In the matter of the estate ) FINAL DECREE. of Louise Gilbert, deceased. ) On August 2,1945,this cause come on for hearing on applica0ion of Robert E.Gilbert,to have the will of Louise Gilbert admitted to probate under Chap 30 Sec-1707 Comp.Statutes of Nebraska of 1943 and on the pleadings,process and evidence adduced in open court and on consideration thereof the court finds: That the allegations of the petition are true;that notice of the time and place of hearing on said petition was given to all persons interested in the estate or the last will of the deceased for the time and in the manner provided by law and the order of this court as appears from the proof of publ:i_cation of said notice on file herein;that the deceased died testate a resident of said Hall County on January 6,1939 a resident of said Hall County,Nebraska at the time of her death; that one of the witnesses to said will was sworn and examined as appears from the proof on file herein on consideration whereof I find that said will was duly executed as required by law;that said testatrix at the time of making said will,was of full age,of sound mind and memory and not under restraint and was in all respects competent to devise real and personal property and that said will has not been heretofore offered for probate in any county in Nebraska or elsewhere and thAt more than two years have elapsed since the death of the testatrix;that the deceased died seized in fee simple of an undivided one half interest as tenant in common in fee simple of the Southerly one half of Lot Ten (10) of County Subdivision of the Southerly half of the Southeast Quarter (S2 _SE; ) of Section Sixteen (16) in Township Eleven (11) , North, Range Nine ( 9 ) West of the 6 P.M. in maid Hall County and that said real estate and all personal property owned by the deceas- ed at her death including a one fourth distributive share of the estate of Linnie Smith deceased pending in the Bounty court of said Hall County passed and descended under said last will and under the statuteof wills of Nebraska to the petitioner Robert E.Gilbert referred to in said will as Robert Gilbert and that they are one and the same person and that any distributive share devis- ed or bequeathed to the-deceased under the will of the said Minnie Smith should be paid to said Robert E.Gilbert; that the testatrix,Louise Gilbert,left as her sole and only heir at law and only devisee and legatee said Robert E.Gilbert,her son;that all claims and demands against the deceased, or her estate including the court costs herein and expenses of deceased's last illness and burial have been fully paid and that any unpaid claims and demands,if any there be,are barred and preclud- ed;that the value of the estate of the deceased did not exceed the sum of $1500.00 and that said estate and the succession thereto are not subject to any inheritance tax under the laws of Nebraska. IT IS THEREFORE CONSIDERED,ORDERED AND DECREED;that said last will and testament was duly executed and that the same is genuine and valid and that said last will and testament be and it is admitted to probate and established as a will of real and personal estate;that the testatrix left as her sole and only devisee and legatee said Robert E.Gilbert her son and her sole and only heir at law,who was referred to in said will as Robert Gilbert;that the real estate above described and all real and personal estate owned by the deceased at her death passed and descended on her death to said Robert.E.Gilbert and the same including any distributive share of the estate of Minnie Smith, deeeased,should be and is assigned and declared to said Robert E.Gilbert;that more more than two years have elapsed since the testatrix' death and that all claims and demands against her or her estate are forever barred; that the estate of the testatrix is not subject to any inheritance tax under the laws of Nebraska;that "all court costs,expenses of this proceeding and publication of notice have been paid;that no personal representative be appointed to administer said estate and that said estate be and it is closed.
