<br />THE COURT FURTHER FINDS that neither the estate nor the beneficiaries thereof are subject

<br />barred and excluded from filing or setting up any claims or demands against said estate and that

<br />having been continued from thlel 2Szh day of January, 1942, and it appearing to the satisfaction of
<br />the Court that notice as required by law has been given to all persons interested as to the filing
<br />of said report and the time fixed for final settlement of said estate by publication, and no ob-
<br />jection or protest has been filed, and on examination thereof the Court finds that said report is
<br />correct in all respects and ought to be approved and allowed as the final report of said adminis-
<br />trator de bonis non:
<br />THE COURT FURTHER FINDS that notice as required by law was given to all creditors of said de-
<br />ceased of the time and place appointed for filing of claims against said estate and the time allowed
<br />for filing claims has fully expired; that all claims filed and allowed against said estate have been
<br />paid and satisfied and that all claims outstanding against said estate and not so filed,if any such
<br />there be, are forever barred and excluded. -
<br />THE COURT FURTHER FINDS that Elizabeth Kirkpatrick departed this life in her residence in Hall
<br />County, Nebraska, on the 17th day of July, 1939; that she was at the time of her death a resident
<br />and inhabitant of Hall County, Nebraska; that she died intestate; and that she left surviving as
<br />her heirs and only heirs at law the following named persons; James F.Kirkpatrick, a son; Elizabeth
<br />Gibbs, a daughter; Mina Potter, a daughter; Sherman Kirkpatrick, a son; Herman Kirkpatrick, a son;
<br />Emma Dearing, a daughter; all of legal age; the Court further finds that James F.Kirkpatrick is
<br />also known as J.F.Kirkpatrick and J.Frederick Kirkpatrick; that Sherman Kirkpatrick is also known
<br />as Sherman E.Kirkpatrick; that Herman Kirkpatrick is also known as Herman E.Kirkpatrick; that
<br />Elizabeth Gibbs is also known as Elizabeth- H.Gibbs; that Emma Dearing is also known as Emma M.
<br />Dearing.
<br />THE COURT FURTHER FINDS that Elizabeth Kirkpatrick, the deceased, died possessed of the
<br />following described real estate in Hamilton and Hall Counties as shown herein, as follows:
<br />Lots One (1), Two (2), Three (3), Four (4), Five (5) and Six (6) in Block Four (4), in
<br />the Town of Phillips, Hamilton County, Nebraska.
