<br />WILL AND DECREE
<br />LAST WILL AND TESTAMENT OF JAMES CARR
<br />I
<br />KNOW ALL MEN BY 1HESE PRESENTS: That I, James Carr of Grand Island, Nebraska, being of sound
<br />mind and disposing memory, do make, publish and declare this my last will and testament.
<br />1. I direct that all my just debts, funeral expenses and expenses of my last sickness be first
<br />paid by my exexutor hereinafter named.
<br />2. I give, devise and bequeath to the Diocese of Grand Island for the benefit of St. Mary's
<br />Cathedral of Grand Island, Nebraska, the sum of One Hundred ($100.00) Dollars.
<br />3. I give, devise and bequeath unto the Pastor of St. Mary's Church of Grand Island, Nebraska,
<br />the sum of One Hundred ($100.00) Dollars and request the same be used for masses for the repose
<br />of my soul.
<br />4. I direct that, all the rest, residue and remainder of my property, whether real, personal
<br />or mixed, shall be divided equally between my nieces:Margaret McGinley of Chicago, Illinois, Ellen
<br />Carr, Indianapolis, I,ndi'ana and. my nephew, Harry Carr of Indianapolis, Indiana, share and share
<br />alike, each to receive an undivided one -third interest in said residue.

<br />I name, nominate and appoint B.J.Cunningham, of Grand Island, Nebraska, Executor of this,
<br />my Last Will and Testament. I further authorize my said Executor to sell and convey -:all property
<br />which I may own at the time of my death, ; whethe.r real or personal, without-application-to or
<br />authority from any Court whatsoever and to pay the bequests herein above set forth and to divide
<br />the residue equally between my neices and nephew as hereinbefore set forth.
<br />6. I hereby revoke any and all former wills by me made.
<br />IN WITNESS WHEREOF, I have hereunto signed the foregoing instrument consisting of one page of
<br />typewritten matter, this first day of June, A.D. 1932, at Grand Island, Hall County, Nebraska.

<br />We, whose names are hereto subscribed, do hereby certify that James Carr, the Testator, signed
<br />his name to the foregoing instrument in our presence and in the presence of each of us and he at
<br />the same time declared the said instrument to be his Last Will and Testament, and we, at his re-
<br />quest, and in his presence, did sign our names hereto as attesting witnesses.

<br />Grand Island, in said County, on the 19th day of April A.D., 1933
<br />In the Matter of the estate Present Paul N. Kirk County Judge

<br />James Carr, Deceased
<br />I, Paul N. Kirk, Judge of the County Court, in and for said County, hereby certify that
<br />on the 28th day of March 1933, the instrument purporting to be the last will and testament of
<br />James Carr deceased, was filed for probate in this Court. That on the 19th d of April 1933
<br />said instrument to which this certificate is attached was duly proved, probate and allowed as the
<br />last will and testament of the real and personal estate of said James Carr deceased, and the same
<br />was ordered to be recorded in the records of the Court aforesaid.
<br />IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the County Court, this

<br />In the Matter of the Estate I
<br />of FINAL DECREE
<br />JAMES CARR, Deceased
<br />Now on this 29th day of November, 1944, this cause came on for hearing upon the Final Report
<br />of B.J.Cunningham, executor of the estate of James Carr, deceased, following due notice to all
<br />persons interested therein by publication, of the filing of said Report, and of the time fixed for
<br />the settlement of said estate, and no one appeared to object or protest the allowance of said Report.
<br />Upon examination thereof, the Court finds that said Report is correct and ought to be allowed;
<br />that the executor has accounted for all of said estate coming into his hands or under his control
<br />and has paid all of the claims filed and allowed against said estate; that the legacies provided
<br />for in said Will have been paid and the court costs and the cost of this proceeding have been
<br />paid by the executor.
<br />The Court further finds that the said James Carr departed this life on the 24th day of March,
<br />1933, being at the time of his death a resident and inhabitant of Hall County, Nebraska; that he
<br />left a Last Will and Testament, which was duly approved, allowed, and admitted to probate in this
<br />Court on the 19th day of April, 1933•
<br />The Court further finds that due notice was given to all creditors of said deceased as to the
<br />time allowed and the place appointed for the filing of claims against said estate by publication
<br />
