Court is a Court of Record havin a seal, which seal is hereto <br />attached; that said Court has no Clerk authorized. to sign certificates in his own name, and that I <br />am the legal custodian of said Seal and of the Records of said Court, and that the foregoing <br />attestation is in due form, of law. <br />IN TESTI` "ONY WHEREOF I have hereu�.tp set my hand and affixed the seal of the County Court, <br />at Grand Island, this 4th fay of October 1; . <br />Charles Bossert <br />(SEAL) County Judge. <br />Filet for record t' -_is ca.y of October, 19 �'' at 11:0" o' cloci� A.M. <br />Register of ee s <br />DECREE <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA <br />IN THE MATTER OF THE ESTATE <br />OF D E C R E E <br />HENRY KAY, DECEASED. <br />"Now on this 6th day of July, 1908, this cause came on for hearing upon the petition of Anna <br />Kay showing that Henry Kay died intestate in Hall County, Nebraska, on the 29th day of April, <br />1591, and that he was at the time of his death the owner of real estate situate in Hall County, <br />Nebraska, which is wholly exempt from attachment, execution or other process, and not liable for <br />the debts of said deceased, and asking that regular administration of said estate be dispensed <br />with and that a decree be entered. naming the heirs, and it appearing to the satisfaction of the <br />Court that due and legal notice has been given all persons interested in the manner required by <br />law and the order of this court, dated June 10, 1905, and no one appearing to object, and there <br />being no objection or protest on file, whereupon Anna Kay, the petitioner was sworn and examined <br />and her testimony reduced to writing and filed in this office. <br />On consideration whereof I find that Henry Kay departed this life on the 29th day of April, <br />1891, in Hall County, Nebraska; that he was at the time of his death a resident of said County <br />and State; that he died intestate; That he was at the time of his death the•owner of the <br />following described real estate, situate in the County of Hall and State of Nebraska, to -wit: <br />The Southeast Quarter of Section Fifteen (15),and Lot Three (3), in Section Twenty -three (23), <br />all in Township Ten (10), Range Ten (10), West of the 6th P.M. <br />which said real estate is now, under the laws of the State of Nebraska, wholly exempt from <br />attachment, execution or other mesne process and is not liable for the debts of the said Henry Kay. <br />The Court finds that the said Henry Kay left surviving him as his,heirs at law, and his only <br />heirs at law, the following named persons: Anna. Kay, his widow, residing at Grand Island, <br />Nebraska; Amanda Schwartz, a daughter, deceased; Nancy Huebner, a daughter, residing at A1da, <br />Nebraska; Rudolph Kay, a son, residing at Grand Island, Nebraska; Charles Kay, a son, residing <br />at Grand Island, Nebraska; Emma Wiese, a daughter, residing at Wood River, Nebraska and Minnie <br />Kay, a daughter, residing at Grand Island, Nebraska. <br />The Court finds that the above described real estate descended at the death of Henry Kay to <br />Amanda Schwartz, Nancy Huebner, Rudolph Kay, Charles Kay, Emma Wiese and Minnie Kay, in equal <br />shares, subject to the homestead and dower interest of Anna Kay. <br />IT IS,THEREFORE, ORDERED, ADJUDGED AND CONSIDERED that regular administration of the estate <br />of Henry Kay, deceased, be dispensed with; that the said Henry Kay died intestate; that he was <br />at the time of his death a resident of Hall County, Nebraska; and the owner of the <br />Southeast Quarter of Section 15, and Lot 3 in Section 23, all in Township 10, Range 10, <br />situate in said County; <br />That said real estate is exempt from attachment, execution or other process and is not liable for <br />the debts of said deceased; and that the following named persons are the sole heirs at law of <br />said deceased under the laws of the State of Nebraska, to -wit: Anna Kay, his widow, aged 56, <br />residing at Grand_ Island, Nebraska; Nancy Huebner, a daughter, aged 30, residing at Alda, <br />Nebraska; Rudolph Kay, a son, aged 28, Charles Kay, a sot:, aged 24; Minnie Kay, a daughter, <br />aged 15, all residing at Grand Island, Nebraska; Emma Wiese, a daughter, aged 22, residing at Wood <br />River, Nebraska. <br />That said deceased left a daughter, Amanda Schwartz who has since departed this life /leaving the <br />following named heirs: Claus Schwartz, her husband; and Rosa Schwartz, Mathilda Schwartz, Henry <br />Schwartz, Charles Schi�rartz and Harry Schwartz, her children all residing at Wood River, Nebraska. <br />J.
