<br />JAMES H.KIRKPATRICK, DECEASED.
<br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA
<br />DECREE.
<br />Now, on this 7th day of August, 1945, this cause came on for hearing on the final report of
<br />H.P.Zieg, Administrator de bonis non of the estate of James Kirkpatrick, Deceased, said hearing
<br />having been continued from the 21st day of Febr. 1942, and it appearing to the satisfaction of the
<br />Court that notice as required by law has been given to all persons interested as to the filing
<br />of said report and the time fixed for final settlement of said estate by publication, and no
<br />objection or protest has been filed, and on examination thereof the Court finds that said report
<br />is correct in all respects and ought to be approved and allowed as the final report of said ad-
<br />ministrator de bonis non:
<br />THE COURT FURTHER FINDS that notice as required by law was given to all creditors of said
<br />deceased of the time and place appointed for filing of claims against said estate and the time
<br />allowed for filing claims has fully expired; that all claims filed and allowed against said estate
<br />have been paid and satisfied and that all claims outstanding against said estate and not so filed,
<br />if any such there be, are forever barred and excluded.
<br />THE COURT FURTHER FINDS that James Kirkpatrick departed thie life in his residence in Hall
<br />County, Nebraska, on the 29th day of August, 1931; t ":gat he was at the time of his death a resident
<br />and inhabitant of Hall County, Nebraska; that he died intestate; and that he left surviving as his
<br />heirs and only heirs at law the following named persons: Elizabeth Kirkpatrick, Widow; James F.
<br />Kirkpatrick, a son; Elizabeth Gibbs, a daughter; Mina Potter, daughter; Sherman Kirkpatrick, son;
<br />Herman Kirkpatrick, son; Emma Dearing, daughter; all of legal age; the Court further finds that
<br />the deceased, James Kirkpatrick was also known as James H.Kirkpatrick; that James F.Kirkpatrick
<br />is also known as J.F.Kirkpatrick and J.Frederick Kirkpatrick; that Sherman Kirkpatrick is also
<br />known as Sherman E.Kirkpatridk; that Herman Kirkpatrick is also known as Herman E.Kirkpatrick;
<br />that Elizabeth Gibbs is also known as Elizabeth H.Gibbs; that Emma Dearing is also known as Emma
<br />M.Dearing.
<br />THE COURT FURTHER FINDS that James Kirkpatrick, the deceased, died possessed of the following
<br />described real estate in Hamilton and Hall Counties as shown herein, as follows:
<br />Lots One (1), Two (2), Three (3), Four (4), Five (5) and Six (6) in Block Four (4), in
<br />the Town of Phillips, Hamilton County, Nebraska,
<br />Lots Seven (7), Eight (8), Nine (9), Ten (10), Eleven (11), and Twelve (12) in Block Three
<br />(3), in the Original Town of Phillips, Hamilton County, Nebraska.
<br />Lots Eight (8), Nine (9), Ten (10), Eleven (11), and Twelve (12), in Block Eighteen (19),
<br />in the Original Town of Phillips, Hamilton County, Nebraska,
<br />North One -half MU of the Northeast Quarter (NE4) of the Northwest Quarter (Nth) of Section
<br />Twenty -seven (27), Township Eleven (11), North,Range Eight (8), West of the 6th P.M. in
<br />Hamilton County, Nebraska. n
<br />Commencing at a point on the South side of the alley fifty (50) feet in a Northeasterly
<br />direction from the Northwest corner of Lot Five (5) in Block Eighty -nine (89) in the
<br />Original Town, now City of Grand Island, Nebraska; thence running in a Northeasterly
<br />direction along South line of said alley One Hundred Thirty -six (136) feet to the West
<br />line of the County Road; thence South along the West line of said County Road Fifty -one
<br />(51) feet; thence in a Southwesterly direction parallel with the South line of said alley
<br />and forty -four (44) feet distant therefrom, One Hundred Five and eight tenths (105.8) feet;
<br />thence in a Northwesterly direction and parallel with the West line of Block Eighty-nine
<br />(89) Forty -four (44) feet to the place of beginning.

<br />of the 6th P.M., County of Hall, State of Nebraska, now City of Grand Island, Nebraska.
<br />The East Half (E2) of Block Fifteen (1 5) of Pleasant Home Subdivision of part of the East
<br />Half (Er!2�) of the Southeast Quarter (SE0 of Section Twenty -one (21), Township Eleven (11),
<br />North,Range Nine (9),West of the 6th P.M. in Hall County, Nebraska, now City of Grand Island,
<br />Nebraska.
<br />Lot Sixteen (16) of County Sub - division of part of West Half of the Southwest Quarter (WSW4)
<br />of Section Fifteen (15), Township Eleven (11),North,A`Range Nine (9), West of the 6th P.M., in
<br />Hall County, Nebraska, now City of Grand Island, Nebraska.
<br />The Easterly One -half (E2) of Lot Number Seven (7) in Block Fifty -nine (59) of the Original
<br />Town, now City of Grand Island, Nebraska, as surveyed, platted and recorded. The same being
<br />a rectangular piece of ground having a frontage of Thirty -three (33) feet on Third Street in
<br />said City, and a depth of One Hundred Thirty -two (132) feet.
