<br />This matter came on for hearing this 20th day of February,19451upon the final report and petition
<br />for settlement and distribution of Harry Schmidt,executor of the estate of Emma Schmidt,deceased,
<br />the Files and the evidence,and was submitted to the Court;
<br />The -Court finds that: due and legal notice of the time and place of hearing on said final report
<br />and petition for settlement and distribution,has been given to all persons interested in said
<br />estate,as provided by law;the devisees,Pargaret George,Clara Sanders,and Harry Schmidt,have each
<br />filed herein an election to take distribution in kind and consent to the account of the executor
<br />as filed herein,and the closing of the account for operation of store business as of January 6,
<br />1945;Margaret George and lIar�;aret Krow are one and the same person;the final report and account
<br />of such executor is,in all respects,just,true,and correct;due notice has been given to creditors;
<br />all claims allowed against such estate have been paid and satisfied;there remains both personal
<br />and real property of such estate for distribution,after payment of all debts,expenses and costs
<br />of administration;such estate has heretofore been appraised for inheritance purposes by an
<br />appraiser duly appointed by this Court and such appraiser Mlas .filed. his report of appraisement
<br />herein that no inheritance tax is due,after due notice to the County Attorney of Hall County,
<br />Nebraska,and all interested persons;the deceased left surviving her,as her sole and only heirs
<br />at law: Margaret Georp;e,a daugilter,of LiLramie,Wyoming; Clara Sanders,a daughter,of Council Bluffs,
<br />Iowa;and Harry Schmidt,a son,of Grand Island,Nebraska,all more than 21 years of age.
<br />IT IS ,THER.EFORE,COPISIDERED,ORDERED AND ADJUDGED BY THE COURT that: such estate and the shares of
<br />the devisees therein is and are not subject to inheritance tax under the laws of Nebraska or the
<br />United States;the real estate of which such Emma Schmidt died seized,to -wit:
<br />Lot Eight (S) in Block Ten (10) in John Voitle's Addition to the City of Grand Island,in Hall
<br />County,Nebraska;
<br />Fractional Lot One (1) in Block Twelve (12) of John Voitle's Addition,and its complement,Fraction-
<br />al Lot One (1) in Block Three (3) in Evans' Addition,both additions to the city of Grand Island,
<br />Hall County,Nebraska,according to the recorded plat thereof;
<br />Lot Two (2) in Block Twelve (12) in John Voitle's Addition to the city of Grand Island,Hall
<br />County, Nebraska;
<br />Lot Five (5) in Block Five (5) in Evans' Addition to the city of Grand Island,Hall County,Nebraska;
<br />The north 90 -3/4 feet of Lot Twenty -two (22) of the County Subdivision of the west half of the
<br />southwest quarter of Section Ten (10),in Township Eleven (11) North of Range Nine (9) West of
<br />6th Principal M eridian,in Hall County,Nebraska;
<br />All that part of Lot Eight (8) in Block Five (5) in South Grand Island,lying east and south of
<br />the right -of -way of the Grand Island and Wyoming Central Railroad Company over and through said
<br />lot,in Grand Island,Hall County,Nebraska,
<br />Part of the southeast quarter of the southeast quarter of Section Twenty -one (21),in Township
<br />Eleven (11) North,Range Nine (9) West of 6th P.NI.,more particularly described as follows,to -wit:
<br />commencing�at a point 33 feet west of a point 99 feet north of the southeast corner of said
<br />Section 21;running thence north,parallel with the east section line,for a distance of 66 feet;
<br />thence running west,and parallel with the south section line for a distance of 132 feet;thence

<br />three (33),Range Thirty -nine (39) East W.M.Malheur County,Oregon,in name of Emma L.Schmidt;
<br />Lot Forty (40),Block Twenty -two (22),in Oregon Valley Land Company's Addition to Lakeview,
<br />Ore on and north .half of south half of northwest quarter of northeast quarter,Section Fourteen
<br />(14 ,Township Thirty -eight (38)2Range Nineteen (19),East W.11.,Lake County,Oregon;
<br />Lot Fourteen (14),in Block Two Hundred Eighteen (218) in Oregon Valley Land Company's Addition
<br />to Lakeview,in Lake County,Oregon,as shown by recorded plats thereof.
<br />according to the terms and provisions of the last will and testament of such deceased,descends
<br />and is assigned as follows: to Harry Schmidt,Clara Sanders and 1argaret George,son and daughters
<br />of such deceased,in equal shares;the personal property of such deceased remaining after payment
<br />of all just debts,including expenses of last sickness and death of such deceased,and the costs
<br />and expenses of administering her estate,according to the provisions of the will of decedent,
<br />passes to and is assigned in kind to Harry Schmidt,Clara Sanders,and Margaret George,in equal
<br />shares;the final account of such executor is hereby approved,conf irmed and allowed,and upon such
<br />executod filing in this Court the receipts for disbursements enumerated in his'Tlnal report and
<br />the,recipts of the legatees above set out for delivery of their respective shares of the personal
<br />property for distribution,such executor will be discharged fromhis trust as executor of such
<br />estate,and the sureties on his official bond will be released.
