George Weinrich were named execuVors thereof, and the
<br />said George Weinrich having filed his Relinquishment herein as such executor, which instrument he
<br />offered for probate as the Last Will and Testament of waid deceased and asking that he.be appointed
<br />executor thereof; That upon reading and filing said petition, this Court entered an order, fixing
<br />the time and place for hearing said petition and giving notice thereof, as provided by law; and
<br />that said matter coming on to be heard, upon the date fixed by the Court, said instrument was duly
<br />admitted to probate in this Court as the Last Will and Testament of said deceased, and Letters
<br />Testamentary were issued to the daid Albert Weinrich.
<br />That due and legal notice has been given to all persons of the time and place fixed by the
<br />Court for filing claims against said estate, all claims not filed within the time fixed by the
<br />Court, if any such there be, should be forever barred, excluded and enj &ined from setting up or
<br />asserting any such claims against said estate.
<br />That the deceased departed this life, leaving as his heirs at law and only heirs at law, devisees,
<br />legatees, and persons entitled to share in his estate, the following named persons; George Weinrich,
<br />son; Albert N.Weinrich, son; Walter Weinrich, son; Arthur Weinrich, son; Robert Weinrich, son, all
<br />of Grand Island, Nebraska.
<br />That the deceased departed this life the owner, in fee simple title to the following real estate
<br />situated in Hall County, Nebraska, to -wit:
<br />Lot Eight (9) Block One (1) Wiebe's Addition to the City f Grand Island, Hall County,Nebraska.
<br />(8) Sub-
<br />Easterly 59.3/4 ft of the South Half (S2) of Lot Eight County division of the S2 of
<br />County,
<br />the SEJ Sect.16, Twp. 11. N. R. 9 W.6 P.M. Hall Nebraska
<br />and the said real estate hereinbefore described did pass and descend under the terms of the said
<br />Last Will and Testament as follows:
<br />To Albert N.Weinrich, Walter Weinrich, Arthur Weinrich, Robert Weinrich, and George Weinrich,
<br />and undivided one - fifth (1 /5th) interest therein, equally share and share alike, in fee
<br />simple title.
<br />That all the claims filed in said estate have been paid and satisfied.
<br />That the final report filed herein is true and correct, in all things, and that the same should
<br />be approved and allowed as his final report in said estate, said estate settled and closed, said
<br />executor and his official bondsmen discharged and released from any further liability in said matter.
<br />That there is no inheritance tax due the State of Nebraska or the United States.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED, AND DECREED by the Court that all persons having claims
<br />against said estate, not filed within and time fixed by the Court, if any such there be, are
<br />forever barred,eacluded, and enjoined from setting up or asserting any such claims against said
<br />estate, and that the final report filed herein by Albert N.Weinrich be and the same is hereby in
<br />all things approved and allowed as and for said executor's final report, said estate settled and
<br />closed and said executor and his surety on his official bond are hereby released from any further
<br />liability in said matter.
<br />IT IS FURTHER ORDERED, ADJUDGED, AND DECREED by the Court that the real estate hereinbefore
<br />described did pass and descend under and by virtue of the terms of the Last Will and Testament
<br />of said Nickolaus= Weinrich, deceased, as follows:
<br />To Albert N.Weinrich Walter Weinrich, Arthur Weinrich, Robert Weinrich, and George Weinrich
<br />(1 /5th) therein, share share alike in fee simple title
<br />an undivided one -fifth interest equally and
<br />to�Lot Eight (8) Block, One (1) Wiebels Addition to the City of Grand Island, Hall County, Nebraska,
<br />South (S2) Eight (g) County Subdivision 82
<br />and the Easterly 59/3/4th ft. of the Half of Lot of of
<br />S.E.I Beet. 16- Twp. 11 - N.. R-.9 W. 6 P. M.
<br />Half. County, Nebraska, and distribution thereof is hereby accordingly made.

<br />said Court, and that the foregoing attestation is in due form of law.
