No. 76, <br />Camp McCoy, Wisconsin. <br />And it appearing to the Court that each and all of the aforesaid heirs -at -law and legatees, <br />devisees and distributees of the estate of said decedent have been notified of the pendency of <br />this proceeding in the manner and for the length of time required by law. It is therefore ordered <br />by the Court that said proof be and the same is hereby approved. <br />And it further appearing to the Court that the above named Dianne Ruth Clark is a minor an <br />that the above named Wayne Clayton Clark is in the military service of the United States. <br />IT IS THEREFORE ORDERED AND ADJUDGED BY THE COURT That Merville L.Brown is hereby appointed <br />attorney for said Wayne Clayton Clark, and Merville L.Brown be and he is hereby appointed <br />Guardian ad litem for said minor, to appear for them, and defend their interests herein. And now <br />comes Merville L.Brown attorney for said Wayne Clayton Clark and Merville L.Brown Guardian ad <br />litem for said above named minor; said being attorney at law practicing at the bar of this Court, <br />.and all being of said adult parties except said petitioner herein, having been duly notified as <br />aforesaid, being now on motion of said petitioner and by order of the Court each three times <br />solemnly called in open Court, come not, nor comes any one for them, or either of them, but herein <br />they and each of them fail and make default. and as to said Wayne Clayton Clark, in the military <br />service of the United States it is ordered that judgment be entered herein without bond. <br />And this cause now comes on for hearing, for proof of the execution of the instrument in <br />writing purporting to the Last Will of W.Clayton Clark deceased, filed for probate in this Court <br />on the Fourth day of October A.D. 1943. <br />Now come Bertha Stein and Josephine Washburn subscribing witnesses to the aforesaid instrument <br />in writing, who being duly sworn, each testify to the due execution of said instrument by the said <br />W.Clayton Clark now deceared, in their presence, and to their attestation thereof in the presence <br />of said decedent, on the day of the date thereof as and for the Last Will of the said W.Clayton <br />Clark deceased, and that at the time of the execution of said instrument as they believe, said <br />Testator was of sound mind and memory, of lawful age, and under no constraint. <br />And the Court, being now fully advised in the premises, finds said instrument to be, and the <br />same is hereby declared to be duly and sufficiently proven to admit the same to record. <br />And it is thereupon ordered and adjudged by the Court that said instrument be and the same is <br />hereby admitted to probate and record in this Court, and that the Clerk of this Court record the <br />same, together with the probate thereof, as the true Last Will of said Clayton Clark deceased. <br />IT IS FURTHER ORDFRFD.BY THE COURT That Merville L.Brown Guardian ad litem, as aforesaid, be <br />and he is hereby allowed the sum of Five ($5.00) Dollars for his services herein. and that <br />Merville L.Brown, attorney for said Wayne Clayton Clark, as aforesaid, be and he is hereby allowed <br />the sum of Five ($5.00) Dollars for his services herein. <br />Horace R.
