Suhr be, and he hereby is, allowed sum of <br />attorney's fee herein. <br />This matter came on further to be heard upon the final report and petition for settlement of the <br />estate and the discharge of the executors. <br />There was present in court Franklin Tully, one of the executors, with his attorney, Wm.Suhr, <br />and the Court having examined the report and the records and files in said estate, and after taking <br />the testimony of Franklin Tully, executor, and being duly advised in the premises, finds that due <br />and legal notice has been given to all persons interested in said estate of the time and place <br />fixed for hearing upon said final report, as heretofore ordered, and no one appearing to object <br />thereto and the Court Having examined the same, together with the vouchers on file and the testi- <br />mony in support thereof, and the books and records of the executor and being duly advised, finds <br />that said report is true and correct in all things and ought to be approved and allowed as and <br />for the final report of said executors. <br />The Court finds that the Executors have made distribution of all funds and personal property <br />belonging to said estate in accordance with the terms and conditions of the last will and testament <br />of said Jennie M.Tully, deceased. <br />The Court further finds that the executors have paid all of the expenses of administration. <br />The Court finds that Jennie M.Tully departed this life on the 5th day of August, 1937, testate, <br />and at the time of her death was, a resident and inhabitant of Hall County, Nebraska. <br />The Court further finds that on the 9th day of August, 1937, a petition was filed herein praying <br />for the allowance and probate of an instrument purporting to be the last will and testament of <br />Jennie M.Tully, deceased, and the Court thereupon fixed the time for making proof of said last <br />will and testament, and due notice of the filing of said petition and of the time and place fixed <br />for hearing thereon was given by the Court as by law provided, and on said date said instrument <br />duly allowed, and admitted to probate, and letters testamentary were duly issued <br />was proven, <br />last testament to Inez Robinson and Franklin Tully, executors, <br />thereon as in said will and provided, <br />and they, and each of them, thereupon duly qualified as such. <br />The Court further finds that due and legal notice has been given to all persons of the time and <br />place fixed by the Court for the filing of claims against said estate,that the time so fixed has <br />fully expired. <br />The Court finds that all claims have been paid, and that all persons having claims against <br />said estate, and not filed herein, if any such there be, are forever barred and excluded from <br />setting up or asserting any such claims against said estate. <br />The Court further finds that said Jennie M.Tully died seized of the following described real <br />estate: <br />Fractional Lot Four (4) in Block Six (6 in the Original Town, now City, of Grand Island, <br />Hall County, Nebraska, and <br />An-undivided one -half interest in and to Lots Two (2)and Three (3) in Block Six (6) in the <br />Original Town, now City, of Grand Island,Hall County, Nebraska: <br />that the real estate described in the inventory as situated in Valley County, Nebraska, was in- <br />
