<br />This matter came on for hearing the 26th day of September, 1945, upon the petition of Augusta
<br />Wiese, and was submitted to the Court.
<br />The Court finds that: due and legal notice of this proceeding has been given all persons in-
<br />terested in such estate, both creditors and heirs, as required by law; the allegations of such
<br />petition are true; such Peter Wiese died intestate, residing in Hall County, Nebraska, on August
<br />13, 1943, more than two years prior to the commencement of this proceeding, owning an undivided
<br />one -fifth interest in the following described real estate situated in Hall County, state of
<br />Nebraska; Lots One (1) and Two (2), the southeast quarter of the northwest c�uarter, and the north-
<br />west quarter of the northwest quarter, of Section Two (2), in Township Ten (10) North,Range Nine
<br />(9) West, and a strip of ground in the same section, described as follows: commencin at the north-
<br />east corner of the southwest uarter of the northwest quarter of said Section Two (2f, in Township
<br />Ten (10) North of Range Nine ?9) West of 6th P. M., and running thence west on the north line of said
<br />southwest quarter of the northwest quarter 16 feet; thence in a southeasterly direction to the
<br />southeast corner of said southwest quarter of the northwest quarter; thence north to the place of
<br />beginning, excepting the south 8 feet of the northeast quarter of the northeast quarter of said
<br />Section 2 deeded to Fred Falldorf by deed recorded in Book 22 of Deeds at page 474, and except-
<br />ing the south 8 feet of the west 79 rods of the northwest quarter of the northwest quarter of said
<br />Section 2, deeded to John Falldorf by deed recorded in Book 55 of deeds at page 1, all of the deed
<br />records of Hall County, Nebraska; no administrator of the estate of such deceased has been appointed
<br />in the state of Nebraska.; no decree of heirship has heretofore been entered in a probate of such
<br />estate in Nebraska; such deceased left him surviving, as his sole and only heirs at law; petitioner,
<br />surviving widow; and Dale Wiese, a son; the right of descent of petitioner and Dale Wiese to the
<br />real property of which such deceased died seized is an undivided one -half each.
<br />IT IS, THEREFORE, CONSIDERED, DETERMINED AND DECREED that the real property of Peter Wiese,
<br />deceased, descended to Augusta Wiese, surviving widow, and Dale Wiese,son, in the proportion of
<br />an undivided one -half to each.
<br />IT IS FURTHER CONSIDERED AND ADJUDGED that all claims or demands against the estate of Peter
<br />Wiese, deceased, whether due or to become due, whether absolute or contingent, shall be, and hereby
<br />are, forever barred.

<br />sum of $1,000.00, and to his wife Daisy Eyerly, $1000.
