<br />The Howard County Herald, a legal newspaper printed in said County, three successive weeks prior to
<br />said day of hearing, and it appears by proof on file that notice of said order was so given.
<br />THIRD.
<br />The Court further finds that on the 18th day of December, 1942, said instrument was proven,
<br />allowed and admitted to probate as the Last Will and Testament of said Herman Kruse, deceased and
<br />said Bertha Kruse named in said Will, was appointed Executrix thereof upon her furnishing bond in
<br />the sum of $2500.00 as ordered by this Court, which bond was furnished and approved; the Court fur-
<br />ther finds that said Herman use, at the time of his death, was married, and that he left the fol-
<br />lowing heirs -at -law and only heirs -at -law, to -wit: Bertha Kruse, his widow, Erna Kruse, described
<br />in said Will as Erma Kruse, a daughter, Martin Kruse a son, Walter Kruse, a son, Amelia Hessel,
<br />a daughter, Emma Poehler, a daughter, Ida Poehler, a daughter, Ella Kruse, a daughter, Frieda
<br />Hessel, a, daughter, Bertha Schuett, a daughter, Herman Kruse named in said Will as Hermann Kruse,
<br />a son, Alma Baade, a daughter, Meta Kruse, a daughter, John Kruse, a son, Reinhardt Kruse, a son,
<br />all of whom are now over the age of 21 years.
<br />FOURTH.
<br />The Court further finds that on the 18th day of December, 1942, an order of this Court was
<br />made allowing creditors three months from And after the 8th day of January, 1943, in which to file
<br />their claims against said estate and said Executrix one year in which to settle said estate, and
<br />further ordering that notice to creditors be published in The Howard County Herald, a legal news-
<br />paper printed and published in Howard County, Nebraska and of general circulation therein, three
<br />successive weeks, the first publication to be made on December 23, 1942, and that a hearing on
<br />claims filed against said estate would be held at the office of the County Judge of Howard County,
<br />Nebraska, on the 9th day of April, 194 -3, at 9 o'clock A.M., and it appears by proof on file that
<br />notice of said order was 1.)ublished as. ordered by this Court.
<br />FIFTH.
<br />The Court further finds that on the 9th day of April, 1943, said Bertha Kruse, as Executrix of
<br />said estate, filed in this Court her Inventory of the property of said estate, and that according
<br />to said Inventory, the deceased died seized and possessed of the following described"property,to-
<br />Tait:
<br />Northwest Quarter Mdi -) of Section Twenty -eight (28) and the West Half of the Southeast Quarter
<br />(W2SE4) of Section Twenty -one (21), all in Township Thirteen (13) North,Range Eight (8), West of
<br />the 6th P.M. in Merrick County, Nebraska.
<br />The Northeast Quarter (NEZ) of Section Twenty -five (25) in Township Thirteen (13) North,Range
<br />Nine (9),West of the 6th P.M. Howard County, Nebraska.
<br />Lots Sixteen (16) and Seventeen (17) in Block Twenty -seven (27) of the Village of Palmer in
<br />Merrick County, Nebraska.
<br />Lots Fourteen (14) and Sixteen (16) in Block Seventeen (17) in Scarff's Addition to West Lawn, an
<br />Addition in the City of Grand Island, Hall County, Nebraska.
<br />And personal property of the approximate value of $2500.00.
<br />The Court further finds that according to the terms, conditions and provisions of said Last
<br />Will and Testament of said deceased, said Lots 16 and 17 in Block 27 of the Village of Palmer in
<br />Merrick County, Nebraska, and said Lots 14 and 16 in Block 17 in Scarff's Addition to West Lawn,
<br />an Addition in the City of Grand Island, Hall County, Nebraska, were devised in fee simple absolute
<br />to Bertha Kruse; that the West Half of the Northwest Quarter of Section 29 in Township 13 North,
<br />Range 8, West of the 6th P.M. in Merrick County, Nebraska, was devised unto Herman Kruse, named in
<br />said Will as Hermann Kruse, in fee simple absolute; the East Half of the Northwest Quarter of
<br />Section 28 in Township 13 North,Range 8, West of the 6th P.M. in Merrick County, Nebraska, to
<br />John Kruse in fee simple absolute; the West Half of the Southeast Quarter of Section 21 in Township
<br />13 North, Range 8 West of the 6th PiM. , in Merrick County, Nebraska., to Reinhardt Kruse in fee
<br />simple absolute; the 'lest Half of the Northeast Quarter of Section 25 in Township 13 North,Range 9,
<br />West of the 6th P.M. in Howard County, Nebrasl�a, to Martin Kruse, in fee simple absolute, subject
<br />however to a grant of the use of said land unto Bertha Kruse until March 1, 1946; the East Half
<br />of the Northeast Quarter of Section 25 in Township 13 North,Range 8, West of the 6th P.M. in
<br />Howard County, Nebraska, to Walter Kruse in fee simple absolute, subject however to a grant of the
<br />use of said land unto Bertha Kruse until March 1, 1946;
<br />Legacies unto Amelia Hessel, Emma Poehler, Ida Poehler, Ella Kruse, Frieda Hessel, Bertha
<br />Schuett, Alma Baade, Meta Kruse and Erna Kruse, of $200.00 each, which legacies lapsed on account
<br />of the fact tat tie claims and debts against said estate exceeded the amount of personal property
<br />thereof and there were no funds in said estate with which to pay the same.
<br />SIXTH.
<br />The Court further finds that on the 9th day of April, 1943, all claims filed against said
<br />estate were duly allowed, all of which claims have now been fully paid,'and the Court entered
<br />an order on that date barring the filing of any and all other claims against said estate and
<br />excluding the holders thereof from setting up or asserting any such claims against said estate.
<br />SEVENTH.
<br />The Court further finds that all claims against said estate, including the costs of adminis-
<br />tration thereof, and the expenses of the last illness and burial of said testator, have been fully
<br />paid by said Executrix and that said final report is correct in all respects and should be approved
<br />and allowed; that there remains in her hands the sum of 2. 9 inich sum,inasmuch as said Executrix
<br />was required to use the income from the Northeast Quarter of Section 25 in Township 13 North,Range
<br />8,West of the 6th P.M. in Howard County, Nebraska, accruing since the date of the death of said
<br />decedent fo,, the payment of claims against said estate is hereby awarded unto said Bertha Kruse,
<br />in lieu thereof, and that there is due and payable to the County Treasurers of Hall County, Howard
<br />County and Merrick County, Nebraska, no inheritance tax herein whatsoever.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of Bertha
<br />Kruse, Executrix, be and the same is hereby approved and allowed as such; that the real and true
<br />name of said decedent and testator, was Herman Kruse, and that the real and true name of Hermann
<br />Kruse named in the Last Will and Testament as a. son of said testator and to whom the West Half of
<br />the Northwest Quarter of Section 28 in Township 13 North,Range 8, West of the 6th P.M. in Merrick
<br />County, Nebraska, T^ras devised, is Herman Kruse; that the property described in paragraph 5th hereof
<br />was devised and bequeathed according to the terms and conditions of said Last Will and Testament
<br />as set forth in paragraph Fifth hereof, that there remains in the hands of said Executrix the sum
<br />of $52.39 which is undistributed by her and which should be paid to her as found in paragraph 7th
<br />hereof, which sum she has now paid unto herself and has filed her receipt therefor in this Court
<br />and she therefore is hereby discharged, her bond released and sa"_d estate fully administered,
<br />settled and closed.
