<br />Frederick departed this life intestate at her home in mood River,Hall County,Nebraska on April
<br />21,1939,and at the time of her death she was a resident of Hall County,Nebraska and the owner in
<br />fee simple title of Lot Four (4) in Block One (1) in Dodd and Marshall's Addition to the town of
<br />Wood River,Hall County,Nebraska,and that more than two years have elapsed since her death; that
<br />no application has ever been made in the State of Nebraska for the appointment of an administrator
<br />and no petition has been filed for that purpose and that no administration has ever been had upon
<br />the Estate of the said Catherine Frederick,deceased.
<br />The Court further finds that the said Catherine Frederick left surviving her as her heirs -at -law
<br />and only heirs- at- law,Owen Frederick,a son,residing in Long Beach,California,and Otto> Frederick
<br />a son,residing at Brady,Texas,both of whom are of legal age.
<br />The Court further finds that under the laws of the State of Nebraska in force at the time of the
<br />date of the death of the said Catherine Frederick,the real estate herein described passed and
<br />descended by absolute title to Owen Frederick and Otto Frederick,share and share alike,in absolute
<br />title.
<br />The Court further finds that the funeral expenses of the deceased have been fully paid and that
<br />all debts of the said deceased and of her estate,if any,such existed,are forever barred and pre-
<br />cluded and that the cost of this proceeding has been paid.
<br />IT IS THEREFORE ORDERED,ADJUDGED,AND DECREED BY THE COURT that the said Catherine Frederick'died
<br />intestate in Hall County,Nebraska on the 21st day of Apri1,1939 ;that more than two years have
<br />elapsed since her death;that no application for appointment of an administrator of her estate has
<br />ever been made,nor has there ever been any administration upon the estate of the said deceased
<br />in the State of Nebraska;that said deceased was the owner in fee simple title to Lot Four (4) in
<br />Block One (1) in Dodd and Marshall's Addition to the Town of W6od River,Hall County,Nebraska;
<br />that the petitioner herein is a competent and qualified person to prosecute this proceeding;that
<br />said deceased left surviving her as her heirs -at -law and only heirs- at- law,Owen Frederick,a sbn,
<br />and Otto Prederick,a son;that upon the death of the said Catherine Frederick,the real estate
<br />hereinbbtftw described passed and descended by absolute title under the intestate laws of the
<br />State of Nebraska in force at the time of the death of the said Catherine Frederick,to Owen
<br />Frederick and Otto Frederiek,her sons,in equal shares to each.
<br />IT IS THEREFORE ORDERED,ADJUDGED,AND DECREED BY THE COURT that all debts of the said deceased
<br />and of her estate if any such there are,ate forever barred and precluded and further administrat-
<br />ion of said estate is hereby dispensed with,and said estate is finally settled and forever closed.

<br />"LAST WILL AND TESTAMENT OF CHRIST PETERSON
<br />Is CHRIST PETERSON, of Lincoln, Lancaster County, Nebraska, being of sound and disposing
<br />mind and memory, do hereby make, publish and declare this; MY LAST WILL AND TESTAMENT, in words
<br />and- figures as follows, hereby expressly revoking any and all former Wills made by me:
<br />I order and direct that my executor, hereinafter named, shall pay all of my just debts and
<br />funeral expense as soon after my death as shall be convenient.
<br />II.
<br />All the rest, residue and remainder of my estate, real, personal and mixed, of whatever
<br />character and wherever situate, which I may own or.of which I may have the right to dispose at the
<br />time of my death, I give, bequeath and devise to The First Trust Company of Lincoln, Nebraska,
<br />hereinafter known as the Trustee, IN TRUST NEVERTHELESS, for the uses and purposes hereinafter
<br />specified.
<br />A. My wife, Winona Peterson, shall receive the entire net income from the trust during her lifetime.
<br />She shall also have the right to occupy our home, Lot 7 Block 50 University Place, now Lincoln,
<br />Nebraska, and the trustee shall pay the taxes thereon from the income of the trust.
<br />B. Upon my wife's death said family home described in Paragraph "A" shall be sold, the proceeds
<br />to be invested in the class of securities mentioned in Article III of this Will, and the
<br />income and principal thereof shall be disposed of the same as the other assets of my estate.
<br />The household furniture and furnishings in said home shall then become the property of our
<br />daughter- and only child, Mrs.Golda Peterson Wisehmeier.
<br />C. Upon the death of my said wife.. the net income from the trust shall be paid one-half (1/2)
<br />to my said daughter during her lifetime and one -half (1/2) in equal shares to the Women's
<br />Foreign Missionary SOCie.ty and Women's Home Missionary Society, both of the First Methodist
<br />Episcopal Church of University Place,(Lincoln), Nebraska.
