<br />The Court further finds that said Harold McGuire, deceased, at the time of his death was the
<br />owner of a one -tenth interest in the following real estate:
<br />A one -half interest in the southwest quarter of Section Ten (10), Township Ten (10),Range
<br />Twelve (12) West of 6th P.M., in Jackson Township, Hall County, Nebraska,
<br />A purchase contract from S.T.Grohosky in the amount of $4000.00 for Section 33, the north
<br />half, and tle north half of the south half, of Section 32, all in Township 20, Range 11 West
<br />of 6th P.M., in Greeley County, Nebraska,
<br />A purchase contract from the Federal Land Bank of Omaha for the northeast quarter of Section
<br />15, Township 10 North,Range 12 West of 6th P.M., the southeast quarter of Section 10, Township
<br />10, Range 12 West of 6th P.M., all in Hall County, Nebraska.
<br />The Court further finds that Harold McGuire left surviving him, as his sole and only heirs at
<br />law, the following: Roger McGuire, a brother; Carl McGuire, a brother; Paul McGuire, a brother,
<br />and Eileen Williams, a sister, and the interest in real estate hereinbefore described passed and
<br />descended under the laws of descent of the state of Nebraska, to the aforesaid heirs at law, share
<br />and share alike.
<br />The Court further finds that according to the final report filed herein, that in the estate of
<br />Allen McGuire, deceased, certain sum of money was withheld for the purpose of possible tax ad-
<br />justments; that when said``fatters have been completed there will be a small amount coming to the
<br />estate of Harold McGuire for distribution.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of Carl McGuire,
<br />administrator, be, and the same hereby is approved and allowed as and for his final report to the
<br />date hereof, aid said estate, to the date hereof, is hereby settled and closed, and that when said
<br />final distribution has been made in the estate of Allen McGuire,deceased, this administrator will
<br />be required to make distribution herein.

<br />BE IT RE',IEMBERED that on the 15th day of December ,1944,H.P.Zieg,Administrator With Will and
<br />Codicil thereto annexed,of the estate of Lena Happold,deceased,filed in this Court his final
<br />account as such Administrator and a petition praying that said account be allowed,for decree of
<br />hetrship,an order of distribution,a final settlement thereon and discharge.

<br />For these purposes,the 10th day of January,1945,at 10 o'clock A.M. atthe County Court Room in said
<br />County was assigned as the time and place for hearing said Petition,examining and allowing said
<br />account;and it was ordered that notice of the pendency of said petition be given to all persons
<br />interested in said estate by publishing such notice in the Grand Island Independent,a legal news -
<br />paper printed in said County,for three weeks prior to said day of hearing;and it appears by proof
<br />on file that said notice was given as ordered by Court and that no objections to said final
<br />account have been made or filed.
<br />Upon examination of the records and the evidence in this matter and being duly advised in the prem-

<br />That Lena Happold,also known as Lina Happold,departed this life on the 28th day of December,,1943,
<br />in Hall County,Nebraska,testate,and at the time of her death she was a resident of Hall County,
<br />Nebraska. SECOND
<br />That on the 4th day of January,1944,Henry Happold and John Schmidt filed in this Court instruments
<br />purporting to be the Last Will and Testament and Codicil thereto of said Lena Happold,deceased.
<br />wherein said petitioners were named Executors,arid a petition offering said Will for probate,
<br />alleging that said Lena Happold departed this life on December 28,1913,in Hall County,Nebraska
<br />and on the 4th day of January,1944,an order of this Court was made therein assigning the 27th day
<br />of January,1944,at 10 o'clock A.M. in the County Court Room in said County,as the %ime and place
<br />for hearing said petition,proving said Will and Codicil and admitting the same to probate and
<br />orderdhga° that notice of the pendency of said petition and hearing thereon be given to all per-
<br />sons interested in said matter by publishing said notice in the Grand Island Independent,a legal
