<br />Now on this 27th day of June, 1908, this cause came on to be heard upon the petition of Claus 
<br />Schwartz heretofore filed in this Court showing that Amanda Schwartz died intestate on the 2nd 
<br />day of October, 1904, leaving an estate consisting of an undivided interest in real estate situate 
<br />in Hall County, Nebraska, ?fzhich estate is wholly exempt from attachment, execution or other process 
<br />and not liable for the debts of said deceased, and asking that regular administration be dispensed 
<br />with, and it appearing to the satisfaction of the Court that all persons interested in said estate 
<br />have been notified as required by the order of the court dated June 1, 1908, and there being no 
<br />objection or protest on file, tirnereupon Claus Schwartz, the petitioner, was sworn and examined and 
<br />his testimony reduced to writing and filed in this office.. 
<br />On consideration whereof the Court finds that Amanda Schwartz departed this life intestate, on 
<br />the 2nd day of October, 1904; that she was at the time of her death a resident of Hall County, 
<br />Nebraska; that she was at the time of her death the owner of an undivided one -sixth interest in 
<br />the following described real estate, to- i,,iit : 
<br />The Southeast Quarter of Section 15, and Lot 3 in Section 23, all in Township 10, Range 10, 
<br />West of the 6th P.M. in Hall County, Nebraska, which real 
<br />estate is not now liable for the payment of the debts of the deceased, if any there be, and is 
<br />wholly exempt from attachment, execution or other process. 
<br />The Court finds that the said Amanda Schwartz left surviving her as her -sole heirs at law the 
<br />following named persons: Claus Schwartz, her husband aged 37, residing in Hall County, Nebraska; 
<br />Rosa Schwartz, aged 15, Matilda Schwartz, aged 13, Henry Schwartz, aged 11, Charles Schwartz, 
<br />Aged 7 and Harry Schwartz, aged 4, her children, all of Hall County, Nebraska. 
<br />and that under the laws of the State of Nebraska, the interest of the said Amanda Schwartz in and 
<br />to the said real estate did pass at her death to Rosa Schwartz, Matilda Schwartz, Henry Schwartz, 
<br />Charles Schwartz and Harry Schwartz, in equal shares, to have and to hold to them and their heirs 
<br />and assigns forever subject to the life estate of Claus Schwartz therein. 
<br />The Court finds that administration of said estate may be dispensed with. 
<br />IT IS THEREFORE, ORDERED, ADJUDGED AND DECREED that Administration of the estate of Amanda 
<br />Schwartz, deceased, be dispensed with;That Claus Schwartz, aged 37 years, husband of the deceased, 
<br />and Rosa Schartz, aged 15 years, Matilda Schwartz, aged 13 years, Henry Schwartz, aged 11 years, 
<br />Charles Schwartz, aged 7 years and Harry Schwartz, aged 4 years, her children, all residing in 
<br />Hall County, Nebraska, are the heirs and sole heirs at law of said deceased, under the laws of the 
<br />State of Nebraska, and that the interest of Amanda Schwartz, deceased, in the 
<br />SE4 of Section 15, and Lot 3 in Secti id3, all in Township 10, Range 10, in Hall County, 
<br />Nebraska, did descend at her death to the,�Losa Schwartz, Matilda Schwartz, Henry Schwartz, 
<br />Charles Schwartz, and Harry Sch ?-�artz, share and sharp alike, subject to the life estate of the 
<br />said Claus Schwartz therein.

<br />that said Court has no Clerk authorized to sign certificates inhis own name, and that I am the 
<br />legal custodian of said Seal and of the Records of said Court, and that the foregoing attestation 
<br />is in due form of law.

<br />I, Frederick Eugene Brand, of Grand Island, Hall County, Nebraska, being of sound mind and 
<br />memory, but considering the uncertainty of life, do hereby make, publish and declare this and none 
<br />other to be my last Will and Testament, hereby revoking all other wills by me made. 
<br />FIRST 
<br />I direct that my just debts, if any, and the expenses attending my burial, be first paid. 
<br />SECOND 
<br />I give, devise and bequeath all of my property, both real and personal, to my brother, 
<br />William Wallice Brand, and to my sister, Ida. S.Brand, share and share alike, or in the case of the 
<br />death of either prior to my death, then all of my ;property sh,.,ll go to the survivor of the two 
<br />above named.

<br />In case of the death of both my brother and sister above named prior to my death, then -all of
