<br />last will and testament of Franz Lechner, deceased, was filed for probate in this Cburt. That on
<br />the 20th day of April, 1945, said instrument to which this certificate is attached was duly proved,
<br />probated and allowed as the last will and testament of the real and personal estate of said Franz
<br />Lechner deceased, and the same was ordered to 'be recorded in the records of the Court aforesaid.

<br />Now on this 20th day of April, 1945, this cause came on for hearing upon the pleadings and the
<br />evidence and was submitted to the Court, and on consideration thereof the ,Court finds:
<br />That due and legal notice of the proceeding has been given to all persons interested in said
<br />matter, whether creditors, heirs, legatees of devisees as required by law.
<br />That all of the statements and allegations set forth in said petition are true; that Franz
<br />Lechner also known as Francis Lechner, also known as Frank Lechner, died a resident of Dubois
<br />County, Indiania on the 25th day of October, 1899; that the said Franz Lechner deceased, left a
<br />last will and testament which was duly admitted to probate in the Circuit Court of the Dubois
<br />County Court, Indiania and that a duly authenticated copy of such will and a probate thereof
<br />have been received i-5-evidence herein; that more than two (2) years have elapsed since the death
<br />of the said deceased and that said Last Will and Testament has not'been heretofore offered for
<br />probate in any court of Nebraska; that the said deceased at the time of his death was the owner
<br />in fee of
<br />Lot Eight (8) in Block Ten (10) in the original town, now city of Grand Island,
<br />Hall County, Nebraska.
<br />That the said deceased left surviving him as his sole and only heirs at law; Margaret Lechner,
<br />his widow, Frank Lechner (Also known as Frank Peter Lechner) Joseph Lechner, Conrad Lechner,
<br />Adam Lechner, Peter Lechner, Felix Lechner, Alois Lechner, (Also known as Charles A.Lechner, sons,
<br />and Mary M.Kief er (Also known as Mary Keifer) and Margaret Lechner (Also known as Margaretha
<br />Lechner, also known as Ma.rgarethe Lechner) daughters.
<br />The Court further finds that the said Franz Lechner, in said Last Will and Testament did not
<br />specifically dispose of the real estate hereinbefore described and that neither was there a
<br />residuary clause in said Will and the Court therefore finds that with reference to the real estate
<br />in Hall County, Nebraska hereinbefore described, that the said Franz Lechner died intestate, and
<br />that under the laws of descent that the aforedescribed real estate passed and descended to his
<br />children, Frank Lechner (Also known as Frank Peter Lechner) Conrad Lechner, Adam Lechner, Peter
<br />Lechner,Felix Lechner, Joseph Lechner, Alois Lechner,(Also known as Charles A.Lechner) sons,
<br />and Mary M.Kiefer (Also known as Mary Keifer) and Margaret Lechner (Also known as Margaretha,

<br />State of Indiana, do certify that Dubois County, in the State of Indiana, is comprised within and
<br />constitutes a part of the said 57 Judicial Circuit of said State, and that the foregoing attest-
<br />ation and certificate of Sylvester A.Berger are in due form of law, and that the said Sylvester A.
<br />Berger is, and at the time of making said attestation and certificate was the Clerk of said Dubois
<br />Circuit Court, of said State, and the proper officer to make said attestation and certificate, and
<br />that his signature thereto is genuine, and that as such Clerk, he is the sole custodian of the
