676 ova_ THERUGUSTINECO. 20112 -2.41 assets on hand, for the settlement of said estate and for his discharge,herein, and the court having examined the records and files herein and being fully advised in the premises finds that due and legal notice has been given to all persons of the time and place fixed by the court for the hearing on said report, and further finds that said.report is true and correct in all things and that the same ought to be approved and allowed as and for the final report of said Executor, said estate settled and closed and said Executor discharged. The court further finds that the said Catharina Hennings departed this life on the 9th day of May, 1945, and that at the time of her death she was a resident and inhabitant of Hall County, Nebraska; that she left surviving her as her heirs -at -law and only heirs -at -law one son and four daughters, they being, Peter Hennings, Anna Wiese, Carrie Krueger, Rosa Rehder and Tina Ehlers, all of whom are over the age of twenty -one years; that she left a Last Will-and Testament which was by the consideration of this court duly proven, allowed and admitted to probate on the 21st day of June, 1945, and Letters Testamentary were duly issued by this court, to the said Peter Hennings upon filing of bond herein on the 23d day of June, 1945- The court further finds that due and legal notice has been given to all persons of the time and place fixed by the court for filing claims against the estate of the deceased, and that the time so fixed has fully expired and that all persons having claims against said estate and not filed within the time limited by the court are forever barred and excluded from setting up or asserting such claims against said estate. The court further finds that the Executor has paid the funeral expenses of the deceased, all debts against sg.id estate, and the costs of these proceedings and is prepared to make due dis- tribution of the personal property in said estate of the deceased to the legatees under the Will and Testament of the deceased, and that upon such distribution in accordance with the order of this court and upon filing of receipts from each of the heirs that he be discharged as Executor and his surety released from further liability. The court further finds that the estate is not subject to an Inheritance Tax under the laws of the State of Nebraska, nor to a Federal Estate Tax under the laws of the United States. The court further finds that the said Catharina Hennings was possessed of real estate des- cribed as Lot One (1), Block Six (6), in Windolph's Addition to the City of Grand Island,Hall County, Nebraska, which passed and descended pursuant to the terms of her Will, and subject to a specific bequest of $4,000.00 to Peter Hennings, which has been paid in equal shares to the said Peter Hennings, Anna Wiese, Carrie Krueger, Rosa Rehder and Tina Ehlers, to have and to hold the same forever. IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of the said Peter Hennings, Executor of the estate of Calharina Hennings, deceased, be and the same hereby is in all things approved and allowed as and for the final report of said Executor, and said estate is hereby settled and closed and said Executor discharged upon filing of receipts from all of the heirs of their net distributive shares in the assets of said estate. IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that all persons having claims against said estate, if any such there be, are forever barred, enjoined and excluded from setting up or asserting any such claims against said estate. - IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that the distribution of personal property and transfer of the same by the Executor to the heirs -at -law be made in accordance with the findings of this court and that as soon as such transfer and distribution has been completed and receipts filed herein the Executor is released from further liability on his bond. IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that under the terms and provisions of the Last Will and Testament of Catharina Hennings, the real estate hereinbefore described passed and descended in equal shares to the heirs -at -lax of Catharina Hennings, deceased, and that said heirs -at -law are Peter kennings, Anna Wiese, Carrie Krueger, Rosa Rehder and Tina Ehlers.
