617 <br />FINAL DECREE <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA. <br />In the matter of the estate ) <br />of ) FINAL DECREE. <br />Johanna Rosenkotter, deceased, ) <br />Ilso known as Johanna Rosenkoettert ) <br />T Now, on this 11th day of April, 1945, this cause came on for hearing upon the final report of <br />Henry Rosenkotter, administrator, and the Court, having examined the records and files and being <br />fully advised, finds that due and legal notice has been given to all persons interested in said <br />estate of the time and place fixed for hearing upon said report, as ordered by the Court. <br />The Court, having examined the final report, together with all the files, vouchers, and receipts <br />and the testimony offered in support thereof, finds that said report is true and correct in all <br />things and ought to be allowed and approved as the final report of said administrator. <br />The Court finds that the residue, as set forth in the final report, in the amount of $4991.54, <br />has been paid, as-evidenced by the receipts of the several heirs at law filed herein. <br />The Court further finds that Johanna Rosenkotter, also known as Johanna Rosenkoetter departed <br />this life on the 28th day of August, 1942, at her place of residence in Hall County, Nebraska, <br />and at the time of her death was a resident and inhabitant of Hall County, Nebraska. <br />That a petition was filed for the appointment of an administrator, that due notice was given <br />thereof, and upon hearing the same the Court appointed Henry Rosenkotter, a son of said deceased, <br />as administrator, and he duly qualified as such. <br />The Court further finds that Johanna Rosenkotter died seized of the following described real <br />estate; <br />An undivided one -third interest in and to Lot Six (6)- in Block Three (3) in Hann's Second <br />Addition to the city of Grand Island, being a part of Lots 10, 11, and 12, of the County <br />Subdivision of the west half of the southwest quarter of Section 15, in Township 11 North, <br />Range 9 West of 6th P.M., in Hall County, Nebraska, and <br />An undivided one -third interest in and to the east one -half of the southeast quarter <br />of Section Twenty -six (26), Township Eleven (11),Range Nine (9) West of 6th P.M.,con- <br />taining 80 acres, more or less, all in Hall County, Nebraska. <br />The Court further finds that said Johanna Rosenkotter left surviving her, as her sole and only <br />heirs at law, the following: <br />Minnie Degner, daughter, <br />Henry Rosenkotter, son, <br />Martha 'Wilder, now Martha Colyer, daughter, <br />Anna Rosenkotter Scheffel, daughter, <br />Marie Schroeder, daughter, <br />Emma Sommer, daughter, <br />Frederick-Rosenkotter, a son, <br />Ella Rosenkotter Bro ckmei er, daughter, <br />Carl Rosenkotter, son, <br />William Rosenkotter, son, <br />and that under the laws of descent of the state of Nebraska, said real estate passed and descended <br />to said surviving heirs at law, share and share alike. <br />The Court further finds that said estate was not subject to inheritance tax under the laws <br />of the state of Nebraska; that the administrator has paid all of the claims filed for funeral <br />expenses, the debts of the deceased, the costs of administering said estate, together with the <br />administrator's and-attorney's fees. <br />The Court further finds that said administrator has accounted to the surviving heirs at law <br />for all of the moneys received and disbursed. <br />The Court further finds that due and legal notice has been given to all persons of the time and <br />place fixed for filing claims against said estate, that the time has fully expired, and all claims <br />filed have been paid. <br />IT IS, THEREFORE, ORDERED AND ADJUDGED BY THE COURT that all persons having claims against <br />said estate, if any such there be, and not filed herein, are forever barred and excluded from <br />setting up or asserting any such claims against said estate. <br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED that the final report of Henry Rosenkotter, <br />administrator, be, and the same is hereby, approved and allowed as and for his final report, and <br />said administrator is hereby discharged and his bond released, and said estate is hereby settled <br />and closed. <br />IT IS FURTHER ORDERED AND DECREED BY THE COURT that the real estate hereinbefore described did <br />pass and descend under the laws of descent of the state of Nebraska, upon the death of said Johanna <br />Rosenkotter, also known as Johanna Rosenkoetter, deceased, to her sole and only heirs at law, <br />Minnie Degner, Henry Rosenkotter, Martha Wilder, now Martha Colyer, Anna Rosenkotter Scheffel, <br />Marie Schroeder, Emma Sommer, Frederick Rosenkotter, Ella Rosenkotter Brockmeier, Carl Rosenkotter, <br />and William Rosenkotter, share and share alike. <br />Charles Bossert <br />COUNTY U . <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA. <br />CERTIFICATE. <br />STATE OF NEBRASKA ) I, Charles Bossert, County Judge of Hall County, Nebraska, do hereby <br />HALL COUNTY )ss' certify that I have compared the foregoing copy of Final Decree entered <br />IN THE MATTER OF THE ESTATE OF Johanna Rosenkotter, also known as Johanna Rosenkoetter,Deceased, <br />with the original record thereof, now remaining in said Court, that the same is a correct transcript <br />thereof, and of the whole of such original record;
