<br />by the inventory and the following described real estate;
<br />Lot Number 12 in Block number 19, in the Original town of Woodriver in Hall County, Nebraska.
<br />That by proper proceedings had in this Court, John Simmerman was appointed administrator of said
<br />estate and he took the oath and gave bond as required by the Court and has accounted for all of the
<br />assets of said estate; that due and legal notice has been given to all creditors of said estate to
<br />file their claims herein and that the time for filing claims has expired and that all claims not
<br />filed are forever barred and that all claims filed and allowed by said Court have been fully paid;
<br />that the said estate is not liable for inheritance taxes under the laws of the State of Nebraska
<br />nor for estate taxes under the Acts of Congress; that the deceased left as her sole and only heir
<br />at law; her son, Warren O.Simmerman,who is at this time of full and legal age and that the said
<br />Warren O.Simmerman is entitled to all of said estate.
<br />IT IS THEREFORE CONSIDERED BY THE COURT that Eva M.Simmerman died, as above set out, a resident
<br />of Buffalo County, Nebraska, leaving no last Will and Testament and leaving as her sole and only
<br />heir at law; her son Warren O.Simmerman, who is entitled to all of said estate, and that the said
<br />Warren O.Simmerman is at this time of full legal age; that all claims against said estate are for-
<br />ever barred and that said estate is not liable for inheritance taxes under the laws of the State
<br />of Nebraska nor for estate taxes under the Acts of Congress; that the report of the administrator
<br />is correct and that upon filing receipts herein, the administrator is discharged from further
<br />liability.

<br />Now on this 24th day of February, 1945, at ten o'clock a.m., as per notice published, this
<br />matter comes on upon the petition of the executor for final distribution, and in consideration
<br />whereof the court finds and decrees as follows:
<br />That Charles A.Porth,deceased, departed this life testate, a resident of the City of Hastings,
<br />in Adams County, Nebraska, on the 28th day of July, 1944; that by proper proceedings had and done
<br />his Last Will and Testament was duly proved, approved, and allowed and admitted to probate on the
<br />23rd day of August, 1944, and which Will and Certificate of Probate are as follows:
<br />"LAST WILL AND

<br />CHARLES A.PORTH,
<br />TESTAMENT
<br />Hastings, Nebraska.
<br />I, Charles A.Porth, of Hastings, Nebraska, do hereby make, publish and declare t];As my last
<br />will and testament:
<br />1.
<br />I direct that all my just debts, including the expenses of my last illness, be paid out of my
<br />personal estate, and as soon after my death as conveniently can be done without injury to my estate.
<br />2.
<br />Prior to my marriage to my present wife, she and I entered into an ante nuptial contract, and
<br />in accordance with the terms of that contract, I give and devise to my beloved wife, Myrtle Porth,
<br />the following described property:
<br />(a)The West 60 Feet of Lot 4, and East 50 Feet of Lot 5 of Kerr's Addition to the City of
<br />Hastings, Adams County, Nebraska, absolutely to have and to hold the same forever.
<br />(b) The Southwest Quarter (SWJ) of Section 22, Township 9 North,Range 10 West of the 6th P.M.,
<br />in Hall County, Nebraska.
<br />to have and to hold for and during her natural life, but she shall pay the taxes on said real
<br />estate during her enjoyment thereof, and the remainder in said premises shall pass as hereinafter
<br />provided.
<br />I also give and bequeath to my beloved wife the following personal property:
<br />(a) All of the household furniture, furnishings and equipment belonging to me at the time of
<br />my death, except such articles as family pictures which my children may desire, and any automobile
<br />owned by me at the time of my death, absolutely to have and to hold the same forever.
<br />(b) The sum of $800.00 in cash, one -half of which shall be paid to my wife from my estate on
<br />or before six months after my death, and one -half of which shall be paid from my estate within one
<br />year after my death.
<br />The foregoing provisions for my beloved wife, Myrtle Porth, are in lieu of all her statutory
<br />rights in my estate as surviving spouse.

<br />I give and devise to my beloved son, Maynard Charles Porth:
<br />The Southwest Quarter (SW41) of Section 16, Township 9, North,Range 10 West of the 6th P.M., gnd
<br />The North Half of the Southeast Quarter (N2SEJ) of Section 19, Township 9 North,Rarge 10 West
<br />of the 6th P.M., all in Hall County, Nebraska,
<br />absolutely to have and to hold the same forever.
<br />I five and bequeath to my said son, Maynard Charles Porth, all my hand tools, such as carpenter
<br />tools,'- absolutely to have and to hold the same forever,
