556 <br />THEAUGUSTINECO. 20112.2.41 <br />in the premises finds that due and legal notice has been given to all persons of the time and place <br />fixed by the Court for the hearing upon said reportp and further finds that said report is true and <br />correct in all things, and that the same ought to be approved and allowed as and for the Final Report <br />of said Executrix, said estate settled and closed and said Executrix discharged. <br />The Court further finds that the said Charles Thesenvitz departed this life on the 13th day of <br />May, 1944, and that at the time of his death he was a resident and inhabitant of Hall County, Nebraska, <br />that he left surviving him as his heirs -at -law and only heirs -at -law, his wife, Emma Thesenvitz; <br />and four children, they being, Ruby Irvine, Elmer Thesenvitz, Olive Thesenvitz and Glen Thesenvitz; <br />that he left a. Last Will and Testament which was by the consideration of this Court duly proven, <br />allowed and admitted to probate on the 21st day of June, 1944 and Letters Testamentary were duly <br />issued by this Court to the said Emma Thesenvitz on the Estate of Charles Thesenvitz, deceased. <br />The Court further finds that due and legal notice has been given to all persons of the time and <br />place fixed by the Court for filing claims against the estate of the deceased, and that the time <br />so fixed has fully expired, and that all persons having claims against said estate and not filed <br />within the time limited by the Court are forever barred and excluded from setting up or asserting <br />any such claim against said estate. <br />The Court further finds that the Executrix has paid the funeral expenses of said deceased, all <br />debts against said estate and the costs of these proceedings and has made proper distribution of the <br />personal property in said estate of the deceased as provided under the Will and nothing further <br />remains in the hands of the Executrix belonging to said estate. <br />The Court further finds that the estate is not subject to an inheritance tax under the laws <br />of the State of Nebraska or to a Federal Estate Tax under the laws of the United States. <br />The Court further finds that at the time of his death the said Charles Thesenvitz was the <br />owner of an interest in real estate described as the South Half of the Southeast Quarter (SOEU <br />of Section Twenty -eight (28), Township Eleven (11), North, Range Eleven (11), West of the 6th <br />P.M.
