<br />I Frank J.Coates,being on this 21st day of December, 1932, of sound mind do hereby make and publish
<br />this codicil to my last will of March 23, 1929 this codicil being attached to said will and becoming
<br />page three of said will.
<br />Whereas my daughter Evelyn Ruth, mother of James Francis Sherman, departed this life on December
<br />13th, 1932, I hereby bequeath to said James Francis Sherman that part of my estate that would have
<br />been given to my daughter Evelyn Ruth under my will of March 23, 1929, with these provisions;
<br />First- this share is not be be paid to him until he shall have reached the age of twenty -five years,
<br />namely December 15th, 1949.
<br />Second- in the event of his death before December 15th, 19499 his share shall be divided equally
<br />between his surviving children should he have any.
<br />Third- should, his death occur before December 15th, 1949, and he die childless, then in that event
<br />the portion that would be his shall be divided equally between my surviving children.

<br />We, whose names are hereto subscribed, do hereby certify that Frank J.Coates, the testator, signed
<br />his name to the foregoing instrument,consisting of one page of typewritten matter, in our presence
<br />and in the presence of each of us, and declared. it to be the last and at this time the only codicil
<br />to his last will and testament.

<br />I, Paul N.Kirk, Judge of the County Court in and for said County, do hereby certify that on the
<br />19th day of October, 1934, instruments purporting to be the last will and testament and Codicil of
<br />Frank J.Coates, deceased, were filed for probate in this Court. That on the 13th day of November,
<br />1934, said instruments to which this certificate is attached were duly proved, probated and allowed
<br />as the last will and testament and Codicil of the real and personal estate of said Frank J.Coates,
<br />deceased, and the same were ordered to be recorded in the records of the Court aforesaid.
<br />In witness whereof I have hereunto set my hand and affixed the seal of the County Court this
<br />13th day of November, 1934.

<br />and said Harriett E.Coates named in said Will and Codicil thereto, was appointed Executrix thereof
<br />upon furnishing bond in'the sum of $5,000.00 as ordered by this Court, which bond was furnished and
<br />approved; the Court further finds that said Frank J.Coates, at the time of his death was a married
<br />man and that he left the following heirs -at -law and only heirs -at -law, to -wit:
<br />Harriett E. Coates, his widow
<br />George Francis Coates, a son
<br />Mercer Mattes Coates, a son
<br />Stanley Ferris Coates, a son
<br />Donald Robert Coates, a son
<br />Lucile Mary Beck, a daughter
<br />and James Francis Sherman, a grandson,
<br />Sherman,
<br />being the only child of a predeceased daughter Evelyn Coates
<br />all over the age of 21 years excepting said James Francis Sherman.
<br />FOURTH.
<br />The Court further finds that on the 16th day of November, 1934, an order of this Court was made
<br />allowing creditors three months from and after the 11th day of December, 1934, in which to file their
<br />claims against said estate and said. Executrix one year in which to settle said estate, and further
<br />ordering that notice to creditors be published in the Grand Island Independent, a legal newspaper
<br />published and circulating in Hall County, Nebraska, for three successive weeks prior to said 11th
<br />day of December, 1934, and a hearing on claims filed against said estate would be held at the office
<br />of the County Judge of Hall County, Nebraska, on the 11th day of March, 1935, at 9 o'clock A.M.,
<br />and it appears by proof on file that notice of said order was published as ordered by this Court.
<br />FIFTH.
<br />The Court further finds that on the 6th day of*February, 1935, said Harriett E.Coates, Executrix
<br />of said estate, filed in this Court her Inventory of the property of said estate and that according
<br />to said Inventory, the deceased died seized and possessed of the following describe property, to -wit:
<br />The South V feet of Lot 5 in Block 10g, Railroad Addition to Grand Island, being so much of said
<br />Lot 5 as has not heretofore been conveyed to Mercer Coates.

<br />Lots 1 and 2 in Block 4, Arnold's Place with all of Fractional Block 21 in Arnold's and Abbott's
<br />Addition to Grand Island,Nebraska.
<br />The Northeast Quarter of the Northwest Quarter of Section 19,
<br />and the Southeast Quarter of the Southeast Quarter of Section 33, all in Township 16, Range 32,
<br />West of the 6th P.M., Lincoln County, Nebraska.
<br />The Southeast Quarter of Section 11, Township 17, Range 12, West of the 6th P.M., Greeley County,
<br />Nebraska,
<br />and miscellaneous personal property and chattels of the approximate value of $17,000.00.
