<br />COUNTY OF HALL )ss• At a session of the County Court held in and for said County of Hall,
<br />State of Nebraska, this nth day of August, 1945.
<br />Present: Charles Bossert, County Judge.
<br />BE IT REMEMBERED: That on the 14th day of July, 1945, Albert Herman, Administrator of the
<br />estate of Delia Herman, deceased, filed in this Court his final account as such Administrator
<br />and a petition praying that said account be allowed, for a Decree of heirship, an order of dis-
<br />gribution, a final settlement thereon and discharge.
<br />For these purposes the 8th day of August, 1945, at 10 o'clock A.M. at the County Court Room in
<br />said County, was assigned as the time and place for hearing said petition, examining and allowing
<br />said account; and it was ordered that notice of the pendency of said petition be given to all
<br />j persons interested in said estate by publishing such notice in the Grand Island Independent, a
<br />legal newspaper printed in said County, for three weeks prior to said day 6f hearing, and it
<br />appears by proof on file that said notice was given as ordered by Court and that no objections
<br />to said final account have been made or filed.
<br />Upon examination of the record and the evidence in this matter and being duly advised in the
<br />premises, the Court finds as follows:
<br />FIRST.
<br />That Delia Herman departed this life on the 18th day of January, 1945, in Grand Island, Nebraska,
<br />intestate, and at the time of her death she was a resident of Hall County, Nebraska.
<br />SECOND.
<br />That on the 16th day of February, 1945, Albert Herman, son of said Delia Herman, deceased, filed
<br />in this Court a petition praying for the appointment of said Albert Herman as Administrator of the
<br />Estate of said deceased, and on the 16th day of February, 1945, an order of this court was made
<br />therein, assigning the 14th day of March, 1945, at 10 o'clock A.M. at the County Court Room in said
<br />County, as the time and place for hearing said petition, and ordering that notice of the pendency
<br />of said petition and hearing thereon be given to all persons interested in said matter by publish -
<br />ing said notice in the Grand Island Independent, a legal newspaper printed in said County, for
<br />three successive weeks prior to said day of hearing and it appears by proof on file, that notice
<br />of said order was given as ordered by this Court.
<br />THIRD.
<br />The Court further finds that Albert Herman named in said petition, was upon his giving bond in
<br />the sum of $500.00 as ordered by this Court, appointed Administrator as prayed; the Court further
<br />finds that the deceased at the time of her death, was a widow, and left the following heirs -at -law;
<br />Edith Schimmer, a daughter, Albert Herman, a son, Edna Knuth, a daughter, Martha Meyer, a daughter,
<br />Josephine Petzold, a daughter, Olga Husman, a daughter, Harry Herman, a son, Ernest Herman, a son,
<br />Mildred Hasselmann, a daughter, Laverne Meyer, a grandson, all being over the age of 21 years.
<br />FOURTH.
<br />That on the 14th day or March,1945, an order was made herein allowing creditors three months from
<br />and after the 11th day of April, 1945, in which to file their claims against said estate and said
<br />Administrator one year in which to settle said estate, and further ordering that a notice to cred-
<br />itors be published in the Grand Island Independent, a legal newspaper published and circulating in
<br />Hall County, Nebraska, for Three successive weeks prior to said 11th day of April, 1945, and that a
<br />hearing on claims filed against said estate would be held at the office of the County Judge of H41
<br />County, Nebraska, on July 14, 1945, at 9 o'clock A.M., and it appears by proof on file that notice
<br />of said order was published as ordered by this Court.
<br />FIFTH.
<br />The Court further finds that on the 14th day of March, 1945, said Albert Herman, an Administra-
<br />tor, filed in Court his inventory of the property of said estate, and that according to said in-
<br />ventory, the deceased died seized and possessed of the following described property to -wit:
<br />An undivided one -third interest in the North Half of the Northwest Quarter (N2NW14) of Section
<br />Ten (10) in Township Ten (10), North,Range Nine (5), West of the 6th P.M.
<br />SIXTH.
<br />The Court further finds that according to the laws of descent and distribution, said property
<br />descends as follows: an undivided one -tenth share thereof to each of the following:
<br />Edith Schimmer, Albert Herman, Edna Knuth, Martha Meyer, Josephine Petzold, Olga Husman, Harry
<br />Herman, Ernest Herman, Mildred Hasselmann and Laverne Meyer.
<br />SEVENTH.
<br />The Court further finds that on the 14th day of May, 1945, an order of this Court was made
<br />barring all claims not filed against said estate; the Court further finds that all debts and
<br />claims against said estate, including the costs of administration and the expenses of the last
<br />illness and burial of said Delia Herman, deceased, have been fully paid by Albert Herman as Ad-
<br />ministrator and that he has'advanced the sum of $192.40 to pay the same for the heirs -at -law of
<br />said Delia Herman, deceased, o.rhich he proposes to recover from the rentals accruing from the real
<br />estate hereinbefore described.
<br />EIGHTH.
<br />The Court further finds that after deducting from the assets of said estate, the costs of ad-
<br />ministration,-expenses and monies advanced by said Administrator and the statutory exemptions
<br />allowed the heirs -at -law in said estate, there is due and payable to the County Treasurer of Hall
<br />County, Nebraska, no inheritance tax whatsoever, notice of which fact has been given by this Court
<br />to John McCarthy, acting County Attorney of Hall County, Nebraska.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of Albert
<br />Herman, Administrator herein, be and the same hereby is approved and allowed as such; further that
<br />Edith Schimmer, Albert Herman, Edna Knuth, Martha Meyer, Josephine Petzold, Olga Husman, Harry
<br />Herman,_ Ernest Herman, Mildred Hasselmann, and LaVerne Meyer, are all and the only heirs -at -law
<br />of said deceased, and that the property described in paragraph Fifth hereof, descends according to
<br />
