<br />BE IT RHY- 02BERED that on this 3rd day of October,1945,this matter came on to be heard upon the
<br />petition of Roy R.Rainforth,and the evidence,and was submitted to the eourt,upon consideration
<br />whereof the court finds:
<br />That Ida McBride died on the 19th day of January,1943,in testate,a resident of Omaha,Douglas County,
<br />Nebraska;that more than two years have elapsed since her death and no administrator has been appoinr
<br />ted for or proceedings had for the administration of her estate in Nebraska.
<br />That the deceased left surviving her as her next of kin and heirs at law,Howard R.Wilson,her son,
<br />and Mildred Wendt,her daughter;-that each of said persons is of legal age;that the deceased left
<br />surviving her no husband and no other child nor the child of any deceased child.
<br />That the deceased at the time of her death was the owner and in possession of an undivided 1/32
<br />of the Northeast 4uarter (NEJ) of Section Twenty -five (25),Township Nine (9) North,Range Eleven
<br />(11),West of the 6th P.M.in Hall County,Nebraska,and upon her death her interest in said land
<br />descended to the became vested in her children above named,an undivided 1/2 to each,by virtue of
<br />the statute °of descent and distribution of the state of Nebraska.
<br />That each of the allegations of the petition herein is true.
<br />IT IS ,THEREFORE,CONSIDEHED,ORDERED ABD DECREED:
<br />That Ida McBride died on the 19th day of January,1943,intes•tate;that her children above named are
<br />her heirs;that the undivided 1/32 of the real estate above described and owned by the deceased at
<br />the time of her death descended to her heirs equally,an undivided 1/2 thereof to each and it
<br />should be and the same is hereby assigned to her heirs,ad aforesaid,in accordance with the statute
<br />of descent of Nebraska.

<br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA.
<br />IN THE MATTER OF )
<br />THE ESTATE OF ) DECREE.
<br />DORA CUMMINGS, FORMERLY
<br />DORA GUENTHER, deceased.
<br />On this 24th day of October, 1945, this matter came on to be heard upon the pleadings and the
<br />evidence and was submitted to the Court, on consideration whereof the Court finds that due and legal
<br />notice of these proceedings has been given to all persons interested in said matter, both creditors
<br />and heirs, as required by law. T"nat all of the statements and allegations set forth in said
<br />petition are true; that the said Dora Cummings, formerly Dora Guenther, died intestate in the City
<br />and County of Denver, in the State of Colorado, on July 3, 1929, seized and possessed at the time
<br />of her death of the following described real estate, to -wit:
<br />An undivided one -third interest in Lot Four in Block One Hundred Five (105) of Railroad
<br />Addition to the City of Grand Island, in Hall County,_. Nebraska;
<br />that no application has been made in the State of Nebraska for the appointment of an Administrator
<br />of the Estate of said deceased. That the husband of said Dora Cummings, formerly Dora Guenther,
<br />predeceased her. That she did not remarry and that her only heirs, were and are her children,namely:
<br />Evelyn Fregeau and Robert Cummings, both of whom are over the age of 21 years; and the Court hereby
<br />finds and determines that said children are the sole and only heirs -at -law of the said Dora Cummings,
<br />formerly Dora Guenther, deceased, and that said interest in said real estate descended to said
<br />children, each of said children being the owner of an undivided one -sixth interest in said real
<br />estate.
<br />IT IS THEREFORE CONSIDERED AND ADJUDGED BY THE COURT that the interest in the real estate
<br />above- described be and the same hereby is assigned to the said Evelyn Fregeau and Robert Cummings,
<br />an undivided one -half to each, and that each of them is the owner of an undivided one -sixth of said
<br />Lot Four (4) in Block One Hundred Five (105) of Railroad Addition to the City of Grand Island, in
<br />Hall County, Nebraska.
<br />IT IS FURTHER CONSIDERED AND ADJUDGED BY THE COURT that all claims and demands against the
<br />estate of said deceased, whether due or to become due, whether absolute or contingent, be and the
<br />same hereby are forever barred.
