Dean, Deceased <br />I, Paul N.Kirk, Judge of the County Court, in and for said County, do hereby certify that on <br />the 6th day of December 194 -3, the instrument purporting to be the last will and testament of <br />Mitchell K.Dean deceased, was filed for probate in this Court. That on the 27th day of January <br />1944, said instrument to which this certificate is attached was duly proved, probated and allowed <br />as the last will and testament of the real and personal estate of said Mitchell K. Dean deceased, <br />and the same was ordered to be recorded in the records of the Court aforesaid. <br />IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the County Court, <br />this 27th day of January, 1944 <br />Paul N. KIRK COUNTY JUDGE <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA. <br />In the matter of the estate <br />of I No.3384 <br />Mitchell K. Dean, Deceased I FINAL DECREE. <br />Now, on this 4th day of October, 1944, this cause came on for hearing upon the final report of <br />Katherine Dean, executrix of the last will and testament of Mitchell K.Dean, deceased, and upon <br />her petition for a settlement of said estate and her discharge. <br />The Court, having examined said report and the records and files and being duly advised, finds <br />that due and legal notice has been given to all persons interested in said estate of the time and <br />place fixed for hearing upon said final report, as heretofore ordered by the Court, and no <br />objections have been made to said report, and the Court having examined the same, together with <br />the vouchers on file and the testimony in support thereof, and being duly advised, finds that said <br />report is true and correct in all things and ought to be approved and allowed as and for the final <br />report of said executrix. <br />The Court finds that Mitchell K.Dean departed this life on November 30, 1943, and that he was <br />on the date of his death a resident and inhabitant of Hall County, Nebraska. <br />The Court finds that a petition was filed herein praying for the allowance and probate of an <br />instrument purporting to be the last will and testament of said Mitchell K. Dean, deceased, the <br />Court thereupon fixed the date for hearing, and for making proof of said last will and testament, <br />due and legal notice was given of the time and place fixed for hearing, and on the 4th day of <br />January, 1944, said instrument was duly proven, allowed and admitted to probate in this Court as <br />and for the last will and testament of said Mitchell K. Dean, deceased, and letters testamentary <br />were duly issued thereon to Katherine Dean, executrix, as named in said last will and testament, <br />and she thereupon qualified as such. <br />The Court finds that due and legal notice has been given to all persons of the time and place <br />fixed by the Court for filing of claims against said estate, and that all claims filed against <br />said estate have been paid; that the time fixed for filing claims has fully expired. <br />IT IS, THEREFORE, ORDERED BY THE COURT that all persons having claims against said estate, <br />if any such there be, and not filed herein, are forever barred and excluded from setting up or <br />asserting any such claims against said estate. <br />The Court further finds that Mitchell K.Dean died seized as the owner in fee simple of the <br />following described real estate in Hall County, Nebraska, to -wit: <br />an undivided one -half interest in and to the west half of the southwest quarter of Section <br />Thirty -one (31), in Township Eleven (11) North, Range Ten (10 West of 6th P.M., in Hall County, <br />Nebraska, and that under and by virtue of said last will and testament, said real estate was <br />devised to Katherine Dean. <br />The Court further finds that there was no state inheritance tax to be paid. <br />The Court further finds that all property belonging to said Mitchell K.Dean at the time of his <br />death was devised and bequeathed to Katherine Dean, and all of said property has been delivered <br />to said devisee, and that there remains nothing further for said executrix to do. <br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of <br />Katherine Dean, executrix, of the last will and testament of Mitchell K.Dean, deceased, be, and <br />the same is hereby, approved and allowed as and for her final report, and said estate is hereby <br />settled and closed and said executrix is hereby discharged and her bond as such is hereby released. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that the real estate belonging to <br />said estate, to -wit: <br />an undivided one -half interest in and to the west half of the southwest quarter of Section 31, <br />in Township 11 North, Range 10 West of 6th P.M., in Hall County, Nebraska, <br />passed and descended, under the terms of the last will and testament of Mitchell K.Dean, deceased, <br />to Katherine Dean. <br />Charles Bossert <br />County Judge. <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA <br />CERTIFICATE <br />STATE OF NEBRASKA, )ss. <br />HALL COUNTY ) I, Charles Bossert County Judge of Hall County, Nebraska, do hereby <br />certify that I have compared the foregoing copy of Last Will and <br />Testament, Certificate of Probate of Will and Final Decree - IN THE MATTER OF THE ESTATE OF MITCHELL <br />K.
