that all claims filed and allowed against said estate <br />have been paid and satisfied and that all claims outstanding against said estate and not so filed, <br />if any such there be, are forever barred and excluded. <br />THE COURT FURTHER FINDS that James Kirkpatrick departed thie life in his residence in Hall <br />County, Nebraska, on the 29th day of August, 1931; t ":gat he was at the time of his death a resident <br />and inhabitant of Hall County, Nebraska; that he died intestate; and that he left surviving as his <br />heirs and only heirs at law the following named persons: Elizabeth Kirkpatrick, Widow; James F. <br />Kirkpatrick, a son; Elizabeth Gibbs, a daughter; Mina Potter, daughter; Sherman Kirkpatrick, son; <br />Herman Kirkpatrick, son; Emma Dearing, daughter; all of legal age; the Court further finds that <br />the deceased, James Kirkpatrick was also known as James H.Kirkpatrick; that James F.Kirkpatrick <br />is also known as J.F.Kirkpatrick and J.Frederick Kirkpatrick; that Sherman Kirkpatrick is also <br />known as Sherman E.Kirkpatridk; that Herman Kirkpatrick is also known as Herman E.Kirkpatrick; <br />that Elizabeth Gibbs is also known as Elizabeth H.Gibbs; that Emma Dearing is also known as Emma <br />M.Dearing. <br />THE COURT FURTHER FINDS that James Kirkpatrick, the deceased, died possessed of the following <br />described real estate in Hamilton and Hall Counties as shown herein, as follows: <br />Lots One (1), Two (2), Three (3), Four (4), Five (5) and Six (6) in Block Four (4), in <br />the Town of Phillips, Hamilton County, Nebraska, <br />Lots Seven (7), Eight (8), Nine (9), Ten (10), Eleven (11), and Twelve (12) in Block Three <br />(3), in the Original Town of Phillips, Hamilton County, Nebraska. <br />Lots Eight (8), Nine (9), Ten (10), Eleven (11), and Twelve (12), in Block Eighteen (19), <br />in the Original Town of Phillips, Hamilton County, Nebraska, <br />North One -half MU of the Northeast Quarter (NE4) of the Northwest Quarter (Nth) of Section <br />Twenty -seven (27), Township Eleven (11), North,Range Eight (8), West of the 6th P.M. in <br />Hamilton County, Nebraska. n <br />Commencing at a point on the South side of the alley fifty (50) feet in a Northeasterly <br />direction from the Northwest corner of Lot Five (5) in Block Eighty -nine (89) in the <br />Original Town, now City of Grand Island, Nebraska; thence running in a Northeasterly <br />direction along South line of said alley One Hundred Thirty -six (136) feet to the West <br />line of the County Road; thence South along the West line of said County Road Fifty -one <br />(51) feet;
