<br />COUNTY OF HALL ) At a session of the County Court held in and for said County of Hall,
<br />State of Nebraska, this 8th day of November, 1944, present: Charles
<br />Bossert, County Judge.
<br />BE IT REME11BERED that on the 13th day of October, 1944, Ernest W.Augustine, Administrator of
<br />the Estate of Alice T.Augustine, Deceased, filed in this Court his final account as such
<br />Administrator and a petition praying that said account be allowed, for a decree of heirship, an
<br />order of distribution, a final settlement thereon and discharge.
<br />For these purposes the 8th day of November, 1944, at 10 o'clock A.M. at the County Court Room
<br />in said County was assigned as the time and place for hearing said petition, examining and
<br />allowing said account, and it was ordered that notice of the pendency of said petition be given
<br />to all persons interested in said estate by publishing such notice in the Grand Island Independent,
<br />a legal newspaper printed in said County, for three weeks prior to said day of hearing; and it
<br />appears by proof on file that said notice was given as ordered by Court and that no objections to
<br />said final account have been made or filed.
<br />Upon examination of the record and the evidence in this matter and being duly advised in the
<br />premises, the Court finds as follows:
<br />FIRST
<br />That Alice T.Augustine departed this life on the 21st day of December, 1943, at her home in
<br />Grand Island, Hall. County, Nebraska, intestate, a widow, and at the time of her death she was a
<br />resident of Hall County, Nebraska.

<br />That on the 29th day of February, 1941x, Irving D.Augustine, a son of said Alice T.Augustine,
<br />deceased, filed in this Court a petition praying for the appointment of said Ernest W.Augustine
<br />as Administrator of the estate of said deceased, and on the 29th da� of February, 1944, an order
<br />of this Court was made therein assigning the 24th day of March, 194-1-, at 10 o'clock A.M. at the
<br />County Court Room in said County, as the time and place for hearing said petition and ordering
<br />that notice of the pendency of said petition and hearing thereon be given to all persons interested
<br />in said matter by publishing said notice in the Grand Island Independent, a legal newspaper printed
<br />in said county, for three successive weeks prior to said day of hearing, and it appears by proof
<br />on file that notice of said order was given as ordered by this Court.
<br />THIRD
<br />The Court further finds that Ernest W.Augustine named in said petition, was, upon his giving
<br />bond in the sum of $35,000.00, as ordered by this Court, appointed Administrator as prayed; the
<br />Court further finds that the deceased at the time of her death, was a widow and that she left the
<br />following heirs -at -law: Ernest W.Augustine, a son, Irving D. Augustine, a son, Howard Lynn
<br />Augustine, a grandson of the age of 18 years, and Ann Margaret Augustine, a granddaughter of the
<br />age of 14 years, said grandchildren being the only children of Howard M. Augustine, a predeceased
<br />son of said Alice T.Augustine, deceased.
<br />FOURTH
<br />That on the 24th day of March, 1944, an order was made herein allowing creditors three months
<br />from and after the 19th day of April, 191L, in which to file their claims against said estate and
<br />said Administrator one year in which to settle said estate, and further ordering that a notice
<br />to creditors be published in the Grand Island Independent, a legal newspaper printed and circulat-
<br />ing in Hall County, Nebraska, for three successive weeks prior to the 19th day of April, 1944,
<br />and that a hearing on claims filed against said estate would be held at the office of the County
<br />Judge of Hall County, Nebraska., on July 21, 1944, at 9 o'clock A.M. and it appears from proof on
<br />file that notice of said order was published as ordered by this Court.
<br />FIFTH
<br />The Court further finds that on the 31st day of May, 1911 -11, said Ernest W.Augustine as
<br />Administrator, filed in Court his inventory of the property of said estate, and that according to
<br />said inventory, the deceased died seized and nossessed of the following described property,to -wit:
<br />An undivided one -half interest in Lot Six (6) in Block Twelve (12) of Kernohan and Decker's
<br />Addition to the City of Grand Island, Nebraska
<br />Miscellaneous personal property of the value of $33,272.12
<br />SIXTH
<br />The Court further finds that according to the laws of descent and distribution, said property
<br />descends as follows: An undivided one -third share thereof to Ernest W.Augustine, an undivided
<br />one -third share thereof to Irving D. Augustine, an undivided one -sixth share thereof to Howard
<br />Lynn Augustine and an undivided one -sixth share thereof to Ann Margaret Augustine.
<br />SEVENTH
<br />The Court further finds that on the 31st day of July, 1944, S. J. Shada was appointed
<br />appraiser for inheritance tax purposes in said estate, and that he took his oath and after due
<br />notice and hearing as by law required, on September 13, 1944, filed his report as such a praiser
<br />finding the net value of said estate at $34,587-13 and on the 13th day of September, 194 , this
<br />Court entered an order assessing an inheritance tax in this estate payable to the County Treasurer
<br />of Hall County, Nebraska, in the sum of $30.11, which tax has been fully paid, receipt for which
<br />is on file with this Court herein.
<br />EIGHTH
<br />The Court further finds that on the 21st day of July, 1911 -4, an order of this Court was made
<br />barring all claims not filed against said estate; the Court further finds that all debts and
