<br />IN THE MATTER OF
<br />THE ESTATE OF
<br />EMIL F.H.SCHULTZ, deceased
<br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA
<br />DECREE
<br />Now on this 30th day of August, 1944, this cause came on to be heard upon the pleadings and
<br />the evidence and was submitted to the Court, on consideration whereof the Court finds that due and
<br />legal notice of this proceeding has been given to all persons interested in said matter, both
<br />creditors and heirs, as required by law. That all statements and allegations set forth in said
<br />petition are true; that the said Emil F.H.Schultz died intestate, a citizen and resident of the
<br />County of Hall and State of Nebraska, on July 23, 1925, seized and possessed at the time of his
<br />death of the following described real estate, to -wit:
<br />An undivided one -half interest in Lot Ten (10) in Block Eleven (11) of Bonnie Brae
<br />Addition to the City of Grand Island,Nebraska.
<br />which was his home at the time of his death and constituted.his homestead; that no application
<br />has been made in the State of Nebraska for the appointment of an Administrator of the Estate of
<br />said deceased; that his heirs and only heirs- at -lalf were his widow, Johanna Schultz, and his
<br />children Fred Beal, Carl Schultz, Ernest Schultz, and Martha A.L.Mendenhall; and the Court hereby
<br />finds and determines that they are the sole and only heirs -at -law of the said Emil F.H.Schultz,
<br />deceased., and that said interest in said real estate descends as follows: to Johanna Schultz an
<br />undivided one -third interest and to Fred Beal, Carl Schultz, Ernest Schultz, and Martha A.L.
<br />Mendenhall, each an undivided one - sixth.
<br />IT IS THEREFORE CONSIDERED, ADJUDGED AND DECREED BY THE COURT, that the real estate above -
<br />described, to -wit: an undivided one -half interest in and to Lot Ten in Block Eleven of Bonnie
<br />Brae Addition to the City of Grand Island,Nebraska, is hereby assigned as follows:
<br />To Johanna Schultz an undivided 1/3
<br />Fred Beal, an undivided 1/6
<br />Carl Schultz, an undivided 1/6
<br />Ernest Schultz 1/6
<br />Martha A.L.Mendenhall 1/6
<br />IT IS THEREFORE CONSIDERED AND ADJUDGED BY THE COURT that all claims and demands against the
<br />estate of said deceased, whether due or to become due, whether absolute or contingent, be and
<br />the same hereby are forever barred.

<br />of his death of the following described real estate, to -wit:
<br />An undivided one - twelfth interest in Lot Ten in Block Eleven of Bonnie Brae Addition to
<br />the City of Grand Island,Nebraska;
<br />that no application has been made in the State of Nebraska for the appointment of an Administrator
<br />of the Estate of said, deceased; that his heirs and only heirs -at -law were his children, Edward
<br />Schultz, Donald Schultz, Violet Sunday, Evelyn Schultz, Aileen Mueller and Emiel Schultz; and the
<br />Court hereby finds and determines that they are the.sole and only heirs -at -law of the said Ernest
<br />Schultz, deceased, and that said Ernest Schultz, deceased, and that said interest in said real
<br />estate descends as follows: To Emiel Schultz, Edward Schultz, Donald Schultz, Violet Sunday,
<br />Evelyn Schultz, and Aileen Mueller, each an undivided one- sixth, subject to the homestead right
<br />therein of Johanna Schultz,mother of said Ernest Schultz, deceased.
