579 <br />Nebraska, intestate gnd at the time of her death she was a resident of Hall County, Nebraskat <br />SECOND <br />That on the 25th day of June, 1935, Joseph B.Smith, widower of said Ada A.Smith, deceased, <br />filed in this Court a petition praying for the appointment of said Joseph B.Smith as Administrator <br />of the estate of said deceased, and on the 25th day of June, 1935; an order of this Court was made <br />therein assigning the 16th day of July, 1935, at 10 o'clock A.M. at the County Court Room in said <br />County as the time and place for hearing said petition, and ordering that notice of the pendency <br />of said petition and hearing thereon be given to all persons interested in said matter by publish- <br />ing said notice in the Grand Island Independent, a legal newspaper printed in said County, for three <br />successive weeks prior to said day of hearing, and it appears by proof on file that notice of said <br />order was given as ordered by this Court. <br />THIRD. <br />The Court further finds that Ernest L.Walker was, upon his giving bond in the sum of $250.00, as <br />ordered by this Court, appointed Administrator of said estate; the Court further finds that the <br />deceased at the time of her death, was married and that she left the following heirs -at -law: Joseph <br />B.Smith, her widower, Lola M.Walker, a daughter, and Ralph Bootman, a son, all over the age . of 21 <br />years. <br />FOURTH <br />That on the 16th day of July, 1935, an order was made herein allowing creditors three months <br />from and after the 14th day of August, 1935, in which to file their claims against said estate <br />and said Administrator one -year in which to settle said estate, and further ordering that a <br />.notice to creditors be published in -the Grand Island Independent, a legal newspaper published and <br />.circulating in Hall County, Nebraska, for three successive weeks prior to said 14th day of Aug }st, <br />1935, and that a hearing on claims filed against said estate would be held at the office of the <br />County Judge of Hall County,,Nebraska, on the 14th day of October, 1935, at 9 o'clock A.M. and it <br />appears by proof on file that notice of said order was published as ordered by this Court. <br />FIFTH. <br />The Court further -finds that on the 18th day of July, 1935, said Ernest L.Walker as Administrator <br />filed in Court his inventory of the property of said estate, and that according to said inventory, <br />the deceased died seized and possessed of the following described property, to -wit: <br />Lot Ten (10) in Block Thirty -two (32.) of Russel Wheeler's Addition to Grand Island,Hall County, <br />Nebraska, <br />and chattel property of the value of $45.00 <br />SIXTH. <br />The Court further finds that according to the laws.of descent and distribution, said property <br />descends as follows: an undivided 1/4 interest to Jos ph B.Smith, he not being the father of the <br />children of said Ada A.Smith, deceased, an undivided 3%� interest to Lola M.Walker and an undivided <br />3/9 interest to Ralph Bootman. <br />SEVENTH. <br />The Court further finds that on the 16th day of July, 1935, George E.Mickel was appointed <br />appraiser for inheritance tax purposes in' said estate, that he took his oath and after notice <br />of hearing as by law required, on October 7, 1935, filed his report as such appraiser, finding <br />the gross value of said estate of $2,045:00 <br />EIGHTH. <br />The Court further finds that all debts and claims against said estate, including the cost of <br />administration in said estate, have been paid and that there remains in the hands of said Adminis- <br />rator for distribution, no assets whatsoever. <br />NINTH. <br />The Court further finds that after deducting from the assets of said estate, all debts, claims, <br />costs of administration and all other proper expenditures and the statutory exemptions allowed the <br />heirs -at -law in said estate, there is due and payable to the County Treasurer of Hall County, <br />Nebraska, no inheritance tax whatsoever. <br />TENTH. <br />The Court further finds that the time has expired for filing claims herein and that any claims <br />outstanding not filed against this estate as by law required, are hereby barred and enjoined from <br />being asserted against the assets of this estate. <br />IT IS THEREFORE O'DERED, ADJUDGED AND DECREED BY THE COURT that the final report of Ernest L. <br />Walker, Administrator herein, be and the same hereby is approved and allowed as such; further that <br />Joseph B.Smith, Lola M.Walker and Ralph Bootman are all and the only heirs -at -law of said deceased, <br />and that the property described in paragraph Fifth hereof, descends according to the laws of <br />descent and distribution of the laws of the State of Nebraska, as found in paragraph Sixth of this <br />decree; further that all debts, claims, expenses of the last illness and burial of said decedent <br />and costs of administration herein, have been fully paid and receipts filed herein showing such <br />payment;
