That all of the statements and allegations set forth in said petition are true; that Franz Lechner also known as Francis Lechner, also known as Frank Lechner, died a resident of Dubois County, Indiania on the 25th day of October, 1899; that the said Franz Lechner deceased, left a last will and testament which was duly admitted to probate in the Circuit Court of the Dubois County Court, Indiania and that a duly authenticated copy of such will and a probate thereof have been received i-5-evidence herein; that more than two (2) years have elapsed since the death of the said deceased and that said Last Will and Testament has not'been heretofore offered for probate in any court of Nebraska; that the said deceased at the time of his death was the owner in fee of Lot Eight (8) in Block Ten (10) in the original town, now city of Grand Island, Hall County, Nebraska. That the said deceased left surviving him as his sole and only heirs at law; Margaret Lechner, his widow, Frank Lechner (Also known as Frank Peter Lechner) Joseph Lechner, Conrad Lechner, Adam Lechner, Peter Lechner, Felix Lechner, Alois Lechner, (Also known as Charles A.Lechner, sons, and Mary M.Kief er (Also known as Mary Keifer) and Margaret Lechner (Also known as Margaretha Lechner, also known as Ma.rgarethe Lechner) daughters.
