<br />COUNTY OF HAMILTON ) At a session of the Count- Court held in and for said County of
<br />Hamilton, State of Nebraska, this 18th day of November, 1944,
<br />Present: Ivan M.Bengtson, County Judge.
<br />BE IT RE!4EMBERED: That on the 20th day of October, 19414 -, Ernest G. Kroger, Executor of the
<br />Estate of Mary Kroger Reeb, deceased, filed in this Court his final account as such Executor and
<br />a petition praying that said account be allowed, for a decree of heirship, an order of distri-
<br />bution, a final settlement thereon and discharge.
<br />For these purposes, the 16th day of November, 1944, at 2 o'clock P.M. at the County Court
<br />Room in said County, was assi6ned as the time and place for hearing said petition, examining and
<br />allowing said account; and it was ordered that notice of the pendency of said petition be given
<br />to all persons interested in said estate by publishing such notice in the Aurora News - Register,
<br />a legal newspaper printed in said County for three weeks prior to said day of hearing; and it
<br />appears by proof on file that soid notice was given as ordered by Court and that no objections to
<br />said report have been made or filed.
<br />Upon examination of the record and the evidence in this matter and being duly advised in the
<br />premises, the Court finds as follows:
<br />FIRST
<br />That Mary Kroger Reeb departed this life on the 18th day of April, 1944, at her home in
<br />Hamilton County, Nebraska, testate and at the time of her death she was a resident of Hamilton
<br />County, Nebraska.
<br />SECOND

<br />The Court . further finds that on the 20th day of May, 1944, an order of this Court was made
<br />allowing creditors three months from and after the 9th day of June, 1944, in which to file their
<br />claims aga rest said estate and the said Executor one year in which to settle said estate, and
<br />further ordering that notice to creditors be published in the Aurora News - Register, a legal news-
<br />paper published and circulating in Hamilton County, Nebraska, for three successive weeks prior to
<br />the 9th day of June, 1944, and that a hearing on claims filed against said estate would be held. at
<br />That on the 25th day of April, 1944, Ernest-G.Kroger filed in this Court an instrument pur-
<br />porting to be the Last Will and Testament of said .Nary Kroger Reeb, deceased, wherein said
<br />petitioner was named Executor, and a ;petition offering said Will for probate, alleging that said
<br />Mary Kroger Reeb departed this life on the 18th day of April, 1944, in Hamilton County, Nebraska,
<br />and on the 25th day of April, 1944, an order of this Court was made therein assigning the 20th
<br />dry of May, 1944, at 3 o'clock P.M. in the County Court Room in said County, as the time and
<br />place for hearing said petition, proving said Will and admitting the same to probate and ordering
<br />that notice of the pendency of said petition and hearing thereon be given to all persons
<br />interested in said matter, by publishing said notice in the Aurora News- - Register, a legal news-
<br />paper printed in said County, once each week for three successive weeks prior to said day of
<br />hearing, and it appears by proof on file that notice of said order was so given.
<br />THIRD
<br />The Court further finds that on the 20th day of May, 1944, said instrument was proven, allowed
<br />and admitted to probate as the Last Will and Testament of said Mary>Kroger Reeb, deceased, and said
<br />Ernest G.Kroger, named in said Will, was appointed Executor thereof upon his furnishing bond in
<br />the sum of ,000 /00 as ordered by this Court, which bond was furnished and approved; the Court
<br />further finds that the said Mary Kroger Reeb, at the time of her death, was a widow and that she
<br />left the following heirs- at- la.tnr and only heirs-at-law, to -wit: Ida Wurtz, a daughter, William J.
<br />Kroger, a son, Ernest G. Kroo-er, a son, Adolph T. Kroger, a son, Lillian Branting, a daughter, and
<br />May Lindgren, a daughter, all of whom are over the age of 21 years.
<br />FOURTH
<br />The Court . further finds that on the 20th day of May, 1944, an order of this Court was made
