<br />.The Court further finds that according to the terms, conditions and provisions of said Last Will
<br />and Testament of said deceased, said property was devised and bequeathed unto George Victor Pedersen
<br />Frank John Pedersen, and Mildred Herman, share and share alike, in fee simple absolute.
<br />SIXTH.
<br />The Court further finds that on the 8th day of March, 1945, Ray M.Higgins was appointed
<br />appraiser of this estate by order of-the Court for inheritance tax, and filed his report herein,
<br />after having given due notice as by law required of a hearing for the purpose of such appraisal
<br />and holding such hearing for that purpose, finding the value of this estate in the sum of
<br />$12,710.45, which report this Court approves and adopts and -finds that after payment of just
<br />debts and the costs of of administration, that the value of the share of each of said devisees
<br />and legatees is less than the statutory exemption under the laws of the State of Nebraska for
<br />each of them; the Court further finds that the time has expired for filing claims against this
<br />estate and on the 15th day of March, 1945, the Court entered an order barring the filing of any
<br />and all other claims against said estate and excluding the holders thereof from setting up or
<br />asserting such claims against said estate.
<br />SEVENTH.
<br />The Court further finds that all claims against said estate, including the costs of adminis-
<br />tration hereof, have been fully paid by said Executors and that,the final report is correct in
<br />all respects and should be approved and allowed; that there remains in the hands of said Execu-
<br />tors the sum of $107.67 in cash and the Certificate of Stock No. 72 of Farmers Union Co- operative
<br />Gas and Oil Company for 10 shares of the capital stock of said company, and the personal jewelry
<br />set forth in the inventory herein filed, all of which, according to the terms and provisions of
<br />said Last Will and Testament, are payable and distributable unto the said George Victor Pedersen,
<br />Frank John Pedersen and Mildred Herman, share and share alike, and that there is due and payable
<br />to the County Treasurers of Hall County, Nebraska and Merrick County, Nebraska, no inheritance
<br />tax herein whatsoever.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of George Victor
<br />Pedersen and Frank John Pedersen, Executors, be and the same is hereby approved and allowed as such;
<br />that the property described in Paragraph Fifth hereof was devised and bequeathed according to the
<br />terms and conditions of said Last Will and Testament of John Pedersen, deceased, unto George
<br />Victor Pedersen, Frank John Pedersen and Mildred Herman, share and share alike,in fee simple
<br />absolute; that there remains in the hands of said executors the assets set forth in Paragraph
<br />Seventh hereof which are undistributed, and upon distribution thereof as hereinbefore provided
<br />by said Executors, abd their filing receipts showing such distribution, that they be discharged,
<br />and their bond released and said estate fully administered, settled and closed.

<br />Now on-this 11th day of April, 1945, this matter came on to be heard upon the pleadings and the
<br />evidence and was submitted to the Court, on consideration whereof the Court finds that due and
<br />legal notice of this proceeding has been given to all persons interested in said matter, both
<br />creditors and heirs, as required by law. That all of the statements and allegations set forth
<br />in said petition are true; that the said Peter N.Herman died intestate in Hall County, Nebraska,
<br />on July 6, 1935, seized and possessed at the time of his death of the following described real
<br />estate, to -wit:
<br />North Half (NI) of Northwest Quarter (NWJ) of Section Ten (10) in Township Ten (10),North,
<br />Range Nine (91,West of the 6th P.M.
<br />That no application has been made in the State of Nebraska, for the appointment of an Admin-
<br />istrator of the estate of said deceased, nor has a decree of heirship been entered in any pro-
<br />ceedings. That the wife of said Peter N.Herman survived him, and that his only heirs were and
<br />are -is widow, Delia Herman, and his children, namely: Edith Schimmer, Albert Herman, Edna Knuth,
<br />Martha Meyer, Josephine Petzold, Olga Husman, Harry Herman, Ernest Herman and Mildred Hasselmann,
<br />and the only child of a pre - deceased daughter, Linda Meyer, who is a grandson, namely Laverne
<br />Meyer; and the Court hereby finds and determines that they are the sole and only heirs at law
<br />of the said Peter N.Herman, deceased, and that said real estate descended upon his death as fol4
<br />lows; To Delia Herman, an undivided one.,»third, and to Edith Schimmer, Albert Herman, Edna Knuth,
<br />Martha Meyer, Josephine Petzold, Olga Husman, Harry Herman, Ernest Herman, Mildred Hasselmann
<br />and Laverne Meyer, each an undivided one - fifteenth.
<br />IT IS THEREFORE CONSIDERED AND ADJUDGED BY THE COURT that the real estate above described
<br />be and the same hereby is assigned to the said Delia Herman, an undivided one - third, and to the
<br />said Edith Schimmer, Albert Herman, Edna Knuth, Martha Meyer, Josephine Petzold, Olga Husman,
<br />Harry Herman,Ernest Herman, Mildred Hasselmann, Laverne Meyer each an undivided one - fifteenth.
