<br />COUNTY OF HALL ) ' At a session of the County Court held in and for said County of Hall,
<br />State of Nebraska, this 24th day of January, 1945
<br />Present: Charles Bossert, County Judge.
<br />BE IT REMEMBERED: That on the 29th day of December, 1944, Herbert F.Mayer, Administrator of the
<br />Estate of Johanna Schultz, deceased, filed in this Court his final account as such Ad.ministrat.or
<br />and a petition praying that said account be allowed, for a decree of heirship, an order of distribu-
<br />tion, a final settlement thereon and discharge.
<br />For these purposes, the 24th day of January, 1945, at 10 o'clock A.M. at the Couftty Court Room
<br />In said county, was assigned as the time and place for hearing said petition, examining and allow -
<br />ing said account; and it was ordered that notice of the pendency of said petition be given to all
<br />persons interested in said estate,by publishing such notice in the Grand Island Independent, a
<br />legal newspaper printed in said County, for three weeks prior to said day of hearing; and it appears
<br />by proof on file that said notice was given as, ordered by Court and that no objections to said final
<br />account have been made or filed.
<br />Upon examination of the record and the evidence in this matter and being duly advised in the
<br />premises, the Court finds as follows:
<br />FIRST.
<br />inglrJ nna Schultz departed this life on the 24th day of July, 1944, 'rahile temporarily visit -
<br />Ma.L.Mendenhall at Sacramento; California, intestate, and at the time of her death, she
<br />was a resident of Hall County, Nebraska.
<br />SECOND.
<br />That on the 5th day of August, 1944, Martha A.L.Mendenhall, daughter of said Johanna Schultz,
<br />deceased, filed in this Court a petition praying for the appointment of Herbert F.Mayer as Adminis-
<br />trator of the estate of said deceased, and on the 5th day of August, 1944, an order of this Court
<br />was made therein, assigning the 30th day of August, 1944, at 10 o'clock A.M. at the County Court
<br />Room in said County as the time and place for hearing said petition, and or that notice of
<br />the pendency of said petition and hearing thereon be given to all persons interested in said cause
<br />by publishing said notice in the Grand Island Independent, a legal newspaper printed in said
<br />County, for three successive weeks prior to said day of hearing, and it appears by proof on file
<br />that notice of said order was given as ordered by this Court.
<br />THIRD.
<br />The Court further finds that Herbert F.Mayer, named in said petition, was, upon his giving bond
<br />in the sum of $200.00 as ordered by this Court, a pointed Administrator as- prayed; the Court fur-
<br />ther finds that the deceased, at the time of her eath, was a widow, and that she left the follow-
<br />ing heirs -at -law:
<br />Fred Beal, a son
<br />Carl Schultz, a son
<br />Martha A.L.Mendenhall, a daughter
<br />and the following children of a predeceased son Ernest Schultz, to -wit:
<br />Emiel Schultz, a grandson
<br />Edward Schultz, a grandson
<br />Donald Schultz, a grandson
<br />Violet Sunday, a granddaughter
<br />Evelyn Schultz, a granddaughter
<br />Aileen Mueller, a granddaughter
<br />all over the age of 21 years.
<br />FOURTH.
<br />That on the 30th day of August, 1944, an order was made herein allowing creditors three months
<br />from and after the 27th day of September, 1944, in which to file their claims against said estate,
<br />and said Administrator one year in which to settle said estate, and further ordering that a notice
<br />to creditors be published in the Grand Island Independent, a legal newspaper published and circu-
<br />lating in Hall County, Nebraska, for three successive weeks prior to the 27th day of September,
<br />1944, that a hearing on claims filed against said estate would be held at the office of the County
<br />Judge of Hall County, Nebraska, on the 29th day of December, 1944, at 9 o'clock A.M., and it appears
<br />by proof on file that notice of said order was published as ordered by this Court.
<br />FIFTH.
<br />The Court further finds that on the 30th day of August, 1944, said Herbert F.Mayer as Adminis-
<br />trator, filed in Court, his inventory of the property of said estate, and that according to said
<br />inventory the deceased died seized and possessed of the following described property, to -wit:
<br />Lot Nine (9) in Block Eleven (11) of Bonnie Brae Addition to the City of Grand Island,
<br />Nebraska.
<br />An undivided one -half interest in Lot Ten (10) in Block Eleven (11) of Bonnie Brae Addition
<br />to the City of Grand Island, Nebraska.
<br />SIXTH.
<br />The Court finds that according to the laws of descent and distribution, said property descends
<br />as follows: An undivided 1/4 share to each of the following: Fred Beal, Carl Schultz and Martha
<br />A.L.Mendenhall, and an undivided 1/24 share is each of the following: Emiel Schultz, Edward Schultz,
<br />`Zonal:d SohulU, Violet Sunday,' Evelyn Schultz . and Aileen Mueller.
<br />SEVENTH.
<br />The Court further finds that on the 29th day of December, 1944, an order of this Court was
<br />made barring all claims not filed against said estate; the Court further finds that all debts and
<br />claims against said estate, including the expense's of the last illness and burial of said Johanna
<br />Schultz,deceased, have been fully paid and that the costs of administration of said estate have
<br />teen fully paid excepting the sum of $33.12 due Herbert F.Mayer as the unpaid balance of his
<br />attorney Is fees as attorney for this estate, and that there remains no funds in his hands for
<br />payment thereof and that the same constitutes a lien against the real estate belonging to this
<br />
