<br />3rd day of January, 1941; that by the term of said last will and testa ment, after the payment of
<br />just debts amd funeral expenses, she gave, devised, and bequeathed to her children, Martha M.
<br />Nielsen, Helen Pauline Jacobsen, Arthur A.Nielsen, Thora Nielsen, Anna Christine Nielsen, William
<br />C.Nielsen, Ainer H.Nielsen, Xdaa O.Leschinsky, Bessie M.VanHoosen, Gilbert C.Nielsen, all of my
<br />property both real and personal of whatsoever nature to be divided between them share and share
<br />alike, with the following exceptions; that her son Arthur A.Nielsen, being indebted to her in the
<br />sum of $900.00 for back rent must either pay the same into ,the estate or said sum deducted from
<br />his share of the estate and divided equally between the rest of the children; that her daughter,
<br />Anna Christine Nielsen, is to receive her share from said estate except the sum of $620.00, which
<br />must be deducted from her share and the same paid to William C.Nielsen, a son of said deceased;
<br />that her daughter, Bessie M.VanHo &sen, is to receive her share of said estate except the sum of
<br />$880.00, which is to be deducted from her share and the same paid to William C.Nielsen, a son
<br />of said decedent.
<br />The court further finds that Helen Pauline Jacobsen, daughter of said decedent named in said
<br />last will and testament predeceased her mother, the said decedent, and left surviving her as her
<br />sole and only heirs at law the following named children to -wit: Laverne Jacobsen, Eugene Jacobsen,
<br />Raymond Jacobsen, Kenneth Jacobsen, Osborne Jacobsen, and Helen Mae Jachbeen, who is now known
<br />as Helen Mae Jacobsen Kipp, a daughterj, all of whom are of full legal age.
<br />The court further finds that Thora 1.Nielsen, daughter named in the said last will and testament
<br />of said deceased, predeceased her mother, said Anna Cecelia Nielsen, deceased, leaving no issue
<br />surviving her.
<br />The court further finds that said decedent left surviving her as her only heirs at law the fol-
<br />liwng named children; Martha M.Nielsen, Anna Christine Nielsen, daughters, William C.Nielsen,
<br />Art ur A. Nielsen, Ainer H.Nielsen, and Gilbert C.Nielsen, sons, E (<na O.Leschinsky and Bessie M.
<br />Van Hoosen. daughters, and La erne Jacobsen, Eugene Jacobsen,Raymm- Jacobsen, Kenneth Jacobsen
<br />and Osborne Jacobsen, grandsons and Helen Mae Jacobsen now known as Helen Mae Jacobsen Kipp, grand-
<br />daughter; that said grand children are sons and daughters of Helen Pauline Jacobsen, deceased
<br />daughter of the said Anna Cecilia Nielsen, deceased, she having predeceased her mother; that all
<br />of said heirs are of full legal age; that said Anna Cecelia Nielse::, deceased, left no widower sur-
<br />viving her.
<br />The court further finds that the funeral charges, expenses of the last sickness of said decedent
<br />and costs and expenses of administering os said estate have been paid in full.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND 15ECREED BY T1-E COURT:
<br />That all claims against said estate are forever barred.
<br />That said Final Account be, and the same is, hereby approved and allowed as the final Account of
<br />the executor, except as hereinafter set forth.
<br />That said executor retain the sum of $880.00 from the distributive share due Bessie M.VanHoosen
<br />and pay the same to William C.Nielsen, as provided in the Last will and testament of said decedent.
<br />That said executor retain the sum of $965.95 from the distributive share of Arthur A.Nielsen and
<br />distribute the same equally amoung the remaining children of said decedent, as provided in said
<br />last will and testament of said deceased.
<br />That said executor collect the sum of $483.87 due said estate from Thomas W.Lanigan,referee,
<br />and distribute the same in equal shares amoung the children of said deceased, excepting Arthur A.
<br />Nielsen and Gilbert C.Nielsen, and the chilccTren of the deceased daughter,Helen Pauline Jacobsen,
<br />who are to receive their mother's share, share and share alike;
<br />That the said executor assign the judgment against Roy G.Appel and Jens Apnel to the persons
<br />entitled thereto under the terms and conditions of the said last will and testament of said de-
<br />cedent.
<br />That said executor retain the sum of $200.00 for the purposes of paying income and other taxes that
<br />maybe due from said estate, and distribute the remainder of the eash in his hands amoung the
<br />children of said decedent named in the last will and testament of said decedent,excepting Arthur
<br />A.Nielsen and Gilbert C.Nielsen, share and share alike, and the children of Helen Pauline Jacobsen,
<br />a deceased daughter of said decedent who are to receive their mother's share,share and share alike.
<br />That said executor turned over to the persons entitled thereto all the remaining property both
<br />real and personal belonging to said estate now in his hands and distribute the same according to
<br />the terms and conditions of the said last will and testament of said decedent.
<br />That after performing all the duties required of him and after having assigned and turned over
<br />all of the property both real and personal remaining in his hands and conditions of said last will
<br />and testament of said decedent; and after having filed receipts showing payments, distributed and
<br />assigned as above set forth, said executor shall be discharged from his said trust and his bond
<br />released, save and except as above ordered.
<br />Said executor shall make further report to this court within one year from date hereof.

<br />Anna Cecelia Nielsen Deceased, and Final Order made -in said estate.

<br />WILL AND DECREE
<br />IN THE NAME OF GOD, AMEN,
<br />I, Mary Lehn, of Grand Island, in the County of Hall State of Nebraska, being of sound mind
<br />and memory, declare this to be my last will and testament; hereby revoking any and all former wills
<br />made by me.
<br />FIRST: I direct that my funeral expenses be first paid. I have an insurance policy which
<br />should cover all the expenses of my funeral and burial, which I desire to be in Burwell, Nebraska,
<br />where my son is buried. If however, said policy does not cover all expenses, then I direct my
<br />executor to pay such sum as is due and remaining on s4id burial and funeral expenses.
<br />SECOND: To expediate the handling of my estate, hereby give my executor, hereinafter named,
<br />full power and authority to sell and make deeds of conveyance of all of my real estate and personal
<br />property. Said authority to sell and convey to continue in him until he has been discharged in due
