519 <br />IT IS, THEREFORE, DETERMINED AND DECREED BY THE COURT that said Mitchell K.-Dean, husband, <br />Wayne W.Dean, son, and Reva M. Dean, nolq Reva M. Montgomery, daughter, are the sole and only sur- <br />viving heirs at law of said Ella Dean, deceased, also known as Ella May Dean, and that said real <br />estate parsed and descended, under the law of descent of the state of Nebraska, as follows: <br />To Wayne W.Dean and Reva M.Dean,(now Reva M.Montgomery), son and daughter, each an un- <br />divided one -half interest, subject to the homestead interest of said Mitchell K.Dean, <br />surviving husband. <br />That said. IN THE <br />MATTER OF THE ESTATE OF ELLA DEAN, DECEASED, with the original record thereof, now remaining in <br />said Court, that the sam.eais „a correct transcript thereof, and of the whole of such original <br />record; that said Court of e "cord having a seal, which seal is hereto attached; that said Court <br />has no Clerk authorized to sign certificates in his own name, and that I am the legal custodian <br />of said Seal and, of the Records of said Court, and that the foregoing attestation is in due form <br />of law. <br />IN TESTIMONY WHEREOF I have hereunto set my hand and affixed the seal of the County Court, at <br />Grand Island., this 11th day of September, 1944. <br />Charles Bossert <br />(SEAL) County Judge <br />Filed for record this 12th day of September, 1944, at 9:20 o'clock A.M.4 <br />1 <br />Register of De ds <br />0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0- <br />FINAL DECREE <br />IN THE COUNTY COURT OF HALL COUNTY,NEBRASKA <br />IN THE MATTER OF THE .ESTATE OF ) <br />FINAL DECREE <br />JOHN SPECK, deceased ) <br />STATE OF NEBRASKA ) <br />SS At a session of the County Court held in and for said County of Hall <br />COUNTY OF HALL ) and State of Nebraska,this 13th day of September,1944. <br />Present: Charles Bossert,County Judge. <br />BE IT REMEMBERED that on the 18th day of August,1944,Walter Speck,Administrator of the Estate of <br />John Speck,deceased,filed in this Court his final account as such Administrator and a petition <br />praying that said account be allowed,for a decree of heirship,an order of distribution,a final <br />settlement thereon and discharge. <br />For these purposes the 13th day of September,19442at 10 o'clock A.M.at the County Court Room in <br />said County,was assigned as the time and place for hearing said petition,examining and allowing <br />said account;and it was ordered that notice of the pendency of said petition be given to all <br />persons interested in said estate by publishing such notice in the Grand Island Independent,a <br />legal newspaper printed in said County for three weeks prior to said day of hearing ;and it appears <br />by proof on file that notice was given as ordered by Court and that no objections to said final <br />account have been made or filed. <br />Upon examination of the record and the evidence in this matter and being duly advised in the prem- <br />ises, the Court finds as follows: <br />I. <br />That John Speck departed this life on the 4th day of March,1944,while temporarily residing at <br />Spokane ,Washington,intestate,and at the time of his death he was a resident of Hall County,Nebraska. <br />2. <br />That on the 14th day of March,1944,Walter Speck and Ray Speck,his nephews,filed in this Court a <br />petition prayin for the appointment of Walter Speck as Administrator of the estate of said deceas- <br />Court was made therein,assigning the 12th <br />ed,and on the 15th day of March,1944,an order of this <br />day of April,1944,at 10 o'clock A.M.at the County Court Room in said County astthe time and place <br />for hearing said petition,and ordering that notice of the pendency of said pet�,ion and hearing <br />thereon be given to all persons interested in said matter by publishing said notice in the Grand <br />Island Independent,a legal newspaper printed in said County,for three successive weeks prior to <br />said day of hearing,and it appears by proof on file that notice of said order was given as order- <br />ed by this Court. <br />3. <br />The Court further finds that said Walter Speck named in said petition was,upon his giving bond in <br />the sum of $1,000.00,as ordered by this Court,appointed administrator as prayed;the Court further <br />finds that the deceased at the time of his death,was an *remarried man and had never married and thst <br />both his father and his mother preceeded him in death and that he left him no children surviving, <br />and that he left the following heirs -at -law: Lawrence Speck,a brother,and the following nephews <br />and nieces,all heing children of a predeceased brother Charles Speck,to -wit: <br />Walter C.Speck,Ray Speck,Helen Phillips,Clarence J.Speck,Evelyn Samway,all of whom are over the age <br />of 21 years. <br />
