OWN <br />THEAUGUSTINECO. 20112.2.41 <br />Fannie Campbell,who is one and the same person as Fannie Cooley,her maiden name being Fannie <br />Cooley;and <br />Esther L.Phillips,who is one and the same person as Esther Phillips and Ettie Cooley,her maiden <br />name having been Esther Cooley,and she having been commonly known as Ettie Cooley prior to her <br />marriage to one Samuel Phillips. <br />The Court further finds that the said Mortimer W.Cooley was a single man at the time of his deat}';, <br />his wife having predeceased him,and that the foregoing named heirs at law were the children and <br />all of the children of the said Mortimer W.Cooley,and that there was no issue of any deceased <br />child or children,and that the petitioner claims title through mesne conveyances made by the said <br />heirs at law of the said Mortimer W.Cooley. <br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED BY THE COURT that Mortimer W.Cooley died intestate on <br />July 10,1892,a resident of Hall County,Nebraska; that more than two years have elapsed since his <br />death;that he had made entry on government lands and had not received patent therefor,to -wit: <br />The South Half of the Northwest Quarter (S,NWJ) of Section Eight (8) in Township Ten (10),North, <br />of Range Eleven (11),West of the 6th P.M.,in Hall County,Nebraska. <br />That an administrator was appointed,but no decree of heirship was entered in his estate;that a patent <br />was issued to the heirs of Mortimer W.Cooley;that he was a single man at the time Of his death and <br />that the sole and only heirs at law were Thomas W.Cooley.otherwise known -as T.W.Cooley;Walter A. <br />Cooley,otherwise known as W.A.Cooley;Daniel J.Cooley;Helen M.Dodge; Fannie Camp.bell,whose maiden <br />name was Fannie Cooley;and Esther L.Phillips,who is otherwise known and described as Esther Phillips <br />and Ettie Cooley. <br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that the degree of kinship of the afore <br />mentioned heirs at law was that of being sons and daughters of the said Mortimer W.Cooley,and <br />that the right of descent of the real property belonging to the deceased was to the afore mention- <br />ed heirs at law,share and share alike,as tenants in common;that said real estate did upon the death <br />of the said Mortimer W.Cooley pass and descend to said heirs at law,share and share alike,as <br />tenants in commom,and that the right of the said Mortimer W.Cooley to rec6tve a patent therefor <br />did pass and descend to said heirs at law,as tenants in common, share and share alike. <br />Charles Bossert <br />COUNTY JUDGE. <br />In the County Court of Hall County,Nebraska <br />Certificate <br />State of Nebraska, ) <br />) ss. Judge of Hall County, Nebraska, do hereby <br />Hall County ) certify that I have compared the foregoing copy of Final Decree <br />entered IN THE MATTER OF THE ESTATE OF MORTIMER W.000LEY,DECEASED, <br />with the original record thereof,now remaining in said Court,that the same -is a correct transcript <br />thereof,and of the whole of such original record; that said Court is a Court of Record having a <br />seal,which seal is hereto attached;that said Court has -no Clerk authorized to sign certificates <br />in his own name,and that I am the legal custodian of said Seal and Of the Records of said Court, <br />and that the foregoing attestation is in due form of law. <br />IN TESTIMONY WHEREOF I have hereunto set my hand and affixed the seal of the County Court,at <br />Grand Island,this 5th day of April 1945- <br />(SEAL) Charles Bossert <br />County Judge <br />Filed for record this 6 day of April,1945, at 10 o'clock <br />Register of Deeds <br />- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- O- o- o- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- O -O -o- <br />DECREE ON FINAL ACCOUNT <br />IN THE COUNTY COURT OF SEWARD COUNTY, NEBRASKA <br />IN THE MATTER OF THE ESTATE OF ) DECREE ON FINAL ACCOUNT. <br />MAY E.R.WHITNAH, DECEASED. <br />NOW, on this 30th day of March, 1945, this cause coming on to be heard on the petition for <br />final settlement of the estate of May E.R.Whitnah, deceased, on the final administration account <br />of the administrator of said estate, and the evidence,was submitted to the Court, on consideration <br />whereof the Court finds: <br />THAT, on the 10th day of March, 1945, the administrator of said estate of said deceased, filed <br />in this court his final administration account and a petition praying that said account be settled <br />and allowed; that said estate be distributed as required by law, and that a discharge be issued, <br />and that for these purposes a time and place be assigned for hearing said petition, and examining <br />and settling said account, and that notice be given thereof as the law directs. <br />THAT, on the 10th day of March, 1945, an order of Court was made assigning the 30th day of <br />March 1945, at 9 o'clock A.M:. at the County Court of Seward County, Nebraska, as the time and <br />place for hearing said p6ti.tion, and examining and settling said account, and requiring that <br />notice of said hearing be given to all persons interested by publishing a notice thereof three <br />successive weeks in the Seward Independent, a legal newspaper:.- printed and published and of <br />general circulation in said County. <br />That notice of the hearing has been duly given as required by law and the order of this Court, <br />and due proof of the publication thereof made and filed herein." <br />That the final administration account is in all.respects true and correct, that due notice to <br />creditors has been given, that all claims allowed against said estate have been fully paid and <br />satisfied, all claims and debts not filed forever barred, and that said estate is fully solvent. <br />The Court further finds that the said May E.R.Whitnah, deceased, departed this life intestate <br />while a resident of Seward County, Nebraska, on the 18th day of October 1944, and that at the <br />time of her death she was the owner of all the personal property mentioned and set forth in the <br />inventory filed in this estate which is hereby referred to and made a part of this decree as <br />fully as if set out at length herein, and of the following described real estate, to -wit: <br />The Southeast Quarter (SEJ) of Section Thirteen (13), Township Nine (9),North,Range.One (1), <br />East of the Sixth P.M., Seward County, Nebraska. <br />The Southwest Quarter (S*) of Section Thirty (30), Township Twelve (12) North,Range.Nineteen <br />(19),West of the Sixth P.M., Dawson County, Nebraska. <br />1 <br />1 <br />1 <br />1 <br />
