583 <br />No. 8 HALL COUNTY <br />WILL AND DECREE <br />I, Matilda W.Leiser, of Grand Island, Nebraska, being of sound mind and disposing memory, do <br />make aril publish this, my last will and testament, in the manner and form following, that is to say: <br />FIRST. <br />I direct that my just debts, if any, and the expenses attending my burial, be first paid out of <br />my personal estate. <br />SECOND. <br />Subject to the express condition that they, and each of them, shall be without right, power, or <br />authority to sell, incumber, partition, or otherwise alienate the same, or any part thereof, prior <br />to June 2, 1942, I hereby give, and devise to my, beloved children, James M.Dunkel, Anna Dunkel <br />Richardson Sadie Dunkel, and Ruth Dunkel, the east half of the northeast uarter of Section <br />Twelve (12�, in Township Eleven (11) North,Range-Ten (10) West; Lots One and Two (2) in <br />Section Seven (7), the west half of the northwest quarter, and that part of the west half of the <br />southwest quarter, and that part of the southeast quarter of the southwest quarter of Section <br />Eight (8), all in Township Eleven (11)- North,Range Nine (9) West, in Hall _County, Nebraska, and <br />containing in all 262 acres, note owned by me, share & share alike, and in the event either,of my <br />said children should attempt to sell, incumber, partition, or otherwise alienate the above des - <br />cribed real estate, or any part,, prior to June 2, 1942, he or she so violating or attempting to <br />violate the above condition shall forfeit all of his or her right in and to the above described <br />real estate, and the share thus forfeited shall pass to the other of my said children who have <br />not violated or attempted to violate the above conditions. <br />THIRD. <br />I give, devise and bequeath all the rest, residue, and remainder of the estate of which I <br />shall die the "owner to my said children, James M. That on the 1st day of June 1932, said <br />instrument to which this certificate is attached was duly proved, probated and allowed as the last <br />will and testament of the real and personal estate of said Matilda W.Leiser, deceased, and the same <br />%as ordered to be recorded in the records of the Court aforesaid. <br />IN WIT %LESS WFEPEOF I have hereunto set my hand and affixed the seal of the County Court this <br />1st day of June. 1932. <br />(SEAL) <br />Paul N.Kirk, County Judge. <br />IN THE COUNTY COURT OF HALL COUNTY,NEBRASKA <br />In the matter of the estate ) <br />of ) FINAL DECREE. <br />Matilda W.Leiser, deceased. ) <br />Now, on this 31" day of December, 1935, this cause came on for hearing upon the final report <br />of William Buhr, Executor of the last will and testament of Matilda W.Leiser, deceased, <br />The Court, having examined said report and the files in said estate, and being duly advised <br />in the premises, finds that due notice has been given to all persons interested in said estate of <br />the time and place fixed for hearing upon said final report, and no one appearing to object there - <br />to, the Court finds said report is true and correct in all things, and ought to be approved and <br />allowed as the final report of said Executor. <br />The Court finds that Matilda W.Leiser died on the 28th day of April, 1932, and at the time of <br />her death was a resident and inhabitant of Hall County, Nebraska. <br />The Court finds that a petition praying for the allowance and probate of an instrument pur- <br />vorting to be the last will and testament of Matilda W.Leiser, deceased, was filed herein, and <br />the 31st days of May, 1932, was fixed for the time of hearing thereon; that due notice was given <br />as provided by law, and on said date, May 31, 1932, said instrument was duly proven, allowed, and <br />admitted to probate in this Court, as and for the last will and testament of Matilda W.Leiser, <br />deceased, and letters teatamentary were duly issued thereon to Ralph R.Horth, Executor, that <br />said Ralph R.Horth, departed this life on the 22d day of September, 19342 and letters testamentary <br />were issued to William Buhr, named in said will, as executor, and he thereupon duly qualified as <br />such. <br />
