<br />WILL AND DECREE
<br />Last Will and Testament.
<br />I. Rev. W.H.O'Keefe, being of sound mind and disposing memory do make and declare this to be
<br />my Last Will and Testament, and hereby revoke and declare null and void any Last Will and Testa,
<br />ment by me previously made.
<br />I. To Mrs.Marie Stitts I will and bequeath all funds, valuables and papers that I have or may
<br />have in any bank or banks in Tucson, Arizona.
<br />II. To Mrs.Marie Stitts I will and bequeath all my books and personal belongings that I have
<br />in Tucson, Arizona.
<br />III.To Mrs.Marie Stitts I will and bequeath my share in the Grand Island, Nebraska, property
<br />in rich I am a beneficiary along with other relatives.
<br />IIII.Should anyone attempt to contest this my Last Will and Testament I herein will and bequeath
<br />the contestant the sum of one dollar.
<br />V. I hereby make, constitute and appoint Mrs.Marie Stitts as the Executrix of this my Last
<br />Will and Testament without having to give bond or security, and that she be not compelled
<br />to account to any County or other Court. This my Last Will and Testament is not to be
<br />probated.
<br />VI. In witness whereof I have hereunto set my hand this sixth day of July 1937

<br />I, Paul N.Kirk, Judge of the County Court, in and for said County, do hereby certify that on
<br />the 11th day of October, 1938, the instrument purporting to be the last will and testament of
<br />William H.O'Keefe deceased, was filed for probate in this Court. That on the 17th day of December,
<br />1938, said instrument to which this certificate is attached was duly proved, probated and allowed
<br />as the last will and testament of the real and personal estate of said William H.O'Keefe deceased,
<br />and the same was ordered to be recorded in the records of the Court aforesaid.

<br />William O'Keefe, Deceased. ) FINAL DECREE.
<br />This matter came on for hearing this 16th day of March, 1945, upon the final account and
<br />petition for distribution of Marie Stitts, executrix of the last will and testament of William
<br />O'Keefe, deceased, and was submitted to the Court upon the files and the evidence, said hearing
<br />having been continued from the 3rd day of January, 1945-
<br />Upon consideration thereof, the Court finds from the proof on file that all persons interested
<br />in said estate halve been duly notified as required by law and the orders of this Court, and after
<br />a full examination of the final account of such executrix, that such account is true and correct
<br />and should be approved and allowed; no claims have been filed and allowed against such estate;
<br />claims against such estate have been barred. by order of this Court and notice as provided for by
<br />law; such deceased left no wife, children or mother, him surviving; deceased left him surviving,
<br />as his sole heir at law, James O'Keefe, his father, now deceased, formerly of Pittston, Pennsylvania;
<br />the undivided interest of such deceased in the real estate hereinafter assigned is less than
<br />$500.00 in value and no inheritance tax is due the State of Nebraska or the United States; the
<br />costs of this Court and fees of attorneys for executrix have been paid; the sole devisee and
<br />legatee of such deceased is Marie Stitts, of Gary, West Virginia, more than 21 years of age.
<br />IT IS, THE'1=0RE, ORDERED, ADJUDGED AND DECREED that the final account of Marie Stitts,
<br />executrix of the estate of William O'Keefe, deceased, be, and the same is hereby, in all things,
<br />approved, confirmed, and allowed, and such Marie Stitts is discharged from her trust as executrix
<br />of s?.zch estate, and her official bond released; the sole surviving heir -at -law of such deceased
<br />was James O'Keefe, his father; the undivided interest of deceased in Lot 3, Block 4, in Rollins'
<br />Addition to the city of Grand Island,Hall County, state of Nebraska, and the personal property
<br />remaining for distribution, according to the terms and provisions of the last will and testament
<br />of such deceased, is devised, and bequeathed, and is assigned to, Marie Stitts, as the sole devisee
