<br />IN THE COUNTY COURT OF HAMILTON COUNTY, NEBRASKA.

<br />MARGARET BOAG, deceased. ) FINAL DECREE.
<br />This cause came on for hearing on May 16, 1945, on the petition of Anna A.Boag, the administra._.-'__
<br />trix, for final settlement of this estate. On motion of said administratrix made in open court
<br />this matter is hereby continued to May 29, 1945, at 10:00 A.M.
<br />This cause then came on furthdr to be heard on May 28, 1945, on said petition. The administra-
<br />trix was present in court in person and by Charles F.Adams, her attorney. It appearing to the
<br />satisfaction of the court that due and legal notice of the time and place of said hearing has been
<br />given to all persons interested in said estate by publication, as provided by law, and that no
<br />objections thereto have been filed, the matter is thereupon submitted to the court. On consider-
<br />ation of the pleadings, report and account herein, and the evidence, the court, being fully advised
<br />in the premises, finds as follows:
<br />1. That Anna A.Boag, the administratrix herein, should be charged with the sum of $12,050.02
<br />and credited with the sum of $1,639.57 and that there now remains in her hands the sum of $10,410.45,
<br />all of which is shown by her final report herein and which constitutes the remaining personal prop -i-
<br />erty assets of said estate, and that her report and account as such adrrdnistratrix is true and cor-
<br />rect and should be allowed and confirmed.
<br />2. That due and legal notice to creditors of this estate has been given by publication, as pro-
<br />vided by law, and that no claims or demands have been presented or filed against this estate and
<br />that a decree barring claims has been duly made and entered herein on April 7, 194 .
<br />3. That Margaret Boag, the deceased herein, died intestate on November 10, 1944, and was at the
<br />time of her death a resident of Hamilton County, Nebraska, and that she left surviving her as her
<br />sole and only heirs at law and next of kin the following:
<br />Anna A.Boag, daughter, Giltner, Nebraska
<br />Maggie P.Niklaus, daughter, Giltner, Nebraska.
<br />Roy S. Boag,eGiltner, Nebraska.
<br />The following children of Jessie E. Morton,
<br />deceased daughter of said Margaret Boag, deceased:
<br />James S.Morton, gr4ndson, Doniphan, Nebraska
<br />Margaret M.Morton, granddaughter, Doniphan, Nebraska.
<br />and that all of the above named persons are of full legal age and are fully competent.
<br />4. That said Margaret Boag, the deceased herein, was at the time of her death the owner in fee
<br />simple of the following described real estate, all of which remains undisposed of:
<br />An undivided one -half interest in and to the North Half 4 the Southwest Quarter WSA)
<br />and the Southwest Quarter of the Southwest Quarter (SAS ) of Section Sixteen (16), Township
<br />Nine (9) North,Range Eight (8) West of the 6th P.M. in Hamilton County, Nebraska,
<br />The North Half of the Southeast Quarter (*SE4) of Section Thirteen (13), Township Ten (10) _
<br />North,Range Nine (9) West of the 6th P.M. in Hall County, Nebraska,
<br />The Southwest Quarter (SWJ) of Section Twenty -three (23), Township Ten (10) North,Range
<br />Nine (9) West of the 6th P.M. in Hall County, Nebraska,
<br />none of which constituted the homestead of the deceased, and that said real estate descends to the _
<br />above named heirs at law in fee simple and without condition. `
<br />5. That Margaret Boag, the deceased herein, left no Last Will and Testament and therefore died
<br />intestate; that all debts, allowances, costs of administration and fees herein have been fully
<br />paid and that the balance of the personal property now on hand and the above described real estate
<br />should be assigned to the above named heirs at law and next of kin, as set forth above, and that
<br />neither this estate nor the distributive shares thereof are subject to any state or federal estate
<br />or inheritance tax.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that the final report of the administratrix herein
<br />be and the same is hereby allowed, approved and confirmed; that the above described real estate and
<br />the balance of the personal property now in her hands be and the same is hereby assigned to the
<br />above named heirs at law and next of kin, as set forth.above; that upon delivery and payment there-
<br />of and filing of proper receipts evidencing the same, said administratrix herein shall be entitled
<br />to be discharged from her trust, and that she and the sureties on her official bond be released
<br />from all liability thereon.
<br />IT IS FURTHER ORDERED that the matter of the discharge of said administratrix be continued
<br />until the further order of this court and that said Anna A.Boag be retained and continued as ad-
<br />ministratrix herein until her discharge is entered of record herein.
