<br />IN THE COUNTY COURT OF HALL COUNTY,NEBRASKA
<br />IN THE MATTER OF THE ESTATE OF )
<br />DECREE DETERUINING HEIRS
<br />WILLIAM H.WEST,deceased )
<br />STATE OF NEBRASKA, COUNTY OF HALL, as.
<br />This Cause coming on to be heard this 28th day of February,1945,the'same being the time fixed
<br />by order of this Court for hearing the petition of Emily E.Hinkson filed herein on February 5,
<br />1945,for determination of the time of the death of said William H.West,a determination of the
<br />heirs of said William H.West,the decree of kinship of said Heirs and the right of descent of the
<br />real estate belonging to said William H.West at the time of his death and barring claims bf
<br />creditors of said deceased,and notice as by law provided and according to order of this Court,
<br />having been given all persons interested in this eatate,both creditors and heirs by publication
<br />and proof thereof being on file,and from the evidence adduced by said petitioner in support of
<br />her petition,the Court finds that William H.West departed this life in Hall County,Nebraska,a
<br />resident thereof,on the 6th day of March,1891,intestate and that John W.West was appointed Admin-
<br />istrator of this estate on April 13,1891,but that these estate proceedings have become dormant
<br />for the failure of said Administrator to file any re;:)ort for more than two years and no .decree
<br />of heirship has been entered in the probate of said estate;the Court further finds that said
<br />William H.West left him surviving his widow Sally A.West and his son Leonard J.West,as his heirs
<br />and only heirs- at- law,and that the following described real estate,to -wit:
<br />South Half of the Northeast quarter (S'JNE4) and the North Half of the Southeast Quarter (NJSE4)
<br />of Section Twenty (20) in Township Twelve (12) North,Range Twelve (12),West of the 6th P.M.in
<br />Hall County,Nebraska.
<br />was owned by said William H.West at the time of his death and passed and descended unto said
<br />Sally A.West and Leonard J.West by operation of law and that they became the owners thereof upon
<br />the death of said William H.West.
<br />The Court further finds that the time has expired for the filing of claims against said estate
<br />and that any claims outstanding against said estate,be and the same are now hereby forever barred
<br />and enjoined from being asserted against said estate or the assets thereof.
<br />IT IS THEREFORE ORDERED,ADJUDGED AND DECREED BY THE COURT that the real estate hereinbefore described
<br />did pass and descend unto Sally A.West and Leonard J.West upon the death of said William H.West,
<br />they being his heirs -at -law and only heirs- at- law,free and clear of the claims of any creditors or
<br />any other persons whomsoever.

<br />WILL AND DECREE
<br />LAST WILL AND TESTAMENT OF MINNIE C.HOAGLAND
<br />I, Minnie C.Hoagland, of the city of Grand Island, Hall County, Nebraska., being of sound mind
<br />and disposing memory, do make and publish this, my last will and testament, in the manner and form
<br />following:
<br />FIRST.
<br />I give, devise, and bequeath to my beloved husband, Ernest Hoagland, all of my property, real
<br />ana personal, for and durin his natural life, he to have the use and income therefrom, and in
<br />the event that the income is not sufficient, then so much of the principal may be used by him
<br />for his necessaries of life.
<br />SECOND.
<br />Upon the death of my husband, Ernest Hoagland, I give to the children of my nephew, Ellis C.
<br />Mohr, my silve -ware, and give to my niece; Viola Culbertson, a set of dishes, and all of the
<br />rest, residue, end remainder of my property, I give, devise and bequeath to my niece Viola
<br />Culbertson, and my nephew, Ellis C.Mohr, share and share alike.
<br />THIRD.
<br />I name, nominate and appoint my husband, Ernest Hoagland, as executor of this, my last will
<br />and testament, and in the event he does not survive me or is incapacitated, then I appoint my
<br />nephew, Ellis C.Mohr, as executor.
