THIRD CODICIL TO LAST WILL AND TESTAMENT
OF
CHRIST PETERSON
I, Christ Peterson, of Lincoln, Lancaster County, Nebraska, hereby make, publish and declare
this as a third codicil to my last will and testament of August 23, 193une 8 as modified by the first
codicil executed February 24, 1939 and by the second codicil executed e 9, 1942;
1.
I cancel and revoke paragraph D of Article II of said original will and insert in lieu thereof
a new paragraph D as follows:
"D ": After both my said wife and daughter are deceased, one -third of the net income shall be
paid to my grandson, A.Chester Wischmeier, one -third of the net income shall be paid to my
granddaughter, Janet Ann Wischmeier, and the other one -third of said het income shall be
paid share and share alike to the two Missionary Societies mentioned in paragraph C of
Article II of said original will."
II
I also cancel and revoke subparagraph (1) under paragraph E of said Article II of my original
will, and substitute in lieu thereof a new subparag'r_aph as follows:
"1. The other one -half of the trust estate shall be retained by the trustee during the lifetime of
my remaining grandchild. During said period said surviving grandchild shall receive two - thirds
of the net income therefrom and the other one -third of the net income shall be divided equally
among the two Missionary Societies. Upon the death of said surviving grandchild, (but in no
event while my said wife and daughter or either of them are living), the principal of this
portion of the trust shall be distributed among said grandchild's surviving issue by right of
representation and said Church Missionary Societies, on the same basis as provided in paragraph
E above."
III.
After long and careful consideration I have arrived at the conclusion that I do not desire my
son -in -law, Arthur Wischmeier, to share in my estate or in the income therefrom, and the changes
above set forth in this codicil are made for that reason.
IV.
In'all other respects I ratify, confirm and continue in full force and effect my said will of
August 23, 1938 as amended by the First and second codicils thereto, executed February 24, 1939
and June 8, 1942 respectively.
IN WITNESS WHEREOF, I have hereunto set my hand at Lincoln, Nebraska this 11th day of March,1943.
FOURTH CODICIL TO THE LAST WILL AND TESTAMENT-
OF
CHRIST PETERSON
I. Christ Peterson, of Lincoln, Lancaster County, Nebraska, hereby make, publish and dealate this
as a fourth codicil to my last will and testament of August 23, 1938, as modified by the first codicil
executed February 24, 1939, by the second codicil executed June 8, 1942 and by the third codicil
executed March 11, 1943;
I.
In paragraph A of Article II of my original will I provide that my wife, Winona Peterson, shall
during her lifetime receive the entire net income from the trust created by said Article II and that
in addition she shall have the right to occupy our home. In the first codicil to my will I provide
that if my wife is unable to assume the burden of managing her household and looking after her
affairs, my executor and trustee shall pay, from the income so provided by paragraph A of Article
II of my will, her personal expenses and the expenses of her home, these items being more fully
itemized in said codicil.
I now wish to provide, and it is my will and I hereby direct, that instead of my said wife
receiving "the entire net income from the trust estate during her lifetime" as provided in
paragraph A of Article II of my original will, she shall receive so much of said net income as in
the judgment of the Trustee is necessary and proper for her support,care and comfortable maintenance;
if for any reason my said wife is unable to assume the burden of managing her household and looking
after her affairs, I instruct my executor and trustee to pay, from the income provided for my said
wife by this fourth codicil to my will, her personal expenses, including the wages of any servants
or nurses that may be necessary, and all the expenses of maintaining her home including the taxes,
insurance and upkeep in addition to the usual current expenses.
As provided in said paragraph A of Article II o.f my original will, my wife shall have the right
to occupy our home ;therein described.
Any income not used for the purposes aforesaid shall be retained in the -trust by the trustee, or
in its discretion invested in accordance with the provisions of Article III of said will.
Inasmuch as my said original will gives my wife the entire net income from the trust, and under
the provisions of this fbarth codicil she is to receive only so much thereof as may be necessary
and proper for her support, care and comfortable maintenance, I wish to state that this change is
not made to deprive her, but on the contrary has been discussed with my wife and meets with her
entire approval. We believe that the income will be in excess of her needs and if that is the case
she prefers to have the excess accumulated in the trust for the benefit of the ultimate beneficiaries
named therein.
II.
To the extent that they are inconsistent with any of the foregoing provisions of this fourth
cod i,cil, I cancel, annul and revoke paragraph A of Article II of my said will dated. August 23,
1930, and the first codicil thereto dated February 24, 1939; and in all other respects I ratify,
confirm and continue in full force and effect my said will and the three codicils thereto above
specified.
