<br />Now, on this 26th day of October, 1944, this cause came on for hearing upon the final report
<br />of Margaret Sagesser, administratrix, and the Court, having examined the records and files and
<br />being fully advised, finds that due and legal notice has been given to all persons interested in
<br />said estate, of the time and place fixed for hearing upon said report, as ordered by the Court,
<br />said hearing having been continued from the 16th day of August, 1944,
<br />The Court, having examined said report, together with all other files and the testimony in
<br />support thereof, finds that said report is true and correct in all things and ought to be allowed
<br />and approved as and for the final report of said administrator.
<br />The Court finds that said Albert Sagesser, deceased, departed this life on the 6th day of
<br />February, 1938, and that he was, at the time of his death, a resident and inhabitant of Hall
<br />County, Nebraska.
<br />That on the 9th day of February, 1938, a petition was filed for the appointment of an
<br />administrator, that after due,notice, as by law provided, Margaret Sagesser was appointed admini-
<br />stratrix, and that she duly qualified as such, and is now the qualified and acting administratrix
<br />of said estate.
<br />The Court finds that said Albert Sagesser at the time of his death was the owner of the
<br />following described real estate, to -wit:
<br />Lot Nine (9) in Block Thirty -eight (38) in Russel Wheeler's Addition to the City of Grand
<br />Island, Hall County, Nebraska, and Lot One (1) and the easterly sixteen feet of Lot Two (2) in
<br />Block Seven (7) in the Original Town, now City, of Grand Island, in Hall County, Nebraska.
<br />The Court further finds that the said Albert Sagesser left surviving him the following heirs
<br />at law:
<br />Margaret Sagesser, surviving widow,
<br />Bertha Phelps, daughter,
<br />Ella Sagesser, daughter,
<br />Edward Sagesser, son,
<br />Henry Sagesser, son,
<br />Mabel Patterson, daughter,
<br />Albert Sagesser and Frederick Sagesser, grandsons,
<br />and Ellen Sagesser, now Ellen Sagesser Shoemaker,
<br />grand - daughter, sons and daughter of Herman Sagesser,
<br />a deceased son,
<br />that the Court finds that the aforesaid are the sole and only surviving heirs at law of Albert
<br />Sagesser, deceased, and that they are all of legal age.
<br />The Court further finds that said estate was not subject to inheritance tax under the laws of
<br />the state of Nebraska.
<br />The Court further finds that all claims filed against the estate have been paid, that all the
<br />costs and expenses of administration have been paid, including attorney's fees; that due and
<br />legal notice has been given to all persons of the time and place fixed for filing claims against
<br />said estate, and that such time has fully expired, and that all persons having claims against the
<br />estate of Albert Sagesser, deceased, if any such there be, and not filed herein, are forever
<br />barred and excluded from setting up or asserting any such claims against said estate.
<br />The Court finds that said administratrix has accounted for all receipts and disbursements,
<br />that she has made distribution of all personal property to the said heirs at law under the laws of
<br />descent of the state of Nebraska, and the receipts of such heirs at law are herein filed, and that
<br />there remains no personal property in the hands of the administratrix.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED THAT the final report of Margaret Sagesser,
<br />administratrix of the estate of Albert Sagesser, deceased, be, and the same is hereby approved
<br />and allowed as and for her final report, and said estate is hereby settled and closed.
<br />The Court further finds that the real estate hereinbefore described passed and descended,
<br />under the laws of descent of the state of Nebraska, upon the death of said Albert Sagesser, to
<br />Margaret Sagesser, widow, an undivided one -third interest therein, and to Bertha Phelps, Ella
<br />Sagesser, Edward Sagesser, Henry Sagesser, and Mabel Patterson, sons and daughters, an undivided
<br />one -ninth interest to each; and to Albert Sagesser, Frederick Sagesser, and Ellen Sagesser, now
<br />Ellen Sagesser Shoemaker, an undivided 1/27th interest to each, subject to the homestead interest
<br />of the widow, Margaret Sagesser, in and to Lot 9 in Block 38 in Russel Wheeler's Addition to the
<br />city of Grand Island, in Hall County, Nebraska.
<br />IT IS, THEREFORE, ADJUDGED AND DECREED, that the real described described as follows:
<br />Lot 9 in Block 38 in Russel Wheeler's Addition to the city of Grand Island, in Hall County,
<br />Nebraska,
<br />Lot 1 and the easterly 16 feet of Lot 2, in Block 7, in the Original Town, now City, of Grand
<br />Island, in Hall County, Nebraska,
<br />passed and descended, under the laws of descent of the state of Nebraska, upon the death of said
<br />Albert Sagesser, deceased, to Margaret Sagesser, surviving widow, a one -third interest therein;
<br />to Bertha Phelps, Ella Sagesser, Edward Sagesser, Henry Sagesser, and Mabel Patterson, an
<br />undivided 1 /9th interest to each, and to Albert Sagesser, Frederick Sagesser, and Ellen Sagesser
<br />Shoemaker, an undivided 1 /27th interest to each, subject to the homestead rights of the widow,
<br />Margaret Sagesser, in Lot 9, Block 38, in Russel Wheeler's Addition to the city of Grand Island,
<br />in Hall County, Nebraska.
<br />IT IS FURTHER ORDERED AND DECREED that the time for filing claims against said estate has
<br />fully expired, and that all persons, if any such there be, having claims against said estate,
