<br />to his heirs and assigns forever, subject to the use of said premises in my wife until the first
<br />day of March, 1946.
<br />I give and devise to my son Walter the East Half of said Northeast Quarter (M!NE,) of Section
<br />25, Township 13 North, Range 8, ?Test of the 6th P.M., Howard County, Nebraska, to him and to his
<br />heirs and assigns forever, subject to the use of said premises in my wife until the first day of
<br />March, 1946.
<br />In lieu of the statutory rights which my wife may have in my estate, I give and bequeath to
<br />her the use of all personal property which I may own or to which I may be entitled at the time of
<br />my decease, wherever the same may be situate, subject however, to the legacies which I am about to
<br />bequeath in the nextparagraph of this Will. She shall have the pvwer to sell and dispose of any
<br />part or all of said personal property as she may see fit without let, hinderance or control on the
<br />part of any person, nor need she obtain permission or order from any Court or Judge, neither shall
<br />she be required to account to any person, Judge or Court for the proceeds received from such sale
<br />or transfer, which proceeds shall be her own property to do with as she sees fit.
<br />I give and bequeath to each one of my daughters, the sum of Two Hundred Dollars ($200.00) that
<br />is to say: Two Hundred Dollars ($200.00) shall be paid each of my daughters Amelia Hessel, Emma
<br />Poehler, Ida Poehler, Ella Kruse, Frieda Hessel, Bertha Schuett, Alma Baade, Meta Kruse and Erma
<br />Kruse, to them and to their respective heirs forever; the aforesaid legacies shall be due and
<br />payable without interest three (3) months after my decease in the event that I survive my wife,
<br />or three months after the decease of my wife, in the event she survivts -me. I distinctly provide
<br />that said legacies are not a lien nor a charge upon the real estate heretofore given my sons
<br />Herman, John, Reinhart, Martin or Walter. It is my intention that these legacies to my daughters
<br />shall not be dur or payable during the lifetime of my wife.
<br />I further give my wife the use of my land situate in Howard County, Nebraska, heretofore devised
<br />to my sons Martin Kruse and Walter Kruse, from the time of my decease until the first day of
<br />March, 1946.
<br />I have arranged with the law firm of Mayer & Mayer of Grand Island, for the probate of this
<br />Will, who shall act as counselors to the Executrix at a reasonable fee to be determined by the
<br />Probate Judge who may have jurisdiction of my estate.

<br />certify that the above and foregoing instrument was filed in this office on the 24th day of
<br />November, 1942, together with the petition for the probate of the same; that notice of the pendency
<br />of said petition was given by publication of the same three successive weeks in The Howard County
<br />Herald, a newspaper published and printed in said county. That on the 18th day of December,1942,
<br />the execution of said will was duly proven and also that said Testator at the time of its execu-
<br />tion was of full age and sound mind; that an order was thereupon entered admitting said instru-
<br />ment to brobate as and for the last will and testament of Herman Kruse, the testator, and that
<br />Letters testamentary thereupon issued to Bertha Kruse the executrix therein - named.

<br />offering said Will for probate, and on the 24th day of November, 1942, an order of this Court,
<br />was made therein assigning the 18th day of December, 1942, at 9 o'clock A.M. in the County Court
<br />Room in said County as the time and nla.ce for hearing said petition, proving said Will and ad-
<br />mitting the same to probate, and ordering that notice of the pendency of said petition and
<br />hearing thereon be given to all persons interested in said matter by publishing said notice in

<br />BE IT REMEMBERED: that on the 30th day of October, 1945, Bertha Kruse, Executrix of the Estate___
<br />of Herman Kruse, deceased, filed in this Court her final account as such Executrix and a petition
<br />praying that said account be allowed, for a decree of heirship, an order of distribution, a final
<br />settlement thereon and discharge.
<br />For these purposes, the 16th day of November, 1945, at 9 o'clock A.M., at the County Court Room
<br />in said County was assigned as the time and place for hearing said petition, examining and allow-

<br />ing said account, and -it was o .-dered that notice of the pendency of said petition be given to all
<br />persons interested in said estate by publishing such notice in The Howard County Herald, a legal
<br />newspaper printed in said County, three successive weeks prior to said day of hearing; and it
<br />apnears'by proof on file that said notice was given as ordered by this Court and that no objections
<br />to said final account have been made or filed.
<br />Upon examination of the record and the evidence in this matter and being duly advised in the
<br />premises, the Court finds as follows:
<br />FIRST.
<br />That Herman Kruse, sometimes known as Hermann Kruse, departed this life on November 18, 1942,
<br />at his residence in Howard County, Nebraska, testate, and at the time of his death, he was a
<br />resident of Howard County, Nebraska.
<br />SECOND.
<br />That on the 24th day of November, 1942, Bertha Kruse filed in this Court an instrument pur-
