<br />and further ordering that notice to creditors be published in the Grand Island Independent, a legal
<br />newspaper published and circulating in Hall County, Nebraska, for three successive weeks prior to the
<br />23rd day of February, 1944, and that a hearinZ on claims filed against said estate would be held at
<br />the office of the County Judge of Hall County, Nebraska, on the 26th day of May, 1944, at 9 o'clock
<br />A.M. and it appears by proof on file that notice of said order was published as ordered by this
<br />Court.
<br />FIFTH.
<br />The Court further finds that on the 26th day of February, 1944, said H.P.Zieg, Administrator
<br />of said estate, filed in this Court his inventory of the property of said estate, and that accord-
<br />ing to said inventory, the deceased died seized and possessed of the following described property,
<br />to -wit:
<br />An undivided one -tenth interest in the following:
<br />Fractional Lot One (1) in Block Ten (10) of Kernohan & Decker's Addition, and Fractional Lot One
<br />(1) in Block Four (4) of Spaulding & Gregg "s Addition to Grand Island,Hall County, Nebraska;
<br />The Southeast Quarter (SE4) of Section 26 and the North Half of the Northeast Quarter (N2NE4) of
<br />Section 35 and the North Half of the Northwest Quarter (N�NW4) of Section 36, all in Township 10
<br />North,Range 9, West of the 6th P.M.;
<br />The Southwest Quarter (SW-41) of Section 6 in Township 9 North,Range 8, West of the 6th P.M. in
<br />Hamilton County, Nebraska.
<br />Promissory notes, household furniture, accrued farm rents and cash on hand as specifically set
<br />forth in said Inventory.
<br />The Court further finds that according to the terms and conditions and provisions of said Last
<br />Will and Testament and Codicil of said deceased, the sum of $10.00 was bequeathed to Bertha Neu -
<br />halfen, and the rest, residue and remainder of said estate was devised and bequeathed share and
<br />share alike to August Happold, Henry Happold, Christian Happold, Carl Happold, Paul Happold, Anna
<br />Schmidt, Minnie Cutshau, Marie Southall and Louise Happold, share and share alike, in fee simple
<br />absolute, excepting for the fact that said Christian J.Happold, prior to the death of said Lena
<br />Happold, released, relinquished and quit claimed all of his interest in and to said property in
<br />writing unto August Happold, Henry Happold, Carl Happold, Paul Happold, Anna Schmidt, Minnie
<br />Cutshaw, Marie Southall and Louise Happold, in settlement of his indebtedness to his mother at
<br />that time.
<br />SIXTH.
<br />The Court further finds that on the 26th day of May, 1944, an order of this Court was made
<br />allowing certain claims against said estate and barring the filing of any and all other claims
<br />against said estate and excluding the holders thereof from setting up or asserting the same against

<br />said estate or any part thereof.
<br />SEVENTH
<br />The Court further finds that all claims allowed against said estate, including the costs of
<br />administration hereof, have been fully paid by said Administrator and the final report is correct in
<br />all respects and should be approved and allowed; and tizat there remained in his hands the sum of
<br />$4,863.74 which sum, according to the terms and provisions of said Last Will and Testament and
<br />Codicil thereto and settlement made with said Christian J.Happold hereinbefore referred to, is
<br />payable unto August Happold and First Securities Corporation of Aurora, his assignee, Henry Happold,
<br />Carl Hap )old also known as C.A.Hap_�old, Paul Happold, Anna Schmidt, Minnie Cutshaw, Marie Southall
<br />and Louise Happold, and that there is due and payable to the County Treasurers of Hall County, Ne-
<br />braska, and Hamilton County, Nebraska, no inheritance tax herein whatsoever; that disbursement has
<br />been made by said Administrator as herein provided and receipts filed by him herein showing such
<br />disbursement.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of H.P.Zieg,
<br />Administrator herin,be and the same is hereby approved and allowed; that Henry Happold and Henry
<br />G.Happold are one and the same persons; that Carl Happold C.A.Happold and Karl Happold are one and
<br />the same persons; that Christian Happold and Christian J.Aappold are one and the same persons; that
<br />Minnie Cutshaw, also known as Minna Cutshaw and also known as Minnie Cutshau, are one and the same
<br />persons, irrespective of the discrepency in the spelling of said names; that Marie Southall was
<br />Marie Happold prior to her marriage, and that all of them are over the age of 21 years; that the
<br />property described in paragraph Fifth hereof was devised and bequeathed accordin to the terms
<br />and conditions of said Last Will and Testament and Codicil thereto, as follows: 10.00 was bequeathed unto said Bertha Neuhalfen and the balance unto said August Happold, Henry Happold, Louise
<br />Happold., Minnie Cutshaw, Anna Schmidt, Karl Happol(f.., Paul Happold, Marie Southall, share and share
<br />alike, and that said Christian J.Happold released, relinquished and quit claimed all of his in-
<br />terest in and to said property in writing unto August Happold, Henry Happold, Carl Happold, Paul
<br />Happold., Anna Schmidt, Minnie Cutshaw, Marie Southall and. Louise Happold, and accordingly had no
<br />interest whatsoever in this estate and the property thereof; that said Administrator has fully
<br />distributed said estate according to said Will and has filed receipts with this Court showing such
<br />distribution, and he therefore is hereby discharged herein, his bond released, and said estate fully
<br />administered, settled and closed.
