<br />to said final account have been made or filed.
<br />Upon examination of the record and the evidence in this matter and being duly advised in the
<br />premises, the Court finds as follows:
<br />FIRST.
<br />That Henry Ditter, also known as Henry Detter, departed this life on the 24th day of April,
<br />1944, in Hall County, Nebraska, intestate, and at the time of his death he was a resident of Hall
<br />County, Nebraska.
<br />SECOND.
<br />That on the 20th day of December, 1944, '.`Mary Ditter, widow-of said Henry Ditter, also known
<br />as Henry Detter, deceased, filed in this Court a petition praying for the appointment of Molly
<br />Wilson as Administratrix of the estate of said deceased, and on the 29th day of December, 194+,
<br />an order of this Court was made therein, assigning the 24th day of January, 1945, at 10 o'clock
<br />A.M. at the County Court Room in said County, as the time and place for hearing said petition,
<br />and ordering that notice of the pendency of said petition and hearing thereon be given to all
<br />persons interested in said matter by publishing said notice in the Grand Island Independent, a
<br />legal newspaper printed in said County for three successive weeks prior to said day of hearing,
<br />and it appears by proof on file that notice of said order was given as ordered by this Court.
<br />THIRD.
<br />The Court further finds that Molly Wilson named in said petition was, upon her giving bond in
<br />the sum of $100.00 as ordered by this Court, appointed Administratrix as prayed; the Court further
<br />finds that the deceased at the time of his death, was married and that he left the following heirs -
<br />at -law: Mary Ditter, his widow, John Ditter, a son, Harold Ditter, a son, David Ditter, a son,
<br />Henry Ditter, Jr., a son, Mollie Wilson, a daughter, and Marie Klavon, a daughter, all of whom are
<br />over the age of F1 years.
<br />FOURTH. .
<br />That on the 24th day of January, 1945, an order was made herein allowing creditors three months
<br />from and after the 21st day of February, 1945s in which to file their claims against said estate
<br />and said Administratrix one year in which to settle said estate, and further ordering that a notice
<br />to creditors be published in the Grand Island Independent, a legal newspaper published and circu-
<br />lating in Hall County, Nebraska, for three successive weeks prior to said 21st day of February,
<br />1945, and that a hearing on claims filed against said estate would be held at the office of the
<br />County Judge of Hall County, Nebraska, on the 24th day of May, 1945, at 9 o' clock A.M., and it
<br />appears by proof on file that notice of said order was published as ordered by this Court.
<br />FIFTH.
<br />The Court further finds that on the 24th day of January, 1945, said Mollie Wilson, as Adminis-
<br />tratrix, filed in Court her inventory of the property of said estate, and that according to said
<br />inventory, the deceased died seized and possessed of the following described property, to-wit:
<br />Lot Three (3), in Block One Hundred Fifty -one (151) in Union Pacific Railway Company's
<br />Second Addition to the City of Grand Island, Nebraska.
<br />which was the homestead of said decedent, and
<br />1 United States of America Defense savings Bond Series E of the maturity value of_$25.00.
<br />SIXTH.
<br />The Court further finds that according to the laws of descent and distribution, said property
<br />descender as follows: An undivided one -third share to Marry.Ditter, and an undivided one -ninth
<br />share tF each of the following: John Ditter, Harold Ditter, David Ditter, Henry Ditter, Jr.,
<br />Mollie Wilson and Marie Klavon; that said Mary Ditter, as widow of said,Henry.Ditter, also known as
<br />Henry Detter, has a homestead right in and to said Lot in Block 151 14; 'V4-ap Pacific Railway
<br />Company's Second Addition to the City of Grand Island, ebraska, whiQ : etae was the home of
<br />said decedent and said Mary Ditter at the time of his death.
<br />SEVENTH.
<br />The Court further finds that on the 24th day of May, 1945, an order of this Court was made
<br />barring all claims not filed against said estate; the Court further finds that all debts and
<br />claims against said estate, including the expenses of the last sickness and burial of said
<br />decendent, as well as the costs of administration in said estate, have been fully paid and that
<br />there are no funds or chattel property in the hands of said Administratrix for distribution and
<br />that she has waived any and all claim for Administratrix fees.
<br />EIGHTH.
<br />The Court further finds that after deducting from the assets of said estate, all debts, claims,
<br />costs of administration and other proper expenditures, and the statutory exemptions allowed th9
<br />heirs -at -law in said estate, there is due and payable to the County Treasurer of Hall County, e-
<br />braska, no inheritance tax whatsoever, the gross value of said estate being less than $5,000.00.
<br />NINTH.
<br />The Court further finds that Molly Wilson, named in the petition filed herein for appointment
<br />of her as Administratrix herein, and the Mollie Wilson named as one of the heirs -at -law of said
<br />decendent, are one and the same person, irrespective of the discrepancy in the spelling of said
<br />names.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of said Mollie
<br />Wilson, Administratrix herein, be and the same hereby is approved and allowed as such; further that
<br />Mary Ditter, as widow, and John Ditter, Harold Ditter, David Ditter, Henry Ditter, Jr., Mollie
<br />Wilson and Marie Klavon are all and the only heirs -at -law of said deceased, and that the property
<br />described in ua.ragraph Fifth hereof, descends according to the laws of descent and distribution
<br />of the State of Nebraska, as found in Paragraph Sixth of this Decree; that said estate has been
<br />fully administered and that said Administratrix be and she hereby is discharged, her bond released
<br />and said estate fully settled and closed.
